HomeMy WebLinkAbout87-209 - Resolutions RESOLUTION NO. 87-209 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, AUTHORIZING THE EXECUTION AND SIGNING OF PROGRAM SUPPLEMENT NO. 12 TO LOCAL - STATE AGREEMENT NO. 08-5420 FOR ROADWAY WIDENING IMPROVEMENTS ON ARCHIBALD AVENUE AT THE SOUTHERN PACIFIC TRANSPORTATION COMPANY RAILWAY CROSSING NO. BBO 522.9 WHEREAS, the City Council of the City of Rancho Cucamonga (hereinafter referred to as "Local Agency"), has for its consideration and execution, the Program Supplement No. 12 to Local Agency - State Agreement No. 08-5420 for Roadway Widening Improvements on Archibald Avenue at the Southern Pacific Transportation Company Railway Crossing No. 522.9 located approximately 1/2 mile north of Base Line Road; and WHEREAS, the State of California, Department of Transportation, District Office 8 (hereinafter referred to as "State") processes and monitors Federally funded projects; and WHEREAS, as a condition to payment of Federal funds for said project, the Local Agency shall approve and execute said Program Supplement No. 12. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Rancho Cucamonga, California, that said Program Supplement No. 12 be hereby approved and accepted, and authorize the Mayor to execute the same, and direct the City Clerk to attached a certified copy of this Resolution, as well as type in the Resolution number and date in the blank of the third block of said supplement and mail same to the State for final execution. BE IT ALSO RESOLVED, that the Local Agency shall also comply with the "Special Covenants or Remarks" attached to said supplement: 1. In executing this Program Supplemental Agreement the Local Agency hereby reaffirms the "Nondiscrimination Assurances" contained in the aforementioned Master Agreement for Federal-Aid Programs. 2. The Local Agency will advertise, award, and administer this project and will obtain the State's concurrence prior to either award or rejection of the contract. 3. The Local Agency agrees the payment of Federal funds will be limited to the Detailed Estimate amounts approved by ',he Federal Highway Administration in the Federal-Aid Project Agreement (PR-2), or its modification (PR-2A), and accepts any increases in Local Agency Funds as shown on the Finance or Bid Letter or its modification as prepared by the Office of Local Streets and Roads. All required pavment markings and advance warning signs shall conform to the requirmments of MUTCD, 1978 and shall be placed In their proper location by the Local Agency at the time of completion of the Railroad's work. 5. The cost of maintenance of the crossing shall be as allocated by the Public Utilities Commission. PASSED, APPROVED, and ADOPTED this 6th day of May, 1987.
