BOULEVARD W~AUm'£C PLAN BY ADDING INDOC~ ~ DISIRICT~St~AREAS 1AND2. 1. OAS Investo~ has filed an application for Foothill Boulevard Specific Plan Amendment No. 94-02, as described in the title of this Specific Plan Amendment is referred to as "the application." 2. On the 10th day of August 1994, the Plannin~ C~,..,{~ion of the City of Rancho Cuc~,~3~ conducted a duly noticed public hearing on the application and, follc~ing the o0~clusion thereof, adopted its ~%esolution No. 94-74, reo~m~nding that the City Oouncil adopt this ~. 3. On Segtember 7, 1994, the City Council co~ducted a duly noticed public hearing on the application and concluded said hearing on that date. 4. All legal prerequisites prior to the adoption of this Resolution have occurred. B. R~solution. NOW, TH~REMDRE, it is bmreby found, determined, and resolved by the City Council of the City of RanchoCX~w~nga as follc~s: 1. %~nis Council hereby specifically finds that all of the facts set forth in theRecitals, Part A, of this P~solutionaretrueandcorrect. 2. Based upon substantial evidence presented to this Oouncil during the above-referenced public hearing on September 7, 1994, including written and oral staff reports, together with public testimony, this Oouncil hereby specifically finds as follows: a. This amendment does not conflict with tb~ Land Use Policies of the General Plan; and b. This amendment promotes the goals and objectives of the Land Use Element and the Foothill Boulevard Specific Plan; and c. This amendment would not be materially injurious or detrimental to tb~ adjacent properties and would not have a significant impact ResolutionNo. 94-184 p e2 3. Based upon the substantial evidence presented to this Oouncil during the above-referenced public hearing and upon the specific f'~xi~ngs of facts set forth in ~ 1 ar~ 2 above, this Oouncil hereby finds and concludes as follows: a. That the proposed amendment would not have significant b. That the proposed amendment is in conformance with the General Plan. 4. ~he City Council of the City of Rancho Cucamonga hereby finds that the project h~s R~n ~ an~ reviewed in compliance with the California Env~l Quality Act of 1970, as amer~_ed, and the Guidelines promulgated there~l~er, and further, specifically finds that based upon substantial evidence, it can be seen with certainty that there is no possibility that the proposed Resolution will have a significant effect on the environment and; therefore, the proposed Resolution is exempt pursuant to State ~ Guidelines, Section 15061 (b) (3). 5. Based upon the findings and conclusions set forth in paragraphs 1, 2, 3, and4 above, this Council hereby approves Foothill Boulevard Specific Plan;~m~nt 94-02, to modifythe Foothill Boulevard Specific Plan as shown on theattachedExhibit A. 6. ~ne City Clerk shall certify to the adoption of this Resolution.
