HomeMy WebLinkAbout93-107 - ResolutionsRESOLUTIONNO. 93-107 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO ~, CATIFORNIA, CATlING FOR A PUBLIC HEARING TO DETERMINE WHEUHER PUBLIC N~CESSITY, HEAI/~, SAFETY OR W~,FARE RMQUIRES ~HE FC~MATIONOFANL~DER~ROUNDb'r~.~CY DISTRICT ALONG BASE LINE ROAD FRC~ AR(~IBALD AV~R/E TO H~RMOSAAV~R/E WHEREAS, it ham been rec~mL~nded that an Undez~-£ound Utility District, hereinafter called District, be formed; and WHEREAS, Rancho Cucamonga Municipal Code Section 13.04 establishes a procedure for the creation of Underground Utility Districts and requires as the initial step in such procedure the holding of a public hearing to ascertain whether public necessity, health, safety, or welfare requires the removal of poles, overhead wires, and associated overhead structures and the co~{.~nication or similar associated service in any such district. NC~, THEREFORE, BE IT RESOLVED by the City Council of the city of Rancho Cucamonga, California as follows: SECTION 1: That an Underground Utility District be formed in the following described area: Those portions of Cucamonga Homestead Association Map Book 6, Page 46; Parcel Map 10884 Parcel Map Book 120, Pages 36 and 37; Tract No. 8919 Map Book 122, Pages 99 and 100; Tract No. 11350 Map Book 160, Pages 26 and 27; Tract Map 9449 Map Book 136, Pages 99 and 100; Tract No. 9451 Map Book 132, Pages 33 and 34; Parcel Map 4251 Parcel Map Book 43, Pages 61 and 62; and Cucamonga Fruit Lands Map Book 4, Page 9; all records of the San Bernardino County Recorder, State of California lying within a strip of land 160 feet wide, the centerline of said strip is described as: Beginning at the intersection of Archibald Avenue and Base Line Road; thence East along the centerline of Base T.ineRoadtothe intersection with HermosaAvenue. The sidelines of said strip being parallel to said centerline and distant at right angles to said centerline of Base Line Road. The sidelines being length~ or shortened to terminate with the centerlines of said Archibald Avenue and Hermosa Avenue. Resolution No. 93-107 Page 2 S~CTION 2: NOTICE IS HEREBY GIVEN that a public hearing will be held by the City Council of the City of Rancho Cucamonga on June 2, 1993, at the hour of 7:00 PM in the City Council Chambers at 10500 Civic Center Drive, Rancho Cucamonga, California, to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, co~.~unication or similar associated service in the District herein described. SECTION 3: At such hearing, all persons interested shall be given an opportunity to be heard. Said hearing may be continued from time to time as may be determined by City Council. SECTION 4: The city Clerk shall notify all affected property owners as shown on the last equalized assess~nt roll and utilities concerned, of the time and place of such hearing and by mailing a copy of this Resolution to such property owners and utilities concerned at least ten (10) days prior to SE~kTION 5: The area proposed to be included in the District is shown upon that certain mp entitled ,'Underground Utility District No. 3", which is on file in the office of the City Clerk of the City of Rancho Cucamonga, California.
