USE PERMIT 94-36- RYKOFF-SF. XTON. INC.- A request to establish an office and administrative uaining center in a leased space of 4,305 square feet in an existing building at 9269 Utica Avenue, Suite 100, in the General Industrial District (Subarea 11) of the Industrial Area Specific Plan. - APN: 209-411-17 ANAI.YSIS: General: The applicant, Rykoff-Sexton, Inc., is requesting a Conditional Use Permit to operate their sales office and training facility. During normal business hours, a portion of the facility will be used as an office/administration use. The property will also be used to store small quantities of food products in portable refrigerators and freezers. Eight full-time employees will be working in the facility. Training sessions will be held Tuesday evenings from 5:00 - 7:00 p.m. and will involve 25-35 employees. Regional sales meetings will be held one Tuesday a month from 5:00 - 7:00 p.m. and will involve 50-60 employees. The training facility is classified as a personal service which is conditionally permitted within Subarea 11 of the Industrial Area Specific Plan. !.and Use Conll~ibiliW: The basic premise of all zoning is the separation of incompatible uses. Subarea 11 is zoned for General Industrial activities and is primarily intended for industrial users. Typical uses permitted would include: custom and light manufacturing and building contractors offices and yards. Business support services or administrative offices may be permitted subject to review and approval of a Conditional Use Permit. The applicant is proposing to utilize 4,305 square feet of an existing 30,550 square foot building located in a multi-tenant business park. The majority of uses within the business park are office oriented. Go Parking: Staff recommends 1 parking space for each employee participating in the training sessions, which would require 60 parking spaces. The office/administrative portion of the facility will require 5 parking spaces. December 27, 1994 Page 2 Services office in the adjoining buildings may result in parking conflicts between the three users. At present, the church holds midweek services on Wednesday night; however, it is approved to conduct services or other public assembly (i.e., 50 or more persons) any weeknight after 6:30 p.m. The church requires 50 parking spaces. Additionally, Primerica Financial Services' Conditional Use Permit 94-29 was recently approved by the City Planner to conduct training sessions on Thursday evenings and Saturday mornings. This facility requires 76 parking spaces. Although there is a sufficient number of spaces available in the Rancho Pacific Business Park in the evenings (230 spac~. s) when the other tenants are closed, the church parking demand extends beyond the front entrance of the Primerica suite and the Primerim parking demand extends beyond the front entrance of the Rykoff-Sexton suite (see Exhibit "F"). Should the church decide to conduct a public assembly on Tuesday or Thursday nights, conflicts will occur and individuals will have to park some distance away. The church was approved to relocate to another site in town (Conditional Use Permit 94-27); however, the appeal period is still open. A condition was placed on the Primerica facility limiting usage of the facility to Thursday evenings and Saturday mornings to avoid potential conflicts. Similarly, a condition has been placed on this applicant to limit the training sessions to Tuesday evenings. Environmental Assessment: The applicant is exempt per Section 15061 of the California Environmental Quality Act. RECOMME2qDATION: Staff recommends that the City Planner approve Conditional Use Permit 94-36 through the adoption of the attached Resolution.. A RESOLUTION OF THE CITY PLANNER OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO. 94-36 ESTABLISHING AN OFFICE AND ADMINISTRATIVE TRAINING CENTER IN A LEASED SPACE OF APPROXIMATELY 4,305 SQUARE FEET IN AN EXISTING BUILDING, LOCATED AT 9269 UTICA AVENUE, SUITE 100, IN THE GENERAL INDUSTRIAL DISTRICT (SUBAREA 11) OF THE INDUSTRIAL AREA SPECIFIC PLAN, AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 209411-17. A. Recitals. 1. Rykoff-Sexton, Inc. has filed an application for the issuance of Conditional Use Permit No. 94-36, as described in the title of this Resolution. Hereinafter in this Resolution, the subject Conditional Use Permit request is referred to as "the application." 2. On the 27th day of December 1994, the City Planner of the City of Rancho Cucamonga conducted a duly noticed public heating on the application and concluded said hearing on that date. 3. All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the City Planner of the City of Rancho Cucamonga as follows: 1. The City Planner hereby specifically finds that all of ~e facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to the City Planner during the above-referenced public hearing on December 27, 1994, including written and oral staff reports, together with public testimony, the City Planner hereby specifically finds as follows: a. The application applies to property located at 9269 Utica Avenue, Suite 100 with a su'eet frontage of 458 feet on 6th Street and 480 feet on Utica Avenue; and b. The property to the north and east are vacant and zoned General Industrial, the property to the south is an industrial building and zoned General Industrial, and the property to the west is the Coca Cola Plant and zoned Industrial Park; and c. The subject prop,my is a fully-developed multi-tenant business park; and CITY PLANNER RESOLUTION NO. CUP 94-36 - RYKOFF-SEXTON, INC. December 27, 1994 Page 2 d. A church exists in the adjoining building, with a parking demand of 50 parking spaces, which operates public assemblies on weeknights and weekends; and e. A financial services office exists in an adjoining building with a parking demand of 76 parking spaces, which operates training programs on Thursday evenings and Saturday mornings; and f. Sufficient parking exists on the site to accommodate the proposed use on Tuesday evenings. 3. Based upon the substantial evidence presented to the City Planner during the above- referenced public hearing and upon the specific f'mdings of facts set forth in paragraphs 1 and 2 above, the City Planner hereby finds and concludes as follows: a. That the proposed use is in accord with the General'Plan, the objectives of Development Code, and the purposes of the district in which the site is located. b. That the proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. c. That the proposed use complies with each of the applicable provisions of the Development Code. 4. The City Planner hereby findS and determines that the project identified above in this Resolution is exempt from the requirements of the California Environmental Quality Act of 1970, as amended, and the Guidelines promulgated thereunder, pursuant to Section 15016 (b)(3) of the State CEQA Guidelines. 5. Based upon the findings and conclusions set forth in paragraphs 1, 2, 3, and 4 above, the City Planner hereby approves the application subject to each and every condition set forth below: Planninl Division l) If operation of the facility causes adverse effects upon adjacent businesses or operations, including but not limited to, noise, vibration, or parking, the Conditional Use Permit shall be brought before the City Planner for consideration and possible termination of the use. December 27, 1994 Page 3 2) Any signs proposed for the facility shall be designed in conformance with the Uniform Sign Program for the complex and the Comprehensive Sign Ordinance and shall require review and approval by the Planning Division prior to installation. 3) The applicant shall obtain and maintain a valid Business License. 4) Hours of operation for the training facility shall be limited to 5:00 - 7:00 p.m. on Tuesday evenings. 5) Any modification, expansion, or other change in operation will require a revision to the Conditional Use Permit. 6) Approval of this request shall not waive compliance with all sections of the Indusifial Area Specific Plan and all other City ordinances. 7) Occupancy of the facility shall not commence until such time as all Uniform Building Code and State Fire Marshal's regulations have been complied with. Plans shall be submitted to the Rancho Cucamonga Fire Protection District and the Building and Safety Division to show compliance and the building shall be inspected for compliance prior to occupancy. 6. The City Planner shall certify to the adoption of this Resolution. APPROVED AND ADOPTED THIS 27TH DAY OF DECEMBER 1994.
