A RESOI33TION OF THE CITY OOUNCIL OF THE CITY OF RANCHO
~, CATIFORNIA, AUTHORIZING T~{E LEASE/~E OF
~I/PMt~TTHROUGHMUNICIPALSERVICESGRDUP, INC.
WHEREAS, the City of Rancho Cucamonga has determined that a true and
very real r~ exists for the acquisition of the equipment described in the
Municipal Ma~ter Lease and Option Agreement No. 464-1 (the "Agreement")
presented to this meeting; and
WHISKAS, the City Council of the City of Rancho Cucamonga ban taken
the necessary steps, including any legal bidding requirements, under
applicable law to arrange for acquisition of such equipment,
WHEREAS, the city Council of the City of Rancho Cucamonga hereby
directs the City Attorney to review the agreement and negotiate appropriate
modifications to said agreement so as to assure compliance with state law and
local statutory law, prior to execution of the agreement by those persons
authorizedby the City Council for such purpose.
BE IT RESOLVSD, by the City Council of the City of Rancho Cucamonga
Finding: Authorized officers. ~ne terms of said Agreement are in the
best interests of the city of Rancho Cucamonga for the acquisition of such
equipment and the City Council of the City of Rancho Cucamonga designates and
Jack Lam, AICP, City Manager and/or
Robert Dominguez, Administrative Services Director
to execute and deliver, and to witness (or attest) respectively, the A~3reement
and any related documents necessary to the consu~ation of the tranactions
contemplated by the Agreement.
RESOLVED, the acquisition of the equipment, under the terms and
conditions provided for in the Agreement, is necessary, convenient, in the
futherance of the will at all times be used in connection with the City of
Rancho Cucamonga's gove~-~,~ntal and proprietary purposes and functions (except
to the extent that subleasing of the equipment is permitted under terms of the
Agreement) and are in the best interests of the City of Rancho Cucamonga and
no portion of the equipment will be used directly or indirectly in any trade
or business.

BE IT FURFHER RESOLVED, that the City of Rancho Cucamonga is
authorized and directed to fulfill all obligations under the terms of the
Municipal Master Lease and Option Agreement No. 464-1.
PASSED, APPROVED, and ADOPTED this 21st day of April, 1993.
