WHerEAS, Rancho O,camonga Municipal Oode Sectic~ 13.04 estm_blishes a procedure for the creation of Un~ Utility Districts and requires as the initial step in such procedure the holding of a public hearing to ascertain wb~ther public necessity, health, safety, or welfare requires the removal of overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, c~m~nication or similar associated service in any such district. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rancho Cucamonga, California as follc~s: S~CTION 1: That an Under.-round Utility District be formed in the following described area: Those portions of Map of Rocb~ tract, Map Book 9 Page 20, as recorded in the office of the San Bernard/no County Recorder, California, lying within a strip of land 240 feet wide, the centerline of said strip being the centerline of ~ Avenue (Orange Avenue) as shown on said Map. S~CTION 2: NOTICE IS HEREBY GIV~ that a public hearing will be held by the City Council of the city of Rancho Cucan~nga on January 19, 1994, at the hour of 7:00 p.m. in the City Council Chambers at 10500 Civic Center Drive, Rancho Cucamonga, California, to ascertain whether the public necessity, health, safety or welfare re~]ires the removal of overhead wires and associated overhead structures and the ~ installation of wires and facilities for supplying electric, c~mmmication or similar associated service in the District herein described. S~CTION 3: At such hearing, all persons interested shall be given an opportunity to be heard. Said hearing may be continued frum time to time as may be determined by City Council. S~2TION 4: The city Clerk shall notify all affected property owners as shown on the last equalized assessment roll and utilities concerned, of the time and place of such hearing and by mailing a copy of this Resolution to such property owners and utilities concerned at least ten (10) days prior to Resolution No. 94-016 Page 2 SfL~fION 5: The area proposed to be included in the District is shown upon that certain map entitled 'T~derground Utility District No. 3", which is on file in the office of tb~ City Clerk of the City of Rancho Cucamonga, California.
