Long, Supervising Public Works Inspector SUBJECT: AUTHORIZE THE ADVERTISING OF THE "NOTICE INVITING BIDS" FOR THE ARCHIBALD AVENUE AND FOURTH STREET WIDENING, LOCATED AT THE NORTHEAST CORNER OF ARCHIBALD AVENUE AND FOURTH STREET, TO BE FUNDED FROM MEASURE 'T' FUNDS, ACCOUNT NO. 32-4637-9615 RECOMMENDATION: It is recommended that the City Council approve plans and specifications for the Archibald Avenue and Fourth Street Widening, located at the northeast corner of Archibald Avenue and Fourth Street, and approve the attached resolution authorizing the City Clerk to advertise the "Notice Inviting Bids". BACKGROUND/ANALYSIS: The scope of' work to be performed in general consists of, but not limited to, street widening at the northeast corner of Fourth Street and Archibald Avenue, which includes installation of curb, gutter, sidewalk, driveway approach, bus bay, landscaping, asphalt paving, street lighting, traffic signal modification. signing, striping and pavement markings. The subject project plans and specifications have been completed by staff and approved by the City Engineer. The Engineer's estimate l:br construction is $390,218.25. Legal advertising is scheduled for June 9 and June 16, 1998, with the bid opening at 2:00 p.m. on Tuesday. July 7, 1998. Staff has determined that the project is categorically exempt per Article 19. O'Neil City Engineer WJO:MDL:Is Attachment RESOLUTION NO. q<~;~" / cO,~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA APPROVING PLANS AND SPECIFICATIONS FOR THE ARCHIBALD AVENUE AND FOURTH STREET CORNER WIDENING, LOCATED AT THE NORTHEAST CORNER OF ARCHIBALD AVENUE AND FOURTH STREET IN SAID CITY AND AUTHORIZING AND DIRECTING THE CITY CLERK TO ADVERTISE TO RECEIVE BIDS WHEREAS, it is the intention of the City of Rancho Cucamonga to construct certain improvements in the City of Rancho Cucamonga. WHEREAS, the City of Rancho Cucamonga has prepared plans and specifications for the construction of certain improvements. PREVAILING WAGE: Notice is hereby given that in accordance with the provisions of California Labor Code, Division 2, Part 7. Chapter 1. Articles 1 and 2, the Contractor is required to pay not less than the general prevailing rate of per diem wages for work of a similar character in the locality in xvhich the public work is performed, and not less than the general prevailing rate of per diem wages for holiday and overtime work. In that regard, the Director of the Department of Industrial Relations of the State of California is required to and has determined such general prevailing rates of per diem wages. Copies of such prevailing rates of per diem wages are on file in the office of the City Clerk of the City of Rancho Cucamonga, 10500 Civic Center Drive, Rancho Cucamonga, California, and are available to any interested party on request. The Contracting Agency also shall cause a copy of such determinations to be posted at the job site. RESOLUTION NO. JUNE 3, 1998 PAGE 2 Pursuant to provisions of Labor Code Section 1775, the Contractor shall ibrfeit, as penalty to the City of Rancho Cucamonga, not more than fifty dollars ($50.00) for each laborer, workman, or mechanic employed for each calendar day or portion thereof, if such laborer, workman or mechanic- is paid less than the general prevailing rate of wages herein before stipulated for any work done under the attached contract, by him or by any subcontractor under him, in violation of the provisions of said Labor Code. Attention is directed to the provisions in Sections 1777.5 and 1777.6 of the Labor Code concerning the employment of apprentices by the Contractor or any subcontractor under him. Section 1777.5, as amended, requires the Contractor or subcontractor employing tradesmen in any apprenticable occupation to apply to the joint apprenticeship committee nearest the site of the public work's project and which administers the apprenticeship program in that trade for a certificate -' of approval:- T&e certificate will also fix the ratio of apprentices to journeymen that will be used in the pertbrmance of the contract. The ratio of apprentices to journeymen in such cases shall not be less than one to five except: Ao When unemployment in the area of coverage by the joint apprenticeship committee has exceeded an average of 15 percent in the 90 days prior to the request of certificate, or no When the number of apprentices in training in the area