HomeMy WebLinkAbout97-094 - ResolutionsRESOLUTION NO. 97-094 A RESOLUTION OF THE CITY COUNCIL OF CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING A DETERMINATION OF PUBLIC CONVENIENCE OR NECESSITY AND A REQUEST FOR THE ISSUANCE OF AN ALCOHOL BEVERAGE CONTROL LICENSE FOR A LIQUOR STORE, LOCATED AT 8045 VINEYARD AVENUE, SUITE I-8, AT THE NORTHEAST CORNER OF FOOTHILL BOULEVARD AND VINEYARD AVENUE - APN: 208- 101-23. A. RECITALS, 1. Saadoun Ghayour has filed an application for an off-site sale of liquor, beer, and wine license from the Department of Alcohol Beverage Control. 2. Section 23958 of the Business and Professional Code requires the City of Rancho Cucamonga to make a determination that the issuance of the said license will serve the public convenience or necessity. 3. On the 16th day of July 1997, the City Council of the City of Rancho Cucamonga reviewed said application prior to the adoption of this Resolution. 4. All legal prerequisites prior to the adoption of this Resolution have occurred. B. RESOLUTION. NOW, THEREFORE, it is hereby found, determined, and resolved by the City Council as follows: 1. This Council hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Council during the above-referenced meeting on July 16, 1997, including written and oral staff reports, together with public testimony, this Council hereby specifically finds as follows: On March 19, 1990, Conditional Use Permit 90-04 was issued for a liquor store located at 8045 Vineyard Avenue, Suite I-7. On June 24, 1997, Conditional Use Permit 97-18 was issued for the relocation of an existing liquor store to a directly adjacent tenant suite, Suite I-8. Resolution No. 97-094 Page 2 b. The site is located along two major arterial streets, which is suited for this type of business. c. The site is not close to sensitive users such as day care facilities, schools, or churches. d. Rancho Cucamonga residents would be afforded more shopping opportunities for personal and convenience items. 3. Based upon the findings set forth in paragraphs 1 and 2 above, this Council concludes that the off-site sale of liquor, beer, and wine will not have a negative impact to the surrounding uses. 4. Based upon the findings and conclusions set forth in paragraphs 1, 2, and 3 above, this Council hereby determines that the issuance of and Off- Sale General license for a liquor store serves the public convenience or necessity. 5. The City Clerk shall certify the adoption of this Resolution. PASSED, APPROVED, AND ADOPTED this 16th day of July, 1997.
