FRCM PDUiTIffL MARKETPLACE P~ AND AUTHORIZING ~HE
MAYOR TO SIGN THE SAME.
WH~ZEAS, The City Council of the City of Rancho O%camonga,
California, approved Conditional Use Permit 90-37 on August 21, 1991, subject
to oertain conditions which require the review and approval of grading plans
prior to is~,ance of grading permits; and
WHfREAS, Section 15.12.240 of the City of Rancho Cucamonga Municipal
Code requires the posting of seo/rity with the City prior to the issuanoe of
grading permits to assure that work to be performed under the permit, if not
o~mpleted in accordance with approved plans and specifications, will be
corrected to el'nninate hazardous conditions; and
WHEREAS, the posting of security as a prerequisite to issuance of
precise grading permits for Conditional Use Permit 90-37 has been met by entry
into a Lien Agreement by Foothill Marketplace Partners.
NOW, THEREFORE, BE IT RESOLVfD that the City Council of the City of
Rancho Cucamonga, California, does accept said Lien Agreement, authorizes the
Mayor to sign the same, and directs the City Clerk to record the same in the
Office of the County Recorder of San Bernardino County, California.
The City Clerk shall certify to the adoption of this Resolution.