exceeds a ratio of one to five, or When the trade can show that it is replacing at least 1/30 of its membership through apprenticeship training on an annual basis statewide or locally, or When the Contractor provides evidence that he employs registered apprentices on all of his contracts on an annual average of not less than one apprentice to eight journeymen. The Contractor is required to make contributions to funds established for the administration of apprenticeship programs if he employs registered apprentices or journeymen in any apprenticable trade on such contracts and if other Contractors on the public works site are making such contributions. The Contractor and subcontractor under him shall comply with the requirements of Sections 1777.5 and 1777.6 in the employment of apprentices. Information relative to apprenticeship standards, wage schedules, and other requirements may be obtained from the Director of Industrial Relations, ex-officio the Administrator of Apprenticeship, San Francisco, California, or fi'om the Division of Apprenticeship Standards and its branch offices. Eight (8) hours of labor shall constitute a legal day's work for all workmen employed in the execution of this contract and the Contractor and any subcontractor under him shall comply with and be governed by the laws of the State of California having to do with working hours as set forth in Division 2, Part 7, Chapter 1, Article 3 of the Labor Code of the State of California as amended. The Contractor shall forfeit, as a penalty to the City of Rancho Cucamonga, twenty-five dollars RESOLUTION NO. JUNE 3, 1998 PAGE 3 ($25.00) for each laborer, workman, or mechanic employed in the execution of the contract, by him or any subcontractor under him, upon any of the work herein before mentioned, for each calendar day during which said laborer, wor'kman, or mechanic is required or permitted to labor more than- eight (8) hours in violation of said Labor Code. Contractor agrees to pay travel and subsistence pay to each workman needed to execute the work required by this contract as such travel and subsistence payments are defined in the applicable collective bargaining agreement filed in accordance with Labor Code Section 17773.8. The bidder must submit with his proposal, cash, cashier's check, certified check, or bidder's bond, payable to the City of Rancho Cucamonga for an amount equal to at least 10% of the amount of said bid as a guarantee that the bidder ~vill enter into the proposed contract if the same is awarded to him, and in event of failure to enter into such contract said cash, cashiers' check, certified check, or bond shall become the property of the City of Rancho Cucamonga. If the City of Rancho Cucamonga awards the contract to the next lowest bidder, the amount of the lowest bidder's security shall be applied by the City of Rancho Cucamonga to the difference between the low bid and the second lowest bid, and the surplus, if any shall be returned to the lowest bidder. The new tract for circulation purposes will be connecting to the dead-end portions of Orange Street and Bristol Drive, and in order to do so, the existing vehicular access rights easements need to be vacated. RESOLUTION A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, ORDERING THE ANNEXATION OF CERTA1N TERRITORY TO LANDSCAPE MAINTENANCE DISTRICT NO. 1 AND STREET LIGHTING MAINTENANCE DISTRICT NOS. 1 AND 2 FOR TRACT 15726 WHEREAS, the City Council of the City of Rancho Cucamonga, Califomia, has previously formed a special maintenance district pursuant to the terms of the "Landscaping and Lighting Act of 1972", being Division 15, Part 2 of the Streets and Highways Code of the State of California, said special maintenance district known and designated as Landscape Maintenance District No. 1, Street Lighting Maintenance District No. 1 and Street Lighting Maintenance District No. 2 (hereinafter -referred to as the "Maintenance District"); and WHEREAS, the provisions of Article 2 of Chapter 2 of the "Landscaping and Lighting Act of 1972" authorize the annexation of additional territory to the Maintenance District; and WHEREAS, at this time the City Council is desirous to take proceedings to annex the property described on Exhibit "A" attached hereto and incorporated herein by this referenced to the Maintenance District; and WHEREAS, all of the owners of property within the territory proposed to