HomeMy WebLinkAbout87-241 - Resolutions RESCLUTION NO. 87-241 A RESCLUTION OF THE CI?Z COUNCIL OF THE CITY OF RANGGO CUCAMDNGA APPRC~ING A 'SCHEDULE OF PUBLIC IMPROVE AND/OR' FACILITIES · CONSTRUCTION PROGRAM AND AUTHORIZING THE COLLECTION OF FEES PURSUE TO CALIFORNIA GOVERNMENT CODE SECTION 53077'.5 ~dqD' MAKING FIM3INGS IN S~PPORT THEREOF. (i) The City of Rancho Cucamonga currently imposes, and collects at the time of the issuance of building permits, fees on new development for: (1) Park Development; (2) Beautification Fees; (3) System Development Fees; and, (4) Drainage Fees. (ii) The fees referenced in subparagraph ( i), above, are assessed and collected to provide for the construction of public improvements and/or facilities made necessary by new development within the City. (iii) California Government Code Section 53077.5 provides that the payment of these fees, when assessed against residential development, shall be deferred until the final inspection or issuance of the Certificate of Occupancy for the residential development unless: (1) the City determines that the fees will be collected for public improvements and/or facilities for which a separate account has been established and funds appropriated, and for which the City has adopted a proposed construction schedule or plan; and/or, (2) the fees are to reimburse the City for expenditures previously made. (iv) As part of the enabling legislation for each of the fees referenced in subparagraph (i) , above, the fees generated under each separate program are required to each be segregated into separate accounts of the City. As part of the Capital Improvement Budget process, anticipated revenues from each of these fees are assigned within each respective account to various ongoing and proposed improvement projects pertinent to the subject and purpose of each particular fee. (v) This Council is concerned that public improvements and/or facilities related to new developments should be constructed at the earliest opportunity and finds that collection of such fees at the earliest feasible opportunity is in the best interest of the public. (vi) All legal prerequisites prior to the adoption of this Resolution have occurred. B. NOW, THEREFORE, it is found, determined and resolved by the City Council of the City of Rancho Cucamonga as follows: ~QD_ZJ In all respects as set forth in the Recitals, Part A, of this Resolution. Resolution No. 87-241 Page 2 ~iQD_aa This council finds and determines as follows: a. That the fees referenced in this Resolution are each segregated into separate and distinct accounts; b. That funds collected from each of these fees has been appropriated and allocated by the City Council as part of its capital improvement project; and, c. That as part of the Capital Improvement Budget process, and as clarified by this Resolution, a construction schedule and plan for proposed public improvements and/or facilities has been adopted. ~2~iQ_n_3a In conjunction with the Capital Improvement Budget process, the City Council here83y approves the proposed schedule of public improvements and/or facilities relative to each fee program as reflected in the exhibits attached hereto and incorporated by this reference, as follows: a. Park Development Fee (Exhibit "A"); b. Beautification Fee (Exhibit "B"); c. Systems Development Fee (Exhibit "C"; "transportation, major streets and railroad crossings"); and, d. Drainage Fee (Exhibit "D") . ~QD_4a Pursuant to the requirements of California Government Code Section 53077.5, the City Council here~y directs that the fees referenced herein shall be collected at the time of issuance of building permits (or such other time referenced in the respective enabling legislation) and shall not be deferred as required by said Section 53077.5. ~QD_~- The City Clerk is hereby directed to certify to the adoption of this Resolution.
