HomeMy WebLinkAbout95-160 - ResolutionsRESOLUTION NO. 95-160 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA APPROVING THAT CERTAIN DISPOSITION AND DEVELOPMENT AGREEMENT BY AND BE'I'VVEEN THE RANCHO CUCAMONGA REDEVELOPMENT AGENCY AND ORANGE HOUSING DEVELOPMENT CORPORATION, INC. Aw Recitals. (i) The City of Rancho Cucamonga supports the Agency's efforts to disposition and redevelopment of affordable rental housing available to qualifying senior citizens. In furtherance of this goal, the Agency proposes to sell property which it now owns, generally described as Assessors Parcel No. 208-031-75, a 4.8 acre parcel located on the south side of Baseline Avenue, to Orange Housing Development Corporation, Inc. (OHDC). A Disposition and Development Agreement ("the Agreement" hereinafter) by and between the Rancho Cucamonga Redevelopment Agency and OHDC is required to effectuate this project. (ii) California Health and Safety Code Section 33431 provides as follows: "(a)... [B]efore any property of the Agency acquired in whole or in part, directly or indirectly, with tax increment monies is sold or leased for development pursuant to the redevelopment plan, such sale or lease shall first be approved by the legislative body after public hearing. Notice of the time and place of the hearing shall be published in a newspaper of general circulation in the community for at least two successive weeks prior to the hearing. "(b)...The resolution approving the lease of sale shall be adopted by a majority vote... and shall contain findings to the effect that the sale or lease of the property will assist in the elimination of blight and that consideration is not less than fair market value at its highest and best use in accordance with the plan; or that the consideration is not less than the fair reuse value at the use and with the covenants and conditions and development costs authorized by the sale or lease." (iii) In accordance with Sections 33431 and 33433 of the California Health and Safety Code, on Wednesday, December 6, 1995, the Rancho Cucamonga Redevelopment Agency ("Agency" hereinafter) an this City Council conducted a duly noticed public hearing on the subject matter of the proposed Agreement between Agency and OHDC concerning the disposition of that property known as Assessors Parcel No. 208-031-75, a 4.8 acre parcel located on the south side of Baseline Avenue. (iv) Prior to this City Council's consideration of the adoption of this Resolution, the public hearing referred to in Recital (ii) above was concluded. (v) All legal prerequisites to the adoption of this Resolution have occurred. Resolution No. 95-160 Page 2 B. Resolution. NOW, THEREFORE, it hereby is found, determined and resolved by the City Council of the City of Rancho Cucamonga as follows: 1. This City Council hereby finds that all of the facts set forth in the Recital, Part A, of this Resolution are true and correct. 2. This City Council hereby finds that the project which will be effectuated as a result of the Agreement will assist in the alleviation of blighting conditions existing in the project area and that the facts supporting the findings set forth herein are contained in the staff reports and documentation provided to this Agency, including the report required by California Health and Safety Code Section 33433. 3. This City Council hereby specifically finds that the consideration to be received by Agency for the disposition by Agency of certain property interests in accordance with the provisions, covenants and conditions in the Agreement is not less than the fair market value of said property. This Agency further finds and determines that the facts supporting the findings set forth herein are contained in the staff reports and documentation provided to this Agency, including the report required by California Health and Safety Code Section 33433. 4. This City Council hereby approves the Agreement. 5. This City Council further specifically authorizes and directs City's staff to promptly take any and all actions necessary to implement the Agreement and each and every term and provision contained in the Agreement. 6. The City Clerk shall certify to the adoption of this Resolution and shall forthwith transmit a certified copy hereof to the Agency evidencing this City Council's approval of the Agreement.