be annexed to the Maintenance District have filed with the City Clerk their written consent to the proposed annexation without notice and hearing or filing of an Engineer's "Report". NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA HEREBY RESOLVES AS FOLLOWS: SECTION 1: That the above recitals are all true and correct. SECTION 2: That this legislative body hereby orders the annexation of the property as shown in Exhibit "A" and the work program areas as described in Exhibit "B" attached hereto to the Maintenance District. SECTION 3: That all future proceedings of the Maintenance District, including the levy of all assessments, shall be applicable to the territory annexed hereunder. O'Neil, City Engineer Mike Olivier, Senior Civil Engineer APPROVAL OF PROFESSIONAL SERVICES AGREEMENT WITH ASL CONSULTING ENGINEERS TO PROVIDE DESIGN SERVICES FOR FOOTHILL BOULEVARD MEDIANS FROM VINEYARD AVENUE TO HAVEN AVENUE AND WIDENING OF THE FOOTHILL BOULEVARD BRIDGE OVER DEER CREEK CHANNEL, TO BE FUNDED FROM ACCOUNT NOS. 15-51000 ($235,000.00) AND 22-4637-9711 ($64,727.00) RECOMMENDATION It is recommended that the City Council approve, award and execute the subject Professional Services Agreement with ASL Consulting Engineers for the design of median islands on Foothill Boulevard from Vineyard Avenue to Haven Avenue and for widening of the Foothill Boulevard Bridge over Deer Creek Channel. BACKGROUND/ANALYSIS Requests for proposals to provide design plans, specifications and estimates for median islands and a bridge widening on Foothill Boulevard were sent to five engineering consulting firms. ASL Consulting Engineers submitted by far the best proposal for accomplishing the work. ASL is knowledgeable in relations with Caltrans and County Flood Control. This will be a big plus for this type of project, since it is on a State highway, and the bridge widening is over a Flood Control channel, and permits for construction will be required from each agency. In addition, ASL will design the bridge widening on Foothill Boulevard over Deer Creek Channel with their own staff and not with a subconsultant as the other firms proposed. ASL has completed a number of recent bridge widenings. Besides the standard features of design plans, specifications, estimates, surveys, right-of-way striping plans, etc., ASL will provide conceptual plans which will address access to adjacent businesses and can be used for early public meetings. Lastly, it is felt ALS's proposal for construction staging/traffic control plans better address flow of traffic during construction. The cost of ASL's proposal is $299,727.00 ($272,479.00 plus 10% contingencies), which is within budget. $235,000.00 will be funded from Account No. 15-51000 and $64,727.00 will be funded from Account No. 22-4637-9711. Resj2ectfifily submitted, City Engineer WJO:MDL:ls Attachn~ent CableVision AGREEMENT BETWEEN THE CITY OF RANCHO CUCAMONGA AND MARKS CABLEVISION CONCERNING THE SETTLEMENT OF THE 1998 CABLE TELEVISION FRANCHISE FEE AUDIT, COVERING THE PERIOD 1994 THROUGH 1997 Marks CableVision and the City of Rancho Cucamonga hereby agree to the following Statement and terms: It is understood and agreed that Marks CableVision will pay the City of Rancho Cueamonga the sum of $20,000, to cover expenses including, but not limited to, the cost of the cable television franchise fee audit, and consultant and legal fees associated with the audit, and that the City of Rancho Cucamonga will not require Marks CableVision to pay any additional franchise fee for the period covered by the audit or any additional charges related to the cable television audit, with the exception of this one time charge of $20,000 as noted above. It is further understood and agreed that Marks CableVision will continue with its current franchise fee calculation and payment procedures through December 31,1998. However, Marks CableVision agrees to readjust its franchise fee payments calculation procedures, commencing January 1,1999, to include all gross revenues (without deducting the amount of the franchise fee from its gross revenues bases) and to define the terms "gross revenues" as all annual gross revenues received by a grantee from all operations of its cable television system within the City, and that revenues identified and collected from subscribers as franchise fees may not be excluded from a grantee's gross annual cable service revenues.
