HomeMy WebLinkAbout93-018 - ResolutionsRESOI33I~ON NO. 93-018 A RESOLUTION OF THE CITY OOUNCIL OF ~ CITY OF RANCHO ~, CALIFORNIA, APPROVING T~N~AT/VE TRACT 14116, A RESID~CIAL SUBDIVISION OF 19 SINGLE FAMILY LOTS ON 4.09 A(/RES OF LAND IN THE LOW M~DIIX4 RESID~CIAL DIS~CRICT (4-8 E~m~.LrNG UNITS P~ ACRE), ~ SOUI~ OF HIGHLAND AV~K/E, WEST OF DEER C~FFK C~ANNEL, AND MAKING FINDINGS IN SUPPO~ ~/~ER]~DF - APN: 1076-61-03. A. Recitals. (i) William Lyon Company has filed an application for Tentative Tract 14116 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Tract Map request is referred to as the "application." (ii) On December 9, 1992, the Planning C,.~,,,,~i.~ion of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and, following the conclusion of said public hearing, adopted Resolution No. 92-146 thereby rec~m~nding to this City Council that said application be approved. (iii) The decision represented by said Planning Oreremission Resolution was timely appealed to this Council. (iv) On Jan,,ary 20, 1993 the City Council of the City of Rancho Cucamonga conducted a duly noticed public hearing on tb~ application which was continued to February 3, 1993 in order to allow the Council the opportunity to review different alternatives. (v) On February 3, 1993 the City Council of the City of Rancho Cucamonga concluded said hearing. (vi) All legal prerequisites prior to the adoption of this P~solution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the City Council of the City of Rancho Cucamonga as follows: 1. This Council hereby specifically finds that all of the facts set forth in the Recitals, Part "A," of this Resolution are true and correct. 2. This Council hereby finds and certifies that the project has been reviewed and considered in cc~pliance with the California Environmental Quality Act of 1970, and further, this Council hereby issues a Negative Declaration. 3. Based upon substantial evidence presentedtothis Councilduring the above-referenced January 20, 1993 and February 3, 1993 hearing, including written staff reports, the minutes of the above-referencedPlanningCommission meeting, and the contents of Planning Coi~m-~ssion Resolution No. 92-146, this Council hereby specifically finds as follows: Resolution No. 93-018 Page 2 (a) That the proposed project is consistent with the objectives of the General Plan; and (b) That the proposed design is in accor~ with the objectives of the Develo~t Code and the txlrposes of the district in which the site is (c) That the proposed design is in compliance with each of the applicable provisions of the Development Code; and (d) That the proposed design, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. 4. Based upon the findings and conclusions set forth in tkqragrat~hs 1 and 2 above, this Council hereby approves the application subject to each and every condition as set forth in Planning C~uLdssion Resolution No. 92-146, with the modification that Condition #1 (Planning Division) sb~11 be deleted. 5. This Council hereby provides notice to William Lyon Cc~pany that the time within which judicial review of the decision represented by this Resolution must be sought is governed by the provisions of California Code of Civil Procedure Section 1094.6. 6. The City Clerk of the City of Rancho Cucamonga is hereby directed to: (a) certify to the adoption of this Resolution, and (b) forthwith transmit a certified copy of this Resolution, by certified mail, return-receipt requested, to William Lyon Cc~pany at the address identified in City records.
