HomeMy WebLinkAbout93-090 - ResolutionsRESOLUTION NO. 93-090 A RESOLUTION OF ~ CITY COUNCIL OF THE CITY OF RANCHO ~GA, CALIFORNIA, D~2LARING ITS INT~IYITON TO LEVY AND OOT,L~/C ASSESSMI~YI~ WITHIN PARK AND Pd~IREATION ~ DISTRICT (PD - 85), FOR THE FISCAL YEAR 1993/94 PtRRSLI~fC TO THE IANDSCAPING AND LIGHTING ACT OF 1972; AND OFFERING A TIME AND PLACE FOR HEARING O~ONS THERETO WHEREAS, the City Council of the City of Rancho Cucamonga, pursuant to the provisions of the landscaping and Lighting Act of 1972, being Division 5 of the Streets and Highways Code of the State of California, does resolve as follows: Description of Work. SECTION 1. That the public interest and convenience require and it is the intention of this City Council to levy and collect assessments within Park and Recreation District (PD - 85) for the fiscal year 1993/94 for the maintenance and operation and debt service payment of Red Hill C~m~-~m~ity Park and Heritage Cc~nunity Park thereon dedicated for common park purposes by deed and recorded subdivision tract map within the boundaries of said District. Said maintenance and operation includes the cost and supervision of landscape maintenance (including repair, removal or replacement of all or any part of any improvement providing for illumination of the subject area) in connection with said district. Location of Work. S~CTION 2. The foregoing described work is to be located within the roadway rights-of-way and easements enumerated in the report of the City Engineer and more particularly described on maps which are on file in the City Clerk's office, entitled "Assessment Diagrams Park and Districts Nos. 1, 2, 3A, 3B, 4, 5, 6, 7 and 8. Description of Assessment Districts. SECI~ON 3. That the contemplated work, in the opinion of said City Council, is of more than local or ordinary public benefit, and the said City Coucnil hereby makes the expense of the work chargeable upon the districts, which said districts, are assessed to pay the costs and expenses thereof, and which districts are described as follows: All that certain territory of the City of Rancho Cucamonga included with the exterior boundary lines shown upon that certain '9~ap of Park and Improvement District (PD - 85), indicating by said boundary lines the extent of the territory included within the assessment district and which maps are on file in the office of the City Clerk of said City. Reference is hereby rode to said raps for further, full and more particular description of said assessments districts, and the said maps so on file shall govern for all details as to the extent of said assessment districts. The City Council of said City by Resolution No. 93-090 has approved the annual report of the City Engineer which report indicates the amount of the proposed assessments, the district boundaries, assessment zones, and the method of assessment. The report title "Annual Engin~'s Report" is on file in the Office of the City Clerk of said City. Reference to said report is hereby made for all particulars for the amount and extent of the work. Landscaping and Lighting Act of 1972. SfL-TION 6. All the work herein proposed shall be done and carried through in pursuance of an act of the legislature of the State of California designated as the landscaping and Lighting ACt of 1972, being Division 5 of the Streets and Highways Code of the State of California. Publication of Resolution of Intention. SEL~fION 7. Published notice shall be made pursuant to Section 6061 of the Govel-~--nt Code. The Mayor shall sign this Resolution and the City Clerk shall attest to the same, and the City Clerk shall cause the same to be published 10 days before the date set for the hearing, at least once in the Inland Valley Daily Bulletin, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of Rancho Cucamonga, California.
