HomeMy WebLinkAbout87-377 - Resolutions RESOLUTION NO. 87-377 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, MAKING EXPRESS FINDINGS OF NEED FOR LOCAL MODIFICATIONS TO THE STATE BUILDING STANDARDS CODE WHEREAS, Health and Safety Code Sections 17958.5 and 17958.7 allow a city to make such modifications to the requirements of the regulations adopted pursuant to Health and Safety Code Section 17922 as it determines to be reasonably necessary because of local conditions; and WHEREAS, the City of Rancho Cucamonga is primarily located in an alluvial fan formed from erosion of the San Gabriel mountains, said alluvial fan consisting largely of rocky, granular, and highly erodeable soils formations; and WHEREAS, the City of Rancho Cucamonga is located in a piedmont area at the base of the San Gabriel mountains, said location characterized by a warm and dry climate that contributes to a much more extensive and more prolonged outdoor living environment than is common to other parts of the state; and WHEREAS, the City of Rancho Cucamonga is subjected on a regular basis to high-intensity dry winds; and WHEREAS, the topography of the City is such that the major portion of the community is located on slopes that hinder timely fire protection response by reason of gradient; and WHEREAS, the National Electrical Code as adopted by the State Building Standards Commission has no requirements for expansion of electrical wiring systems to serve outdoor living areas and accessory buildings; and WHEREAS, the National Electrical Code as adopted by the State Building Standards Commission has no requirements for wiring of detached accessory buildings; and WHEREAS, significant climatic temperature differentials coupled with induced heat from load result in increased corrosion and resultant arcing of improper connections in aluminum wiring; and WHEREAS, the National Electrical Code makes no provision for the utilization and protection from damage of electrical wiring in accessory structures and areas that result from use of such areas because of the favorable climatic conditions; and Resolution No. 87-377 Page 2 WHEREAS, the Uniform Building Code as adopted by the State Building Standards Commission has no requirements for anchorage of small detached accessory buildings against wind forces; and WHEREAS, the Uniform Building Code as adopted by the State Department of Housing and Community Development is adopted on a statewide basis without specific consideration for the above stated geologic, topographic and climatic conditions. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Rancho Cucamonga does hereby determine and make the following express findings: 1. That modifications of Sections 210-52(f), 210-54, 210-70, 220-10(a), 230-212, 300,15(c) and 336-4 of the National Electrical Code, 1987 Edition are necessary due to local climatic conditions exfstent in the City of Rancho Cucamonga which provide an ideal environment for the utilization of accessory areas and structures and outdoor areas for hobby and recreational purposes. 2. That modifications of Sections 1717, 3202{b} and 3203 of the Uniform Building Code, 1985 Edition are necessary due to local climatic and topographic conditions of warm, dry, intense winds tending to propagate and extend fires into surrounding structures and grasslands and to make access for fire fighting apparatus difficult. 3. That modifications of Figure 2g-A and Sections 7004, 7008, 7010 and 7013 of the Uniform Building Code, 1985 Edition are necessary due to geological conditions of rocky, granular soils which subject cut and fill slopes to rapid erosion. 4. That modification of Section 2907(b} Uniform Building Code, 1985 Edition is necessary due to the local climate condition of periodic high winds making anchorage of small buildings i mperati ve. The City Clerk shall attest to the passage of this resolution and shall forward an executed copy. of same and a copy of Ordinance No. 311 adopted herewith to the Department .'of Housing and Community Development, State of California consistent with Section 17958.7 of the Health and Safety Code.
