Recitals (i) Western Properties bm.~ filed an application for the approval of Development P~view No. 93-13 as described in the title of this request is referred to as "the application." (ii) On the August 11, August 25, October 13, October 27, 1993, the PlanningC~mL~ssion of the City ofRancho(~ conducted~y~i~ publichearings onthe application and following theconclusion of saidpublic hearings, adopted Resolution No. 93-89 tbmrebydenying said application. (iii) The decision represented by said Planning Cu~td~sion Resolution wastimelyappealedtothis Council. (iv) On ~ 1, 1993 a~d January 5, 1994, the City Council of the City of Rancho Cucamonga conducted public hearings on the application and concluded saidhearingon January 5, 1994. (v) All legal prerequisites prior to the adoption of this Resolutionhave occurred. B. Resolution NOW, THEREFORE, it is b~reby found, determined, and resolved by the City Council of the City of Rancbx) Cucamonga as follows: 1. This Council hereby specifically finds that all of the facts set forth in theRecitals, Part A, of this Resolutionaretrueandcorrect. 2. Based upon substantial evidenoe presented during the above referenced December 1, 1993 and Jam~ry 5, 1994 hearings, including written and oral staff reports, the minutes of the above-~er~ Planning C~-~ssion meetings, and the contents of Planning C~mmission Resolution No. 93-89, this Council hereby specifically finds as follows: a. The application applies to property identified as Pads X and is located at the northeast corner of Foothill Boulevard and Haven Averse and is presently improved with landscape and hardscape; and Resolutic~ No. 94-003 Page2 b. ~ne pr~ to the north and east of the subject site is developed with a sh~pping center, the property to the south is developed with an office park, and the p~ to the west is developed with a mixed-use c. Buildings X is part of the Terra Vista Town Centar and was apuroved as a ~ office building; and d. The applicant requested to change the approved elevations for Buildings X frc~ a tw~ to a single-story design and from office to e. The proposed elevations of Building X, as shown in the revised elevations, are consistent with the architectural standards established in the Terra Vista Town Center. 3. Based upon the substantial evidence presented to this Oouncil during the above-referenced public hearing and upon the specific f'~3s of facts set forth in paragrat~hs 1 and 2 above, t_his Council hereby finds and concludes as follows: a. That the proposed project is consistent with the objectives of the General Plan; and b. That the proposed use is in accord with the objectives of the Develo~ Code and the purposes of the district in which the site is c. That the architecture of Building X is oonsistent with the arc~i~l standards estm__blisb~d in the Terra Vista Town C~-fcer through C~nditi~nal Use Permit 88-12. 4. The City Council of the City of Rancho Cucamonga hereby approves the application with the following c~nditions: 1) Approval of Buildings X sb~11 expire, unless exter~_ed__ by the Planning C~t,,dssion, if use has not O~La,~ed withi~ 24 ~fchs frc~ the 2) The p~upo~ed plaster trim with scored lines around the arches at the north and south elevati~ of Buildirg X shall be dmanged to nc te martial. 3) Precast concrete trim shall be added to all archway elements of Building X. This Council hereby provides notJoe to Rick Mager of Western Properties that the time within which judicial review of the decisio~ of California Code of Civil Procedure Sectic~ 1094.6. 6. The City Clerk of the City of Rar~ O,oz~ is hereby directed to: (a) oertify to the ad~ptic~ of this Resolution, and (b) forthwith transmit a certified copy of this Resolution, by certified mail, return-reoeipt requested, to Rick Mager of Western Properties at the address identified in City records. 7. The City Clerk shall certify to the ____~ption of tb{~ Resolution. PASSED, ~, and ADOPTED this 5th day of J~, 1994.
