Mayor Michael and Members of the City Council presented a Certificate of Sympathy in memory of Linda Bryan, former member of the Rancho Cucamonga Community & Arts Foundation. Mayor Michael noted the certificate would be mailed to the Bryan family. B2. Presentation of a Certificate of Recognition to the Human Resources Department for being Designated as U.S. Best in Class Employer by Gallagher and Awarded the Strategic Leadership and Governance Award by the International City/County Management Association (ICMA). PUBLIC COMMUNICATIONS Two (2) speakers: Sharon Ziese and Paula Rode, spoke about recent inspections, projects pending/completed at Alta Laguna Mobile Home Park, requested that the City continue to support and enforce the terms of the Mobile Home Accord at Alta Laguna Mobile Home Park by Sun Communities located at 10210 Base Line Rd, Rancho Cucamonga, CA 91701 and thanked the City for following up on concerns. Sandie Dubois, spoke about recent coyote sightings at Alta Laguna Mobile Home Park and shared concerns for public/pet safety at the park and surrounding areas. Six (6) speakers: James Gutierrez, Yasmin Cardona-Gutierrez, Husam Suleiman, Phillip Gomez, Nazli Janjua and Avraham Coutin, spoke in support of the So Cal for a Ceasefire Now Coalition and urged the City Council to champion peace and justice through the adoption of a Cease fire Resolution at a future City Council meeting to advocate peace and uphold the sanctity of human life. Avraham Coutin requested the City divest from companies who profit from Israel’s military attacks in Gaza. Phillip Gomez and Yasmin Cardona-Gutierrez provided documents in support of a Ceasefire Resolution, including sample language for a Ceasefire Resolution. Phillip E. Walker, spoke about the success of the 100 Films Retreat Film Festival and thanked Council Member Hutchison for attending the event. D. (CITY) RECOMMENDATION: Staff recommends the City Council adopt the attached 2024 Legislative Platform. BACKGROUND: Each year, there are a multitude of bills introduced in the State Legislature and U.S. Congress that directly impact the operations of municipal government. Often, the City needs to take a position on a particular piece of legislation that will have an impact on the City or local government in general. City staff carefully monitors pending state and federal legislation and once a position is adopted, staff works closely with the City Council to advocate on behalf of the City to members of the State Legislature, the Governor’s office, members of Congress or various state and federal agencies. The 2024 Legislative Platform serves as an outline and reference guide for legislative positions and objectives that shape the actions of both City Council and staff. It is the foundation of a focused advocacy strategy with the primary objective of adopting official City positions on clearly stated legislative issues at the start of the legislative session. It encourages collaboration with Cal Cities and other local agencies in supporting the City’s diverse legislative interests. The City of Rancho Cucamonga does not typically address matters that are not pertinent to local government services or duties, such as socially divisive, partisan, or international affairs. The Legislative Platform is adopted on an annual basis and directs the City’s Legislative Program through the incorporation of key strategic actions that include the communication of legislative positions on proposed Federal, State, and County legislation, measures, initiatives, and governmental regulations, as well as the pursuit of Federal, State, and County funding for City projects, services, and programs. The attached 2024 Legislative Platform builds upon this foundation and has been updated to reflect issues that are anticipated to continue or emerge throughout the upcoming legislative session. Issues that have been resolved or are no longer relevant are typically removed. The Legislative Platform is continually reviewed using the goals and objectives of the City Council, a review of legislative priorities from Cal Cities and other regional agencies, research of current law and pending legislation, as well as input from City departments, local legislative staff, and the City’s legislative advocates.    Page 23 Page 2 2 2 4 6 ANALYSIS: For the 2024 Legislative Platform, staff has taken a comprehensive approach to updating the document. Below are the Guiding Principles and Policy Statements that will allow City staff to address 2024 legislative and regulatory issues in a timely manner, without precluding the consideration of additional legislative and budget issues that may arise during the legislative session. The Legislative Platform authorizes City staff to adopt official City positions. Issues not addressed in this document may require further Council direction. With the Legislative Platform as a guiding document, the City will continue to work with its constituents, consultants, and elected representatives to promote and preserve the City’s interests at the local, state, and federal level.    