On April 6, 1981, the City Council of the City of Rancho ~ approved the enautment of the General Plan by adoptic~ of ~olution No. 81-40. 2. Western Land Properties has filed an application for General Plan Amendment No. 94-0/A as described in the title of this Resolution. to as "the application." 3. On May 11, 1994, the Planning C~,,,,{.~ion of the City of Rancho (kamamonga conducted a duly noticed public hearing on the application and following the conclusion of said public hearing, _____adopted Resolution No. 94-37 rec~,,.,~nding to the City Council that said application be ap~ and a Negative Declaration be issued. 4. On June 15, 1994, the City Ommcil of the City of Ranoho Cucamonga held a duly noticed public hearing and concluded said public hearing prior to its adoption of this Resolution. 5. All legal prerequisites prior to the adoption of this Resolution have oocurred. B. Resolution. NOW, THEREFORE, it is hereby found, deteradded, and resolved by the City Council of the City of Rancho (k~am0n~a as follc~s: 1. This Oouncil hereby specifically fir~-~ that all of the facts set forth in the ~ecitals, Part A, of this Resolution are true and correct. C~,i.'.{.~ion minutes, written and oral staff reports, together with ~ublic testimony, this Council hereby specifically finds as follows: a. The application applies to approximately 25 acres of land, basically a rectilinear configuration, located on the north side of Foothill Boulevard between Spruce Avenue and future Elm Avenue and is px~se~tly vacant. Said property is currently designated as Office; and ResolutionNo. 94-123 p e2 b. ~he px~0erty to the north of the subject site is designated High (24-30 dwelling units per acre) and Medium-High (14-24 dwelling units per acre) and is vacant with a portion planned for park development. ~he pro~ with a c~m~ity shopping center. ~he ~ty to the east is designated Industrial Park and is developed with a hotel and mjor portions are ~acant. c. This amendment does not conflict with the T~d Use Policies of the General Plan and will provide for develo$~ent within the district in a manner o~sistent with the General Plan and with related development; and d. This amendment does promote the goals and objectives of the Land Use Element; and e. This amendment would not be materially injurious or detrimental to the adjaoent properties and would not have a significant impact 3. Based upon the substantial evidence presented to this Council during the above-referenced public hearing and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Council hereby finds and concludes as follc~s: a. The subject p~ is suitable for the uses permitted in the proposed district in terms of access, size, and ompatibility with b. Tb~ pro~ amendment would not have significant impacts on the env~ nor the ~ t~perties; and c. The proposed amendment is in conformance with the General 4.
