BACKGROUND Plans and specifications have been completed for the addition of a canopy at the main employee entrance on the north side of City Hall for weather protection. This entry is used not only for entry purposes but for loading of material and equipment. The canopy will provide sufficient weather protection so that these activities can be better accommodated. The structure will match the architectural design and materials of the City Hall building. The design has been reviewed and recommended by the Public Works Subcommittee. Gillespie, Traffic Engineer CONSIDERATION OF A RECOMMENDATION TO INSTALL ALL-WAY STOP CONTROL AT THE INTERS ECTION OF CAMINO PREDERA AND PREDERA COURT RECOMMENDATION It is recommended by the Public Works Subcommittee that the City Council approve the installation of an all-way stop control at the intersection of Camino Predera and Predera Court. BACKGROUND/ANALYSIS On April 5, 1998, City staff received a letter from Mr. Charles J. Buquet, Jr. requesting the installation of all-way stop control at the intersection of Camino Predera and Predera Court. The location of the intersection of Camino Predera and Predera Court is shown on the attached Figure In his letter, Mr. Buquet indicated that he desired the installation of all-way stop signs at the subject intersection in order to control vehicle speed. Mr. Buquet indicated that in his opinion, Camino Predera was improperly designed, and therefore, a special circumstances determination should be made in order to warrant the installation of all-way stop signs. The deficiencies identified by Mr. Buquet were as follows: Camino Predera has an 18% down grade and the maximum grade allowed by City policy is 12%. 2. Camino Predera has a 200 ft radius curve, and traffic travels too fast for the curve. 3. Camino Predera has a negative super elevation around the curve. The combination of downgrade, curvature, and negative super elevation combine to create a dangerous situation. CITY COUNCIL STAFF REPORT STOP SIGNS ON CAMINO PREDERA August 5, 1998 Page 2 5. Camino Predera has become a "hang-out" for local teenagers who park their cars and party along Camino Predera at night. 6. Box 807 Rancho Cucamonga, CA 91730 Re: Camino PrederaJPredera Court Traffic Control Stop Sign Dear Mr. Gillespie: As you will recall, I recently spoke to you concerning the excessive speed and degree of traffic on Camino Predera. I am formally requesting your serious consideration for installation of a two-way stop at the referenced intersection based upon the following: Camino Predera is a street that was built to facilitate a custom lot subdivision on the southeast side of the Red Hill area of the City. This subdivision did not proceed as originally intended, resulting in a street that was built to serve the eight houses actually constructed. Camino Predera is a winding street with a significant grade differential, as it connects with Red Hill Country Club Drive at its highest point and eastern lowest point. Camino Predera is curremly a loop to Red Hill Country Club Drive, as its only connection is to Red Hill Country Club Drive at both ends. Camino Predera has become a short-cut for traffic attempting to avoid the intersection of Foothill and Vineyard. Traffic on this street is particularly heavy during rush hour commute periods and weekends. Traffic on Camino Predera has been consistemly observed to be traveling at speeds greater than safe for design and configuration. Cars have been firequently observed traveling between 45 and 55 miles per hour on this street, particularly traffic traveling downgrade on Camino Predera. In June, 1997, a vehicle Traveling at a high rate of speed lost control and crashed into the house north of our residence. This accident involved a youthful driver, which as been observed to be what a majority of drivers are that use this street. There is also a prior accident where a youthful driver Traveling downgrade lost control and had a solo rollover accident on this street. During inclement weather conditions, traffic travels at excessive speeds that are unsafe for the road design and configuration. On at least seven occasions since October 1997, I have observed or heard vehicles lose traction and slide while at-tempting to brake and regain control of their vehicle. On one occasion at approximately 10:30 p.m., I observed a pickup track lose control and head directly toward me while I was standing in my bedroom, which is located approximately 20' from the curb face. This vehicle was able to regain control before hitting the curb and return to the proper side of the road for downgrade traffic travel. On three occasions, I have almost been hit head-on by speeding vehicles on the wrong side of the roadway at the curve located between Predera Court and Calle Corazon. I have personally witnessed two similar near misses on occasions where I was in my driveway and front yard area. This situation is exacerbated by the fact there are no streetlights on the older portion of Camino Predem north of this s-curve. I am personally very concerned that myselfand/or spouse will become victims of a serious accident resulting from the reckless travel that occurs on a daily basis on this street. In my professional life, I have performed public ent ?Jsk Management services for over 100 cries and San Bernardino C :y. My training