Page 26 Page | 3 GUIDING PRINCIPLES 1. PRESERVE LOCAL CONTROL Preserve and protect the City’s powers, duties, and prerogatives to enact local legislation and policy direction concerning local affairs and oppose legislation that preempts local authority. Local agencies should preserve and enhance authority and accountability for revenues raised and services provided. 2. PROMOTE FISCAL SUSTAINABILITY Support measures that promote fiscal stability, predictability, financial independence, and preserve the City’s revenue base and maximum local control over local government budgeting. Oppose measures that shift local funds to the County, State, or Federal Governments and/or make cities more dependent on the County, State, or Federal Governments for financial stability, such as mandated costs with no guarantee of local reimbursement or offsetting benefits. 3. SUPPORT EQUITABLE FUNDING OPPORTUNITIES Support opportunities that allow the City to compete for its equitable share of regional, state, and federal funding, and that maintain current funding streams. Funding opportunities may include competitive grant and funding programs as well as dedicated funding streams at the regional, state, and federal levels that allow the City to maximize local revenues, offset and leverage capital expenditures, and maintain City goals and standards. 4. Oppose Efforts To: • Imposes regional, state, or federal growth, development, or land use planning standards within the City in a way that removes or inhibits local control. • Impose a one-size-fits-all approach to housing and land use policies that fail to recognize the efforts cities are making to approve housing projects and the unique housing challenges each city faces. • Punish cities that did not meet their RHNA housing goals by threatening enforcement action, additional state reporting, or loss of funding. • Regulate large freight facilities without providing a balanced approach between reducing air pollution and ensuring the economic vitality of the logistics industry. • Require local governments to lease out public property to the telecommunications industry, limit how much cities can charge for a lease, eliminate the ability for cities to negotiate public benefits and prevent the public’s input and full discretionary review for the installation of “small cell” wireless equipment. • Require cities to modify their permitting process or establish set artificially short and arbitrary timeframes for inspecting and approving local projects.    Page 30 Page | 7 • Further impose additional burdensome requirements on the Surplus Land Act process. • Impose a mandatory cap on local parking standards in transit-intensive areas. • Limit public engagement, design, and environmental review related to housing projects. • Impose statewide standards that erode discretionary oversight on accessory dwelling units. Libraries, Parks, & Open Space Support Efforts To: • Ensure fair and equitable access to digital media, by regulating the book publishing industry to end the practice of e-book and e-audiobook lending restrictions for public libraries, including embargoes on the sales of new titles and allow libraries to purchase these items at the same prices as consumers. • Support the freedom to read and access to material with diverse points of view. • Obtain funding for parks, including the continued build-out of Central Park, and capital improvements to libraries and community facilities, as well as library and recreation programs that enhance the quality of life for residents. • Increase flexibility in funding guidelines to meet disadvantaged community standards. • Provide an ongoing, permanent funding source for the LINK+ interlibrary loan network, which facilitates the free lending of materials between California public and academic libraries. Mandates Oppose Efforts To: • Impose state-mandated costs for which there is no guarantee of local reimbursement or offsetting benefits. • Amend the California Public Records Act requiring public agencies to retain and preserve every public record that is transmitted by electronic email. Oppose Efforts To: • Hinder law enforcement’s ability to access and utilize valuable crime fighting data captured by Automated License Plate Reader (ALPR) cameras. Sustainability Support Efforts To: • Equitably distribute emissions trading revenues in all areas of the state more commensurate with each community’s burden in meeting the State’s overall GHG reduction goals and allow for greater portions of revenues for projects that are located outside of, but still benefit, Disadvantaged Communities as defined by CalEnviroScreen. • Assist municipal utilities in addressing the technical challenges to grid modernization and clean energy development needed to achieve the State’s carbon reduction goals while maintaining affordable electric rates and reliability. • Incentivize solar PV generation, energy storage, and micro-grid technologies for utilities in order to make the transition to renewable energy more financially attractive and help meet the State’s 2030    Page 32 Page | 9 emission targets. • Maintain a competitive net energy metering system to ensure financial incentives