HomeMy WebLinkAbout96-136 - ResolutionsRESOLUTION NO. 96-136 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING A DETERMINATION OF PUBLIC CONVENIENCE AND REQUEST FOR THE ISSUANCE OF AN ABC LICENSE WITHIN AN IMPACTED CENSUS TRACT FOR A DRIVING RANGE. RANCHO VALLEY GOLF CENTER, LOCATED AT 11670 ARROW ROUTE. A. Recitals. 1. Rancho Valley Golf Center has filed an application for an on-site sale and consumption of beer license from the Department of Alcoholic Beverage Control (ABC). 2. Section 23958 of the Business and Professional Code requires the City of Rancho Cucamonga to make a determination that the issuance of the said license will serve the public convenience or necessity. 3. On the 2nd day of October 1996, the City Council of the City of Rancho Cucamonga reviewed said application prior to the adoption of this Resolution. 4. All legal perquisites to the adoption of this Resolution have occurred. B. Resolution. as follows: NOW, THEREFORE it is hereby found, determined, and resolved by the City Council 1. This Council hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this resolution are true and correct. 2. Based upon substantial evidence presented to this Council during the above referenced meeting on October 2, 1996, including written and oral staff reports, together with public testimony, this Council hereby specifically finds as follows: a. Rancho Valley Golf Center is located at 11670 Arrow Route and its primary business is a driving range with a clubhouse. b. The serving of beer is considered as incidental to the driving range, the club house and is an amenity for the players. The bulk of the land area in census tract 21.00 where the driving range is located is zoned industrial which accounts for the low limit for on-site sale and consumption of beer licenses. The majority of the population is located west of Haven Avenue. Resolution No. 96-136 Page 2 d. Rancho Valley Golf Center is not in close proximity to sensitive users such as day care facilities, schools, or churches. The site is next to the City's Adult Sport Complex, which also serves beer. However, the sports park is oriented toward Rochester Avenue and Foothill Boulevard, while the driving range is oriented toward Arrow Route. Staff does not foresee a conflict because of their close proximity to one another. Rancho Valley Golf Center is surrounded by vacant land on the north and west sides, by industrial development on the south side and by a sports park on the east side. 3. Based upon the findings set forth in paragraphs I and 2 above, this Council concludes that the on-site sale and consumption of beer within a clubhouse of a driving range will not have a negative impact to the surrounding uses. 4. Based upon the findings and conclusions set forth in paragraphs 1,2, and 3 above, this City Council hereby determines that the issuance of an on-site sale and consumption of beer license for Rancho Valley Golf Center serves public convenience and necessity. 5. The City Clerk shall certify the adoption of this resolution. PASSED, APPROVED, AND ADOPTED this 2nd day of October, 1996.