and experience has resulted in my ability to recognize · . ..gn defect and hazardous roadway conditions. This street warrants very setiota:. consideration of any and all measures necessary to provide for the safety of the residents who live and travel on this street. This degree of safety does not currently exist on this street. Camino Predera has become an attractive nuisance for youthful drivers of our community, which may account for why a considerable number of the traffic trips involve youthful drivers. Sheriff's Department patrol staff refer to Camino Predera as a "Party Point", which is due to the rural character and view of the valley from this street. During evenings and hours of darkness, vehicles park along this street, with the heaviest such activity being on Thursday through Sunday of each week. These vehicles are occupied by juveniles who turn their stereos up and eat and consume alcoholic beverages for extended periods of time. I am personally getting very tired of the fast food litter left on the street and shoulders that blows into my yard and driveway, as well as the beer cans and broken bottles that are lef~ behind by these individuals. On a few occasions, I have had to call the Sheriff' s Department when the partying gets out of hand and they start racing up and down the street. I have tried to limit the calls to the Sheriff's Department, as my many years of patrol experience makes me well aware that they have more pressing issues than to chase down parting juveniles that start to act stupid. I wish to thank you in advance for your anticipated attention and follow-up with the issues outlined in the foregoing. I believe, that at a minimum, a two-way stop should be placed on Camino Predera at Predera Court. I believe that this, along with a two-way stop at Calle Corazon, would prove to be very effective in deterring the number of traffic trips, as well as reducing the degree of speeding that is currently a daily occurrence on this street. It has been my experience that drivers like to travel on roadways with the least amount of stops or signals. I would prefer to see those using this street as a speedy shortcut return their travel to streets intended and designed for such travel. During our last conversation on this issue, you suggested circulating a petition for the local residents to sign as a basis for additional traffic control measures on this street. I am trying to avoid having this 'become a political issue. I believe that you have within your authority the ability to make a special circumstances determination with regard to Camino Predera. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING PARCEL MAP NO. 15155, IMPROVEMENT AGREEMENT, AND IMPROVEMENT SECURITY WHEREAS, Tentative Parcel Map No. 15155, submitted by Master Development Corporation, and consisting of eight parcels located at the northwest comer of Jersey Boulevard and White Oak Avenue, being a division of 6.9 acres of land was approved by the Planning Commission of the City of Rancho Cucamonga on May 13, 1998, and is in compliance with the State Subdivision Map Act and Local Ordinance No. 28 adopted pursuant to that Act; and * WHEREAS, Parcel Map No. 15155 is the final map of the division of land approved as shown on said Tentative Parcel Map; and WHEREAS, all of the requirements established as prerequisite to approval of the final map by the City Council of said City have now been met by entry into an Improvement Agreement guaranteed by acceptable Improvement Security by Master Development as developer; and WHEREAS, said Developer submits for approval said Parcel Map offering for dedication, for street, highway and related highway purposes, the streets delineated thereon. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA HEREBY RESOLVES, that said Improvement Agreement and said Improvement Security submitted by said developer be and the same are hereby approved and the Mayor is hereby authorized to sign said Improvement Agreement on behalf of the City of Rancho Cucamonga, and the City Clerk to attest; and that the offers for dedication and the final map delineating the same for said Parcel Map No. 15155 is hereby approved and the City Engineer is authorized to present same to the County Recorder to be filed for record. BACKGROUND/ANALYSIS On January 14, 1998, the Planning Commission adopted Resolution No. 98-02 approving Development Review 97-35 to construct single family residences on thirteen in-fill lots. Northtown Housing Development Company (NTHDC) is currently processing DR 97-35 as phase two of its In-fill Housing Program. In conjunction with this processing, NTHDC has requested the vacation of certain unimproved alleys that are contiguous to houses proposed for this phase of in-fill housing. These alleys are either currently not being used for access by adjacent properties or have been fenced in by property owners and are inaccessible. Basically, these alleys are just "paper" alleys that were created with the original North Cucamonga Subdivision in 1887 and are not needed for public use. Utility companies, other agencies and City divisions have been notified of the proposed vacations and were asked for their comments. There were no objections to the vacation from any of the groups notified. If the alleys are vacated, half the width (10 feet) will revert to the