for rooftop solar are not significantly diminished with excessive solar penalty fees and reduced credits for selling the excess energy as well as incentivize battery storage. • Provide financial incentives, including grant opportunities, increasing rebates and expanding tax credits, for the purchase of zero-emission vehicles and necessary charging and fueling infrastructure. • Support Legislation that prioritizes the environment and balances the needs of the community. • Support measures that maintain and enhance local decision-making authority in the development and implementation of environmental strategies. • Develop cost-effective and technologically feasible conversion and replacement of vehicles to zero- emission vehicles. • Provide refueling/charging infrastructure for zero-emission vehicles. • Allow flexible standards and fuel diversity for certain emergency and fleet vehicles that require traditional fuel due to technology, range, power outage, and terrain issues. • Support legislation and funding for the procurement of mandated zero-emission fleet vehicles within reasonable timelines and, more importantly, the necessary supporting infrastructure for refueling and charging. • Provide cities and municipal utilities with funding and resources to improve climate resiliency. During this Fiscal Year, there have been various design changes from the Etiwanda Line Extension Project, as well as the increase in new development construction requiring additional design and engineering needs resulting in an increase in contract costs. In addition to the increase in design, there has also been an increase in electrical inspection services and support needed for projects that are currently under construction. The subject proposal would amend the Amended scope of services and establish an exclusive Professional Services Agreement with Westbound Communications Inc. specifically for economic development marketing and communication services independent of the Cucamonga Station/HART District Marketing Outreach Services Agreement (CO #2022-007). BACKGROUND: With the completion of the General Plan Update and the Economic Development Strategy, and the impending development of the Cucamonga Station and HART District, there is an opportunity and a need for implementing the marketing and communications to support the City’s aggressive economic development efforts. In 2022, the City, in partnership with various regional stakeholders, conducted an RFP process for Cucamonga Station/HART District Marketing Outreach and Engagement Services. It will provide commuters and visitors with multiple rail lines, high-speed rail, an evolutionary bus rapid transit system, and a sleek futuristic underground tunnel that connects rail and bus with the Ontario International Airport. The process resulted in eleven RFP responses received and four vendor interviews conducted. The City Council, at its February 16, 2022 meeting, awarded a Professional Services Agreement to Westbound Communications, Inc., (CO #2022-007) which offered the best fit and value for the City and its partners. The City Council, at its October 19, 2022, meeting, approved an Amendment to this scope to incorporate City Economic Development marketing services into the existing Agreement with language that stated, “any future budget augmentation needed will be incorporated as part of either the mid-year or annual budget processes.” The recent completion of the City’s Economic Development Strategy prioritizes a distinct need for an integrated marketing and communications plan to support the economic development efforts and goals for maintaining a world-class community. The need for a budget augmentation for a    Page 44 separate and dedicated Agreement for the Economic Development Marketing & Outreach Support is needed to keep these two dynamic projects with varied project time-lines independent from the original PSA that is reflective of our Cucamonga Station Partnerships. ANALYSIS: Since the October 19, 2022, Amendment was approved, Economic Development staff have been working with Westbound Communications Inc. on developing a marketing and communications plan to assist the City’s overall economic development efforts. The subject item would reallocate the amended scope of services referenced in the October 19, 2022, City Council action to a new, and secondary Westbound Communications Inc. Professional Services Agreement. This would establish an Agreement exclusively for Economic Development marketing, branding and communications services; independent of the Cucamonga Station / HART District Marketing efforts. Staff is recommending that a single-source award be made to Westbound Communications Inc. of Riverside, California, for the continued implementation of the integrated marketing and communications services for the City’s economic development efforts. Westbound Communications’ scope of work will include: •Continued implementation of marketing and communications plan including the ongoing paid media strategy and event marketing (speaking engagements and trade shows). •Assist with media outreach and create thought leadership