HomeMy WebLinkAbout93-170 - ResolutionsRESOLUTIC~ NO. 93-170 A RESOI33I~(~ OF THE CITY (IX~CIL OF THE CITY OF RANCID SI~F/NG OF PROGRAM SUPP~ NO. 020 TO LOCAL AGenCY - STATE AG~~ NO. 08-5420 F~R ~ (I~~(~ OF ~tWFIC SI6~LS AND SAFEi~ LI~I~/NG AT THE OF~AV~KIEANDSTHSIREET WH~RFAS, the City Oouncil of the City of Rancho Ow~wxz3a (hereinafter referred to as "Local Age~'), has f~r its c~s'~%eration and execution, the Program Supplement No. 020 to Local A~enc~ - State ~3~---~m~ No. 08-5420 for the oo~structic~ of traffic signals and safety lighting at the intersection of Archibald Avenue and 8th Street; and WHEREAS, the State of California, D~ of ~tion, District Office 8 (herein-after referred to as "State") prooesses and monitors Federally _fun~ed_~___ projects; and WHEREAS, as a condition to payment of Federal funds for said projects, the Local Agency shall approve and execute said Program Supplement No. 020; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANOK) DOES H~YRESOLVEASFOLIf~S: Authorize the Execution of Supplement No. 020 to Local Agency - State Agreement No. 08-5420 for the construction of traffic signals and safety lighting at the intersection of Arch/bald Aver~ and 8th Street in the City of Rancho ~, San B~-nardi~o Oounty. To authorize the Mayor to sign said Supplement and direct the City Clerk to attach a certified copy of t_his Resolution, as well as type in the Resolution number and date in the blank of the third block of said supplement and for the return of the original copies of said supplement to the State of California D~ of Tra~e~ortation along with the certified oopy of this Resolution. NOW, ~{~E, BE IT FORi~5~ RESOLVED that the Local Agency shall also cc~ply with the "Special Covenants or Rein%arks" attached to said supplement including: All maintenance, involvir~ the physical condition and the operation of the improvements, referred to in Article VI Ma~ of the aforementio~ Master A~ will be performed by the Local Agency at regular intervals or as required for efficient operatic~ of the cc~01eted improvements. The Local Agency will advertise, award, and administer this project and will obtain the State's cc~curr~ce prior to either award or rejection of the Contract. Resolution No. 93-170 p e2 e The Local Agency agrees the payment of Federal funds will be limited to the amounts approved by the Federal Highway Ad~/nistration in the Federal-Aid Project Agreement (PR-2)/Detail Estimate, or its modification (PR-2A) ~r the F~-76, and accepts any increases in Local Agency Funds as shown on the Finance or Bid Letter or its modification as prepared by the Division of Local Streets and R~ads. reaffirms the "Nondiscrimination Assuranoes" conta' _lr~d~_ in the aforementioned master agreement for Federal-Aid Program. Whenever the local agency uses a cc~n/ltant on a cost plus basis, the local agency is required to suh~it a post audit report covering the allowability of cost payments for each ir~ividual consultant or sub- contractor incurring over $25,000 on the project. The audit report must state the applicable cost principles utilized by the auditor in det~a~r~g allowable costs as referenced in CFR 49, part 18, Subpart C-22, Allowable Costs.