adjoining and adjacent lots. Most of the affected and adjacent property owners have been contacted by NTHDC and none have voiced an unfavorable opinion on the vacation. However, all the affected and neighboring owners have been notified by mail of this proposed vacation and public hearing. The owners, mailing names and addresses were taken from the County Tax Assessor's latest equalized assessment rolls. BACKGROUND: The Terra Vista Park Development Agreement No.1 became effective on June 7, 1984, and was supplemented by the First Supplemental Agreement on November 5, 1996. ANALYSIS: The applicant, Lewis Homes Development Company, has requested an amendment to Terra Vista Park Development Agreement to address private recreational facilities in Terra Vista neighborhoods for which park credit has not been requested. Currently, Lewis Homes has built approximately 58 percent of the total public parks, trails, and green ways as contemplated in the Terra Vista Community Plan. At the same time they have completed approximately 48 percent of the total dwelling units allowed in the plan. Therefore, the ratio of development of park area to the construction of dwelling units is slightly ahead, without considering the issue of private recreation facilities. Provisions of the Amendment will allow Lewis Homes to request park credit for previously developed private recreation areas for which park credit has not been calculated, and for which park credit has not been approved. Pat Loy, Lewis Homes, 1156 North Mountain Avenue, Upland, stated they have built facilities but didn't follow through with the process of filing the paperwork to claim credit. Hearing no further testimony, Chairman Barker closed the public hearing. CommissionerMacias asked the net effect of the proposed amendment with respect to public park facilities. Brad Bullet, City Planner, stated the developer must meet certain open space requirements under the Terra Vista Community Plan. He said the only missing element was that the developer did not get approval in advance. He said that if the City denies the amendment, it would most likely mean more park space because the developer would have to make up the park space he thought he provided. He reported that if the amendment were approved, the Planning Commission will review the developer's application for credit for the existing open space. Chairman Barker commented about a recent newspaper a~icle that the City does not have as much park space as other cities. Hearing no further testimony, he closed the public hearing. Commissioner Macias observed that the developer had the ability to request park credit for the private recreational facilities but had not followed through to request that credit. He thought it would be appropriate to accept staff's recommendation to approve the proposed amendment because it would not change the criteria. Commissioner McNiel commented that if park credit is granted. the developer will be in compliance with the park requirements. He asked if that meant more homes will be built. Mr. Bullet stated that would not necessarily be the case and noted the PIaning Commission has the final say on any proposed open space. Commissioner Bethel felt it would be unfair to the developer if the amendment is not approved. Recitals. follows: The California Government Code Section 65868 et. seg., provides, in pertinent part, as A development agreement may be amended, or canceled in whole or in part, by mutual consent of the parties to the agreement or their successors in interest. 2. On June 7, 1984, the parties hereto entered into a Development Agreement concerning the development of parks, trails, and green ways in accordance with the Terra Vista Community Plan, which was subsequently Supplemented on November 5, 1996 (hereinafter referred to as "the agreement"). 3. The applicant, Lewis Homes Construction Company, Inc., Lewis Development Company, Western Land Properties, and Lewis Homes of California, has requested the First Amendment to Terra Vista Park Development Agreement No. 1, as supplemented, as described in the title of this Ordinance. Hereinafter in the Ordinance, the subject amendment is referred to as the "request." 4. On June 24, 1998, the Planning Commission of the City of Rancho Cucamonga conducted a fully noticed public hearing and recommended approval of this request. 5. On August 5, 1998, the City Council of the City of Rancho Cucamonga conducted a duly noticed public hearing on the request. 6. All legal prerequisites prior to the recordation of this Ordinance have occurred. B. Ordinance. NOW, THEREFORE, THE CITY Council of the City of Rancho Cucamonga does hereby find, determine, and ordain as follows: 1. This Council specifically finds that all facts set forth in the Recitals, Part A, of this Ordinance are true and correct. 