stories for partner organizations, trade publications, and print and digital advertising. •Assist with marketing tactics such as media relations, web presence and events. The term of the Agreement will be for 24-months with two optional one-year extensions. FISCAL IMPACT: The City’s fiscal year 23/24 budget allocates funding for Westbound’s existing Economic Development scope of work in 10011001-5300 (General Fund, Contract Services). (CITY) RECOMMENDATION: Staff recommends the City Council approve and execute master agreements with twenty-six (26) selected consultant firms to conduct “on-call” CEQA environmental services for 3 years with an option to renew in one-year increments for a total of 5 years. BACKGROUND: The California Environmental Quality Act (CEQA) requires state and local governments to consider the potential effects of a project before deciding whether to approve it. CEQA’s purpose is to disclose the potential impacts of a project, suggest methods to minimize those impacts and discuss alternatives to the project so that decision makers will have full information upon which to base their decisions. CEQA applies to both public and private projects. The Planning and Economic Development Department routinely use environmental consultants to assist in the CEQA analysis of private development projects. Other City departments such as Engineering Services, Community Services and Public Works also utilize CEQA consultants as needed for public projects. To reduce contract redundancies and streamline the procurement process, a Statement of Qualifications (SOQ) was prepared to create an “on-call” consultant list for CEQA services that can be utilized by all City departments. ANALYSIS: The current on-call CEQA consultant list includes eighteen approved consultants. Contracts are set to expire in March 2024. Rather than extending the contracts for an additional year as allowed by the terms in the contract, the Planning and Economic Development Department opted to let the contracts sunset and began the process of obtaining a new on-call list. Obtaining a new list will offer the City a wider variety of options when a CEQA analysis is needed. The Planning and Economic Development Department provided a detailed scope of services to the Procurement Division for the purposes of creating a qualified vendor list for “on-call” CEQA consulting services. A formal request for an SOQ (23/24-501) was posted and advertised in the    Page 46 Page 2 2 2 3 8 City’s electronic bidding system. There were 931 notified vendors, 83 prospective vendors downloaded or reviewed the bid documentation, and 33 responses were received, 31 of which were considered viable. An evaluation panel was formed, and the proposal responses were evaluated and rated in accordance with the criteria identified in the SOQ. The top 26 firms meeting the SOQ requirements were selected. These firms are: Once the “on-call” contracts are executed, the consultants will be utilized as needed and will be selected for a project based on project need and availability. The consultant’s work under each individual contract will have to be authorized by the City, subject to funding availability. Consultants selected are not guaranteed work but are available if/as needed for work up to the contracted amount over the course of the contract term. FISCAL IMPACT: CEQA services for private development projects are funded by the project applicant. For public projects, funding for CEQA services would be appropriated as part of an approved project budget. Design Group - WLA to provide construction services for the Rancho Cucamonga Public Library’s Second Story and Beyond® (SSAB) project. The tenant improvements provided by L.A. Design Group are to provide sound attenuation, a first- floor entry space, install lighting and systems integration, and overall, prepare the space to receive custom, literacy-themed exhibits that change over periods of time, and are designed for children and families. For this project, the City retained the services of Aufbau Corporation for in-field construction management services. Due to prolonged construction time, in September 2023, an increase in the purchase order for Aufbau Corporation of $61,400 was approved by City Council. ANALYSIS: Since awarding the contract to L.A. Design Group, Inc., construction services have progressed, and several change orders have been added to their scope per the architectural services from Cambridge Seven and Associates. Construction is scheduled to end in May 2024. Change orders include structural steel modifications, relocation of existing power outlets, and the addition of low voltage to various exhibit locations. As a result, staff is requesting the approval of contract (No. 2022-121) Amendment No. 1 in an amount not to exceed $47,740 for additional construction services.    