ANALYSIS: General: The applicant, Horrigan Enterprises, Inc., is requesting a conditional use permit for an adult day health care facility. The site is a 7,740 square foot leased space within a 23,945 square foot office building. The building is one of four office buildings providing a total of 78,370 square feet of leased space on a 5.7 acre site known as the Haven Commerce Center, located on the northeast corner of Haven Avenue and 7th Street, see Exhibits "A," "B," & "C." The program provides adult day care, including health, therapeutic, and social services for the frail elderly in order to restore or maintain optimal capacity and to delay or prevent inappropriate institutionalization (see Exhibits "D" & "E"). The proposed hours of operation are from 7 a.m. to 4 p.m., Monday through Friday. The applicant anticipates a maximum of 49 persons, including staff and participants, with an average of 25 per day. Clients are expected to arrive by car and public transportation. Land Use Compatibility: Personal Services (Day Care) is a Conditionally Permitted Use in the Haven Avenue Overlay District of the Industrial Area Specific Plan. Other occupants of the center include financial and real estate services, sales offices, and other office uses. However, at least two other occupants appear to provide personal services (computer training and testing services). Parking. This Office Park was parked at a ratio of 1 space per 250 square feet of leased space. The center requires 314 spaces and 314 spaces are provided. A day care facility requires 1 space per employee and 1 space per 5 participants. The proposed facility will have an average of 25 staff/participants per day. The Code requires a total of 10 spaces for day care use, which is well under the 31 spaces provided for the leased space. Accordingly, adequate parking is provided and no special parking requirements are placed on this application. ITEM A CITY PLANNER STAFF REPORT CUP 95-30 - HORRIGAN October 24, 1995 Page 2 Do Building Code/Fire Safety: The proposed use changes the occupancy requirement from B2 to E3 for the subject leased space. Requirements for the proposed change of occupancy must be met to the satisfaction of the Building Official prior to occupancy, including, but not limited to, emergency lighting, exit signs, panic hardware, and a fire alarm/detection system, see Exhibit "G." Eo Environmental Assessment: The subject application is exempt under Section 15301 of the California Environmental Quality Act. RECOMMENDATION: Staff recommends that the City Planner approve Conditional Use Permit 95-30 through adoption of the attached Resolution of Approval. An Adult Day Health Care (ADHC) is a community-based day program providing a variety of health, therapeutic, and social services designed to served the specialized needs of those at risk of placement in a nursing facility. The primary objectives of the program are (1) to restore or maintain optimal capacity for self care to frail elderly persons and other physically or mentally impaired adults, and (2) to delay or prevent inappropriate institutionalization. The program stresses partnership with the participant, the family, the physician, and the community in working towards maintaining personal independence. The ADHC is a State licensed ~Jnd approved program. Our proposed site for this center is located at 9065 Haven Avenue, Suite 100, Rancho Cucamonga, CA 91730. This building sits on the north-east corner of Haven and 7th. The reason that we selected this site as a potential location for the ADHC is due in part to its accessibility to community resources and public transportation. This building design provides for multipurpose use with the necessary elements required for an ADHC. Our proposed hours of operation are from 7am to 4pm, Monday thru Friday. We will employ a complete professional staff with an estimate of six (6) staff being the maximum number present at any one time. I hope that this brief description of our proposed Adult Day Health Care Center provides sufficient information for the filing requirements of the Conditional Use Permit. A RESOLUTION OF THE CITY PLANNER OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO. 95-30, LOCATED AT 9065 HAVEN AVENUE WITHIN THE HAVEN AVENUE OVERLAY DISTRICT OF THE INDUSTRIAL AREA SPECIFIC PLAN, AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 209-401-13. A. Recitals. 1. Horrigan Enterprises, Inc., has filed an application for the issuance of Conditional Use Permit No. 95-30, as described in the title of this Resolution. Hereinafter in this Resolution, the subject Conditional Use Permit request is referred to as "the application." 2. On the 24th day of October 1995, the City Planner of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. 3. All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the City Planner of the City of Rancho Cucamonga as follows: 1. The City Planner hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon the substantial evidence presented to the City Planner during the above- referenced public hearing on October 24, 1995, including written and oral staff reports, together with public testimony, the City Planner hereby specifically finds as follows: a. The application applies to property located at 9065 Haven Avenue, Suite 100, a 7,740 square foot leased space within a 5.7 acre site presently improved as an Office Park. b. The properties to the north and south of the subject site are zoned Haven Avenue Overlay District and are developed as Office Parks, the property to the east is zoned Industrial Park and is developed as an Industrial Park, and the property to the west is zoned Haven Avenue Overlay District and is developed with an Industrial use; and 3. Based upon the substantial evidence presented to the City Planner during the above- referenced public hearing, and upon the specific findings of facts set forth in paragraphs 1 and 2 above, the City Planner hereby finds and concludes as follows: a. The proposed use is in accord with the General Plan, the objectives of Industrial Area Specific Plan, and the purposes of the district in which the site is located; and b. The proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity; and CITY PLANNER RESOLUTION NO. The application, which contemplates operation of the proposed use, complies with each of the applicable provisions of the Development Code and the Industrial Area Specific Plan. 4. The City Planner hereby finds and determines that the project identified in this Resolution is categorically exempt from the requirements of the California Environmental Quality Act of 1970, as amended, and the Guidelines promulgated thereunder, pursuant to Section 15301 of the State CEQA Guidelines. 5. Based upon the findings and conclusions set forth in paragraphs 1, 2, 3, and 4 above, the City Planner hereby approves the application, subject to each and every condition set fodh below: Planning Division 1) Approval shall expire, unless extended by the City Planner, if building permits are not issued or the approved use has not commenced within 24 months of this date. 2) Approval of this request shall not waive compliance with any sections of the Industrial Area Specific Plan, State Fire Marshal's regulations, Uniform Building Code, or any other City Ordinances. 3) If operation of the facility causes adverse effects upon adjacent businesses or operations, the Conditional Use Permit shall be brought before the City Planner for consideration and possible termination of the use. 4) The facility shall be operated in conformance with the performance standards as defined in the Industrial Area Specific Plan. 5) Any signs proposed for the facility shall be designed in conformance with the City's Sign Ordinance and the Uniform Sign Program for the complex and shall require review and approval by the City Planner prior to installation. Building & Safety/Fire Safety Divisions 1) The applicant shall meet occupancy requirement E3 to the satisfaction of the Building Official pdor to occupancy by providing a complete set of plans drawn in accordance with the 1991 Uniform Building Code and CAC Title 24 (State Building Code) and improvements including, but not limited to, the following: a) Emergency lighting and additional illuminated exit signs; b) Complete fire alarm/detection system; c) Area of safe refuge/safe dispersal; d) Panic hardware; CITY PLANNER RESOLUTION NO.
