HomeMy WebLinkAbout93-094 - ResolutionsRESOLUTIONNO. 93-094 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANC2K) DISTRICTS NOS. 1, 2, 3A, 3B, 4, 5, 6, 7 AND 8, FOR THE FISCAL YEAR 1993/94 PURSI/ANT TO THE lANDSCAPING AND LIGHTING ACT OF 1972; AND OFFtSAING A TIME AND PLACE FOR HEARING OBJECTIONS THERETO WHerEAS, the City Council of the City of Rancho Cucamonga, pursuant to the provisions of the landscaping and Lighting Act of 1972, being Division 5 of the Streets and Highways Code of the State of California, does resolveas follows: Description of Work. SECTION 1. That the public interest and convenience require and it is the intention of this City Council to levy and collect assessments within Landscape Maintenance Districts Nos. 1, 2, 3A, 3B, 4, 5, 6, 7 and 8 for the fiscal year 1993/94 for themain~ and operation of thoseparkways, parks and facilities thereon dedicated for c~on greenbelt purposes by deed or recorded subdivision tract map within the boundaries of said Districts. Said maintenance and operation includes the cost and supervision of landscape maintenance (including repair, removal or replacement of all or any part of any improvement providing for illumination of the subject area) in connection with said districts. Location of Work. SECTION 2. The foregoing described work is to be located within the roadway rights-of-way and easements enumerated in the report of the City Engineer and more particularly described on maps which are on file in the City Clerk's office, entitled "Assessment Diagrams landscaps Maintenance Districts Nos. 1, 2, 3A, 3B, 4, 5, 6, 7 and 8. Description of Assessment Districts. St~2TION 3. That the contemplated work, in the opinion of said City Council, is of more than local or ordinary public benefit, and the said City Council hereby makes the ex~ of the work chargeable upon the districts, which said districts, are assessed to pay the costs and expenses thereof, and which districts are descr~ as follows: All that certain territory of the City of Rancho Cucamonga included within the exterior boundary lines shown upon t/hat certain '94ap of ~pe Maintenance District No. 1", '~4ap of landscape Maintenance District No. 2", 'R4ap of landscape Maintenance District No. 3A", "Map of Landscape Maintenance District No. 3B", '~4ap of Landscape Maintenance District No. 4", '9~ap of Landscape Maintenance District No. 5", 'R4ap of Landscape Maintenance District No. 6", 'R4ap of Landscape Maintenance District No. 7", "Map of Landscape Maintenance District No. 8", indicating by said boundary lines the extent of the territory included within each assessment district and which maps are on file in the office of the City Clerk of said City. Resolution No. 93-094 Page 2 Reference is hereby made to said maps for further, full and more particular description of said assessment districts, and the said maps so on file shall govern for all details as to the extent of said assessment districts. Report of Engineer. SECTION 4. The City Council of said City by Resolution No. 93-094 barn approved the annual report of the City Engineer which report indicates the amount of the proposed assessments, the district boundaries, assessment zones, and the method of assessment. The report title "Annual Engineer's Report" is on file in the Office of the City Clerk of said City. Reference to said report is hereJm~ made for all particulars for the amount and extent of the assessments and for the extent of the work. TIME AND PLACE OF HEARING. SECTION 5. Landscaping and Lighting Act of 1972. S~-~I~iON 6. All th work herein proposed shall be done and carried through in pur~_ance of an act of the legislature of the State of California designated as the Landscaping and Lighting Act of 1972, being Division 5 of the Streets and Highways Code of the State of California. Publication of Resolution of Intention. S~CTION 7. Published notice shall be made pursuant to Section 6061 of the Govez-~ent Code. The Mayor shall sign this Resolution and the City Clerk shall attest to the same, and the City Clerk shall cause and same to be published 10 days before the date set for the hearing, at least once in the Inland Valley Daily Bulletin, a newspaper of general circulation published in the City of Ontario, California, and circulated in the city of Rancho Cucamonga, California.
