HomeMy WebLinkAbout95-023 - ResolutionsRESOLUTION NO. 95-023 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, SUMMARILY ORDERING THE VACATION OF A PORTION OF RAMONA AVENUE BETWEEN FERON BOULEVARD AND THE A.T.& S.F. RAILROAD AND VARIOUS DRAINAGE AND UTILITY EASEMENTS (APN: 209-085-20) WHEREAS, by Chapter 4, Article 1, Section 8331, of the Streets and Highway Code, the City of Rancho Cucamonga is authorized to summarily vacate a portion of Ramona Avenue, herein more particularly described; and WHEREAS, by Chapter 4, Article 1, Section 8333, of the Streets and Highway Code, the City of Rancho Cucamonga is authorized to summarily vacate the various drainage and utility easements, herein more particularly described; and WHEREAS, the City Council found from all the evidence submitted that the portion of Ramona Avenue is unnecessary for present or prospective public street purposes, it has not been used for more than five (5) consecutive years, and no public money was expended for maintenance of same; and WHEREAS, the City Council found from all the evidence submitted that the various drainage and utility easements have not been used for the purpose for which dedicated or acquired for five consecutive years or said easement has been superseded by relocation and there are no other public facilities located within the easements. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, HEREBY RESOLVES AS FOLLOWS: SECTION 1: That the City Council hereby makes its order vacating the portion of Ramona Avenue, and the various drainage and utility easements, as shown on map V-130, labeled Exhibit"A", on file in the office of the City Clerk of the City of Rancho Cucamonga which are further described in legal descriptions attached hereto, labeled Exhibit "B" and "C", and by this reference made a part hereof. SECTION 2: That the subject vacations shall be subject to the reservations and exceptions, if any, for any or all existing utilities on record, as directed by the affected utility companies. SECTION 3: That from and after the date the resolution is recorded, said portion of Ramona Avenue no longer constitutes a public street or easement. Resolution No. 95-023 Page 2 SECTION 4: That the City Clerk shall cause a certified copy of this resolution to be recorded in the office of the County Recorder of San Bernardino, California. SECTION 5: That the City Clerk shall certify to the passage and adoption of this resolution, and it shall thereupon take effect and be in force.