2. Therefore, pursuant to Section 65868, et, seg. FIRST AMENDMENT TO TERRA VISTA PARK DEVELOPMENT AGREEMENT NO. 1 This First Amendment ("Amendment") to Terra Vista Park Development Agreement No. 1 is entered into as of the 2rid day of June, 1998, by and between Rosebud Construction, Inc., a California corporation, formerly known as Lewis Construction Co., Inc.; Western Land Properties, a California Limited Partnership formerly known as Western Properties, a general partnership; Lewis Homes of California, a general partnership; and Lewis Development Co., a general partnership (hereinafter, collectively, "Lewis"), and the City of Rancho Cucamonga, a Municipal Corporation (hereinafter, "City"). This Amendment amends that certain Terra Vista Park Development Agreement No. 1, which was effective as of the 7th day of June, 1984, and supplemented by that First Supplemental Agreement to Terra Vista Park Development Agreement No. 1, which was entered into as of the 5th day of November, 1986 (hereinafter, collectively, the "Agreement"). Lewis and City are sometimes hereinafter referred to individually as a "Party" and collectively as the "Parties." RECITALS Section IV of the Park Implementation Plan attached to the Agreement as Exhibit "A," indicates that public and private recreation areas for which park credit will be requested will be identified in the development submittal and that the Tentative Map will identify those public and private areas within the project for which park credits need to be granted. Since the execution of the Agreement, Lewis has developed various private recreation areas for which the Parties have not calculated park credit. The Parties now desire to authorize expressly the calculation by the Parties and the approval by City of private area park credit for those previously developed private recreation areas, subsequent to Tentative Map approval. NOW, THEREFORE, in consideration of the foregoing and the mutual covenants set forth herein, Lewis and City agree as follows: Notwithstanding the provisions of Section IV of the Park Implementation Plan attached to the Agreement, as to those previously developed private recreation areas for which the Parties have not yet calculated park credit and for which park credit has not yet been approved by the City, the Parties agree that such calculation and approval may occur subsequent to Tentative Map approval. Background: In May, 1995 a formula System was adopted to phase out the utility tax beginning in FY 96/97. The proposed reductions were discussed in the most recent budget workshops and adopted by Council in the FY 98/99 budget with provisions for specific fee reductions. This amendment to the resolution requires two readings with an effective date of August 31, 1998. The utility tax rate will be reduced from 3.91% to 3.48% or 11%. Also the maximum cap is reduced from $28,400 to $25,140 or 11% for industrial/business users. Section 3.48.050.A of the Rancho Cucamonga Municipal Code is hereby amended to read, in words and figures, as follows: "A. There is imposed a fee upon every person using electrical energy in the City. The fee imposed by this section shall be at the rate of 3.91 pcrecr~t (3.91%) 3.48 percent (3.48%) of the charges made for such energy by an electrical corporation providing service in the City and shall be paid by the person using the energy. The fee applicable to electrical energy provided by a non-utility supplier shall be determined by applying the fee rate to the equivalent charge the service user would have incurred if the energy used had been provided by the electrical corporation franchised by the City. Non-utility suppliers shall install and maintain an appropriate utility-type metedng system which will enable compliance with this section. 'Charges,' as used in this section, means charges made for: (1) metered energy and (2) minimum charges for service, including customer charges, service charges, demand charges, standby charges, and all other annual and monthly charges, fuel or other cost adjustments authorized by the California Public Utilities Commission or the Federal Energy Regulatory Commission." Ordinance No. 558-B Page 2 SECTION 4: SECTION 5: Section 3.48.060.A. 1 of the Rancho Cucamonga Municipal Code is hereby amended to read, in words and figures, as follows: "A.1. There is imposed a fee upon every person in the City, other than a gas corporation or electrical corporation, using gas in the City which is transported through mains or pipes or by mobile transport. The fee imposed by this section shall be at the rate of 3.01 pereclat (3.01%) 3.48 percent (3.48%) of the charges made for the gas and shall be paid by the person using the gas. The fee applicable to gas or gas transportation provided by non- utility suppliers shall be determined by applying the fee rate to the equivalent charges the service user would have incurred if the gas or gas transportation had been provided by the gas corporation franchised by the City." Section 3.48.070.A of the Rancho Cucamonga Municipal Code is hereby amended to read, in words and figures, as follows: "A. There is imposed a fee upon every person in the city using water which is delivered through mains or pipes. The fee imposed by this section shall be at the rate of 3.91 pcreg~t (3.01%) 3.48 percent (3.48%) of the charges made for such water and shall be paid by the person paying for such water." SECTION 6: Section 3.48.140 of the Rancho Cucamonga Municipal Code is hereby amended to read, in words and figures as follows:This Ordinance shall be deemed effective on Novcmbcr 15, 1997 August 3'1, 1998. "A. Whenever the calculation of the amount of any fee due and owing under this chapter is alleged to have resulted in an overpayment or a payment more than once, it may be refunded by the Finance Director as provided in this section subsections "B" and "C" of this section, provided a claim in writing therefor stating under penalty of perjury the specific grounds upon which the claim is founded, is filed with the Finance Director within one year of the date of the claimed overpayment. The claim shall be on forms furnished by the Finance Director. "a. A service supplier may claim a refund or take as credit against fees collected and remitted an amount overpaid or paid more than once when it is established that the person from whom the fee has been collected did not owe the fee. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases are declared unconstitutional or preempted. The City of Rancho Cucamonga provides several options to serve the teens of the community. Following please find a brief overview of the programs offered for teens within the Community Services Department and other agencies within the City. ANALYSIS Rancho Cucamonga YMCA The Rancho Cucamonga YMCA offers a Teen Summer Program for sixth through eight graders. The program is called "Summer Teen Club" and is located at Ruth Musser Middle School. The teens participate in indoor activities and have lunch at this site and then are transported to various field trip locations. A snack is provided daily for each participant. Some additional features include: · Activities, Crafts and Field Trips · Offered 5 day per week (Monday - Friday) · Offered from 6:30 a.m. - 6:30 p.m. (12 hours per day) · Cost of $100.00 per child per week for the summer. · Additional 10% discount for enrolling a second child from the same family. Additional YMCA Teen Programs Leadership Club - Develop camp counselor skills & leadership skills. Focus on trips and volunteers for Community Service projects. Leadership School - For Teens 14-17 years old. Participate at resident camps and learn how to deal with children as a C.I.T. (Counselor In Training), learn first aid skills, effective disipline behavior, etc. ':/7 Page 2 August 5, 1998 Teen Program Overview and Comparison C.I.T. 's and Camp Counselors - Highschool teens and college students participant in these programs at summer camps for younger campers. Y.O.C. (Your Own Club) - Teen middle school to high school freshmen, teens meet at Old Town Park and Villa de Norte. Youth In Government - High school teens meet weekly during school year and once or twice monthly in the summer. The YMCA also works in collaboration with local high school students who need to fulfill community services hours for their school. They volunteer in the YMCA's youth sports programs. This Fall, the Y.M.C.A. anticipates on beginning a Middle school to Junior High School version of Youth in Government. City of Rancho Cucamonga Programs After School Teen Program - The After School Teen Program was initiated on March 30, 1998 at the Family Sports Center. During the school year the program operates from Monday through Friday, 2:30 p.m.- 6:30 p.m. During the summer the program operates from Monday - Friday, 9:00 a.m. - 5:00 p.m. Weekend hours will be implemented based upon approval. The initial $30,000 grant provided purchases such as: two billiard tables, large screen television, football, ping pong table, three smaller televisions with Nintendo systems and various games. The addition of special events, tournaments and theme activities are also starting to surface. Teen Learning Center (TLC) - Formed in the Summer of 1995. Since its inception 130 teens have volunteered more than 6,500 hours in Community Services programs such as Day Camp, Play Camp and Pee Wee Sports. Teen Trips - Since 1991, approximately 8,500 teens have gone on approximately 75 excursions. Teen Recreation Activity Club(TRAC) - Formed in 1989. As of May 1998 teens have volunteered over 24,000 hours of service to the City and raised over $67,000 through their snack bar fundraiser. Teen Job Fair - Held in 1995, 1996 and 1997. Attendance for all three years totaled 900. This event is expected to return in 1998. College Fair - Inaugural event in 1997. Eighty colleges and universities were represented and over 2,000 attended. This event is planned to return in October of 1998. Page 2 August 5, 1998 Teen Program Overview and Comparison Other Community Teen Programs Hillside Community Teen Program - The Church provides a teen program called EDGE. It accommodates junior high and high school students. It meets all summer, one day a week and usually includes a trip to the beach or amusement park, followed by bible study. During the school year, they meet once a week on Tuesdays for 1 ½ hours and participate in games and bible study. Alta Loma Christian Church - The Church provides a summer vacation bible school for teens that provides games, crafts, trips, and bible study. Shepherd of the Hills Church - The Church has a youth group for its members that meets on Wednesdays from 6 p.m. to 9 p.m., for ages 10 - 18. There is no admission fee. The costs are supported by fund-raises. SUMMARY Staff invited representatives from other teen programs to speak about their programs. Other churches, such as St. Peter and St. Paul, the Mormon stakes, and many others also provide opportunities for the teens throughout the year. Hopefully, some of these organizations may also be available to present what they offer for the teens of the community. Staff invited representatives from all of the above organizations.