Page 48 Page 2 2 2 4 9 The original contract currently has a 10% contingency of $149,990. The Property Owners cast their vote unanimously in favor of the special tax levy for CFD 2022-01. Adoption of the Resolutions constitutes the City Council’s formal action certifying the election results and adding the Annexation Territories to CFD 2022-01 and directs the recordation of an amendment to the existing Notice of Special Tax Lien. By recordation of this amendment, prospective purchasers of the property within the Annexation Territories will have notice of the special tax obligation affecting such properties. WHEREAS, the City Council of the City of Rancho Cucamonga, California (the “City Council”) has previously formed Community Facilities District No. 2022-01 (Street Lighting Services) of the City of Rancho Cucamonga (“CFD No. 2022-01”) pursuant to the Mello-Roos Community Facilities Act of 1982 (the “Act”), as amended, for the purpose of financing certain municipal maintenance services; and WHEREAS, acting pursuant to the Act, the City Council also authorized by the adoption of Resolution No. 2022-063 (the “Resolution Authorizing Future Annexation”) the annexation in the future of territory to CFD No. 2022-01, such territory designated as Future Annexation Area, Community Facilities District No. 2022-01 (the “Future Annexation Area”); and WHEREAS, at this time the unanimous consent to the annexation of certain territory located within the Future Annexation Area to CFD No. 2022-01 has been received from the property owner of such territory, and such territory has been designated as ANNEXATION NO. 2024-7 (the "Territory"); and WHEREAS, less than twelve (12) registered voters have resided within the Territory for each of the ninety (90) days preceding the election date established for the Territory, therefore, pursuant to the Act the qualified elector of the Territory shall be the "landowner," as such term is defined in Government Code Section 53317(f), of such Territory and such landowner who is the owner of record as of the applicable election date, or the authorized representative thereof, shall have one vote for each acre or portion of an acre of the parcel of land that landowner owns within such Territory; and WHEREAS, the time limit specified by the Act for conducting an election to submit the levy of the special taxes on the Territory to the qualified elector thereof and the requirements for impartial analysis and ballot arguments have been waived with the unanimous consent of the qualified elector of the Territory; and WHEREAS, the City Clerk of the City of Rancho Cucamonga has caused a ballot to be distributed to the qualified elector of the Territory, has received and canvassed such ballot and made a report to the City Council regarding the results of such canvass, a copy of which is attached as Exhibit “A” hereto and incorporated herein by this reference; and    Page 86 Page 2 of 3 ATTACHMENT 6 WHEREAS, at this time the measure voted upon and such measure did receive the favorable vote of the qualified elector of the Territory, and the City Council desires to declare the results of the election; and WHEREAS, a map showing the Territory and designated as Annexation Map No. 2024-7 (the "Annexation Map"), a copy of which is attached as Exhibit “B” hereto and incorporated herein by this reference, has been submitted to this legislative body. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Rancho Cucamonga, California, acting as the legislative body of Community Facilities District No. 2022-01, as follows: Section 1. Recitals. The above recitals are true and correct. Section 2. Findings. This legislative body does hereby further determine as follows: A. The unanimous consent as described in the recitals hereto to the annexation of the Territory to CFD No. 2022-01 has been given by the owner of the Territory and such consent shall be kept on file in the Office of the City Clerk of the City of Rancho Cucamonga. B. Less than twelve (12) registered voters have resided within the Territory for each of the ninety (90) days preceding the election date established for the each of the parcels located within the Territory, therefore, pursuant to the Act the qualified elector for the Territory shall be the "landowner" of the Territory as such term is defined in Government Code Section 53317(f). C. The qualified elector of the Territory has voted in favor of the levy of special taxes on the Territory upon its annexation to CFD No. 2022-01. Section 3. Territory. The boundaries and parcels of property within the Territory and on which special taxes will be levied in order to pay for the costs and expenses of authorized municipal maintenance services are shown on the Annexation Map as submitted to and hereby approved by this legislative body. Section 4. Declaration of Annexation. This legislative body does hereby determine and declare that the Territory, and each parcel therein, is now added to and becomes a part of CFD No. 2022-01. The City Council, acting as the legislative body of CFD No. 2022-01, is hereby empowered to levy the authorized special tax within the Territory. Section 5. Notice. A copy of the Annexation Map as approved shall be filed in the Office of the County Recorder no later than fifteen (15) days after the date of adoption of this Resolution. B. Section 6. Effective Date. This Resolution shall become effective upon its adoption.
