A RESOLUTION OF THE CITY OC~qCIL OF ~HE CITY OF RAN(~O
(N3CAMONGA, ~JJ3~-iA, AOCEPTING CEREAIN ~
WITHIN TRACT 12671-1 THRU -4 WHICH INCLLDE THE INTERI~
IANDSCAPING; THE REDUCTION OF THE P~~NCE ~ FOR
DRIVE, TO AN AMC~NT ~ TO 10% OF THE ORIGINAL AM~t~TS;
THE APPROVAL OF AN EXTENSION TO ~ ~ AG~R~I~qT
FOR A TIME P~IOD OF TWO YEARS FRC~ THE DATE OF ~IS
WHEREAS, the oonstruction of public ~ for Tract 12671-1
thru -4 including interior tract streets, sidewalk and parkway i~
and landscaping, have been completed to the satisfacti~ of the City Engineer;
WHEREAS, the reduced amount of the performance bond are pursuant to
the Subdivision Map Act and the Street Capping Agreement and are in an amount
sufficient to secure the c~letion of tb~ remainin~ improvements; and
WHEREAS, the City Council of the City of Rancho Cucamc~ga,
California, ba~ for its consideration an Improvement Agreement Extension
executed on F~h~ ,ary 2, 1994, by Lewis Homes as developer, for the i~0rove~e~t
of public right-of-way adjacent to the real property specifically described
therein, and generally located on the northwest corner of Mill/ken Avenue and
Mt. View Drive; and
WHEREAS, the installation of such improvements, described in said
Improvement Agreement and subject to the terms thereof, is to be done in
conjunction with the development of said Tract 12671-1 thru -4; and
WHERFAS, said Improvement Agreement Extension is secured and
accompanied by good and sufficient Improvement Security, which is identified
in said Improvement Agreement Extension.
NOW, THEREFORE, BE IT RESOLVED, that the described work is hereby
accepted, the reduction of the Performance Bond is hereby approved, that said
Improvement Ac3re~ment Extension and said Improvement Security are hereby
approved.
