A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, SUMMARILY ORDERING
THE VACATION OF A PORTION OF PREVIOUSLY DEDICATED
RIGHT-OF-WAY FOR CHURCH STREET, LOCATED AT THE
SOUTHEAST CORNER OF CHURCH STREET AND EAST ELM
AVENUE
WHEREAS, by Chapter 4, Article 1, Section 8334 (a), of the Streets and Highway
Code, the City Council of the City of Rancho Cucamonga is authorized to summarily vacate excess
right-of-way hereinafter more particularly described; and
WHEREAS, the City Council found all the evidence submitted that the portion of
Church Street right-of-way is no longer required for street and highway purposes.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rancho
Cucamonga as follows:
SECTION 1: That the City Council of the City of Rancho Cucamonga hereby
makes its order vacating that portion of Church Street, as shown in file V-148, on
file in the office of the City Clerk of the City of Rancho Cucamonga, which has been
further described in a legal description which is attached hereto, labeled Exhibits "A"
and "B," and by this reference made a part thereof.
SECTION 2: That from and after the date this resolution is recorded, said portion
at the southeast corner of Church Street and East Elm Avenue no longer constitutes
a public right-of-way.
SECTION 3: That the subject vacation shall be subject to the reservations and
exceptions, if any, for existing utilities on record.
