RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAHONGA, CALIFOP~IA, HAKING DETERHINATIONS THAT
CONSTRUCTION OF IHPROVEHENTS BY CERTAIN PROPERTY OWNERS HAS
BEF. N SUBSTANTIALLY COMPLETI/D (ASSESSMF.NT DISTRICT NO. 86-?)
WHERFAS, the City Council of the City of Rancho Cucamonga (the
'~ity") is considering the formation of an assessment district, pursuant to the
'~4unicipal Improvement Act of 1913", being Division 12 (commencing with Section
10000) of the Streets and Highways Code, for certain public work and
improvements and acquisitions, if necessary, generally described as follows:
The construction and acquisition of drainage improvements
including appurtenances and appurtenant work, acquisition
of interests in real property, if necessary, and incidental
expenses in connection therewith
(the "Improvements"); and
WHEREAS, the City Council has received a Petition signed by owners of
assessable property within the Assessment District requesting construction
and/or financing and acquisition of Improvements and waiving proceedings and
limitations under Division 4 of the Streets and Highways Code; and
WHEREAS, the City Council has authorized execution of several
agreements entitled "Agreement for Acquisition and Financing" for a portion of
the Improvements, pursuant to Section 664~2 of the Government Code:
NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does
hereby RESOLVE, DETERHINE AND ORDER as follows:
SECTION 1. The above recitals are all true and correct.
SECTION 2. The City Council finds and determines:
(a) That the property owners have substantially completed
construction of a portion of the Improvements,
pursuant to the A~reements for Acquisition and
Financing; and
(b) That the Resolution of Intent/on may be amended to
provide for the acquisition of the Improvements
constructed by the property owners, pursuant to the
A~reements for Acquisition and Financing.
PASSED, APPROVED, and ADOPTED this 21st day of January, 1987.
