A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RAN(~O
CUCAMOR~A, CALIFORNIA, ADO[TIE A POLICY STATEMENT AND
COMMITMENT FOR AN ACTIVE DISADVANTAGED BUSINESS
ENTERPRISES (DBE) PROGRAM
WHEREAS, Federal regulations require recipients of Feders/Highway Act
(FHWA) funds to have an approved Disadvantaged Business Enterprise (DBE)
Progr~m~ and
WHEREAS, each local agency who admhisters FHWA projects must prepare
a DBE proEram for approval by the State of California/Department of
Transportation (CalTrans); and
WHEREAS, annual overall goals for Disadvantaged Businesses must be
established, documented and updated annually.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of
Rancho Cucamonga, as follows:
SECTION 1: It is hereby found. and determined pursuant to Code of
Federal Regulation 496RF, Part 23 and the definition contained therein that the
City adopt the Policy Statement and Commitment for an active Disadvantaged
Business Enterprise (DBE) Program as set forth in Exhibit "1" attached hereto
and made a part of this Resolution.
SECTION 2: This Resolution shall supersede Resolution 85-107 which
establ ished a Disadvantaged/Women Business Enterprises (DBE/WBE) Pol icy and
Program.
SECTION 3: This resolution modifies the City of Rancho Cucamonga
Disadvantaged Business Program to comply with the 1987 Surface Transportation
and Uniform Relocation Assistance Act which presumes that women are socially
and economically disadvantaged individuals whose Participation may be counted
in attaining DBE goals. As such separate WBE goals will no longer be used and
the terms "DBE and WBE" in the current adopted program shall be understood to
mean DBE.
SECTION 4: The City Clerk is hereby directed to mail a copy hereof
and a copy of Exhibit "1" to the State of California, Department of
Transportation, District 08 for approval.
