HomeMy WebLinkAbout87-381 - Resolutions RESOLUTION NO. 87-381 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA ORDERING THE WORK IN CONNECTION WITH ANNEXATION NO. 18 TO STREET LIGHTING MAINTENANCE DISTRICT NO. 2 AND ACCEPTING THE FINAL ENGINEER' S REPORT FOR TRACT NOS. 1829, 3221, 4244 AND APN 207-335-1, 2, 19, 20, 21, AND 207-234-9, 10 AND 11 WHEREAS, the City Council of the City of Rancho Cucamonga did on the 17TH day of June, 1987. adopt its Resolution of Intention No. 87-325 to order the therein described work in connection with Annexation No. 18 to Street Lighting Maintenance District No. 2. which Resolution of Intention No. 87-325 was duly and legally published in the time, form and manner as required by law, shown by the Affidavit of Publication of said Resolution of Intention on file in the office of the City Clerk; and WHEREAS, after the adoption thereof, notice of the passage of said Resolution of Intention, headed "Notice of Improvement", was duly and legally posted in the time, form, manner, location, and number as required by law. as appears from the Affidavit of Posting said notices, on file in the office of the City Clerk; and WHEREAS, after the adoption thereof, notices of the adoption of the Resolution of Intention were duly mailed to all persons owning real property proposed to be assessed for the improvements described in said Resolution of Intention No. 87-325, according to the names and addresses of such owners as the same appears on the last mailing or as known to the City Clerk of the City of Rancho Cucamonga, which said copies were duly mailed in the time, form, and manner as required by law, as appears from the Affidavit of Mailing on file in the office of the City Clerk; and WHEREAS. said City Council having duly received considered evidence, oral and documentary. concerning the jurisdiction facts in-this proceeding and concerning the necessity for the contemplated work and the benefits to be derived therefrom and said City Council having now acquired jurisdiction to order the proposed work. SECTION 1: It is hereby resolved by the City Council of the City of Rancho Cucamonga that the public interest and convenience requires the annexation to the District and the ordering of the work, and said City Council hereby orders that the work, as set forth and described in said Resolution of Intention No. 87-325, he done and made; and Resolution No. 87-381 Page 2 SECTION 2: The Report filed by the Engineer is hereby finally approved; and SECTION 3: The assessments and method of assessment in the Engineer's Report are hereby approved. SECTION 4: The assessments shell not begin until after 60 percent of said tracts have been occupied. PASSED, APPROVED, and ADOPTED this 15th day of July, 1987. Authority for Report This report is in compliance with the requirments of Article 4. Chapter 1, Division 15 of the Streets and Highways Code, State of California (Landscaping and Ltg~ttng Act of 1972). SECT[ON 2. General Description ~ts City Council has elected to annex the tracts ena, erated in Exhibit "A" into Street Lighting Maintenance District No. 2. The City Council has determined that the street lights to be maintained will have an effect upon all lots within said tracts as well as on the lots directly abutting the street l t~ts. Work to be provided for with the assessments established by the di strtct are: The furnt shi ng of servi cos and matertal s for the ordinary and usual maintenance, operating and servicing of street light improvements on artera al and cereal n col 1 ector streets. Improvement maintenance is considered of general benefit to all areas in the District and cost shall be divided on a per 1 ot basis. I n the case of contiDal ni ~ms with ai rspace ownership only, and apartments, a dwelling unit shall be considered to benefit the same as a lot. SECTION 3. Plans and Specifications The plans and specifications for street lighting have been prepared by the developers. The plans and street lt~)hts are as stipulated i,, the conditions of approval for the development and as approved by the City Engineering Division.' Reference is hereby made to the subject tract map or development plan and the assessment dialart for the exact location of the street lighting areas. The plans and specifications for street lighting improvement on the individual development is hereby made a part of this report to the same extent as if said plans and specifics were attached hereto. Detailed maintenance activities on the street lighting district include: the repair, removal or replacement of all or any part of any improvement, providing for the ill~ination of the subject area. Resolution No. 87-381 Page 4 SECTION 4. Estimated Costs No costs wi 11 be incurred for street 1 ighti ng improvement construction. All improvements will be constructed by developers. Based on available data, it is estimated that maintenance costs for assessment purposes will be as indicated below. These costs are estimated only, actual assessments will be based on actual cost data. The estimated total cost for Lighting Maintenance District No. 1 including Annexation No. 18 comprised of 74 units and 14 5800L lights, is shown below: 1. S.C.E. SECTION 5. Assessment Diagram Copies of the proposed Assessment Diagrams are attached to this report and labeled "Street Lighting Maintenance District No. 2 ", Annexation No. 18.
