HomeMy WebLinkAbout93-038 - ResolutionsRESOLI/CIONNO. 93-038 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCMO C~, CAT.TFORNIA, AI3THORIZING THE EXECUTION AND SIGNING OF PROGRAM SUPPLWMENT NO. 019 TO I3DCAL AGENCY - STATE ~R~{~T NO. 08-5420 FOR THE OONSTRUCI~ON PHASE INCLUDING ADVERITS~Mt~qT, ~ AND A~MINIglIRATION OF THE Rt'~{ABILITATION AND WIDENING OF HAVt~ AV~RIE FRC~ CIVIC WHEREAS, the City Council of the City of Rancho Cucamonga (herein- after referred to as "Local Agency"), has for its consideration and execution, the Program Supplement No. 019 to Local Agency - State Agreement No. 08-5420 for the construction phase including Advertisement, Award and Administration of the Rehabilitation and widening of Haven Avenue from Civic Center Drive to Foothill Boulevard; and WHEREAS, the State of California, Department of Transportation, District Office 8 (herein-after referred to as "State") Processes and monitors Federally funded projects; and WHEREAS, as a condition to payment of Federal funds for said projects, the Local Agency shall approve and execute said Program Supplement No. 019; NOW, THEREFORE, ~HE CITY COUNCIL OF THE CITY OF RANCHO ~, DOES HEREBY RESOLVEAS FOLLOWS: Authorize the Execution of Supplement No. 019 to Local B~ency - State Agreement No. 08-5420 for the construction phase including Advertisement, Award and Administration of the Rehabilitation and Widening of Haven Avenue from Civic Center Drive to Foothill Boulevard in the City of Rancho Cucamonga, San Bernardino County. e To authorize the Mayor to sign said Supplement and direct the City Clerk to attach a certified copy of this Resolution, as well as type in the Resolution number and date in the blank of the third block of said supplement and for the return of the original copies of said supplement to the State of California Department of Transportation along with the certified copy of this Resolution. NOW THEREFORE, BE IT FURTHER RESOLVED that the Local Agency shall also comply with the "Special Covenants or Remarks" attached to said supplement including: All maintenance, involving the physical condition and the operation of the improvements, referred to in Article VI Maintenance of the aforementioned Master Bz3reement will be performed by the Local Agency at regular intervals or as required for efficient operation of the completed improvements. ~msolution No. 93-038 Page 2 e The Local Agency will advertise, award, and administer this project and will obtain the State's concurrence prior to either award or rejection of the Contract. e The Local Agency agrees the payment of Federal funds will be limited to the amounts approved by the Federal Highway Administration in the Federal-Aid Project Agreement (PR-2)/Detail Estimate, or its modification (PR-2A) or the FNM-76, and accepts any increases in Local Agency Funds as shown on the Finance or Bid Letter or its modification as prepared by the Division of Local Streets and Roads. In executing this Program Supplement Agreement, Local Agency hereby reaffLrms the "NondiscrLmination Assurances" contained in the aforementioned master Agreement for Federal-Aid Program. 0 Whenever the local agency uses a consultant on a cost plus basis, the local agency is required to submit a post audit report covering the allowably of cost payments for each individual consultant or sub-contractor incurring over $25,000 on the project. The audit report must state the applicable cost principles utilized by the auditor in determining allowable costs as reference in CFR 49, part 18, subpart C-22, Allowable Costs.
