HomeMy WebLinkAbout87-515 - Resolutions RESOLUTION NO. 87-515 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCliO CUCAMONGA, CALIFORNIA, ORDERING THE WORK IN CONNECTION WITH ANNEXATION NO. 37 TO LANDSCAPE MAINTENANCE DISTRICT NO. 1 AND ACCEPTING THE FINAL ENGINEER' S REPORT FOR TRACT NO. 12650-3 AND 11549-1 (MEDIAN) WHEREAS, the City Council of the City of Rancho Cucamonga did on the 19th day of August, 1987, adopt its Resolution of Intention No. 87-452 to order the therein described work in connection with Annexation No. 37 to Landscape Maintenance District No. 1, which Resolution of Intention No. 87-452 was duly and legally published in the time, form and manner as required by law, shown by the Affidavit of Publication of said Resolution of Intention on file in the .office of the City Clerk; and WHEREAS, after the adoption thereof, notice of the passage of said Resolution of Intention, headed "Notice of Improvement", was duly and legally posted in the time, form, manner, location, and number as required by law, as appears from the Affidavit of Posting said notices, on file in the office of the City Clerk; and WHEREAS, after the adoption thereof, notices of the adoption of the Resolution of Intention were duly mailed to all persons owning real property proposed to be assessed for the improvements described in said Resolution of Intention No. 87-452, according to the names and addresses of such owners as the same appears on the last mailing or as known to the City Clerk of the City of Rancho Cucamonga, which said copies were duly mailed in the time, form, and manner as required by law, as appears from the Affidavit of Mailing on file in the office of the City Clerk; and WHEREAS, said City Council h~ving duly received considered evidence, oral and documentary, concerning the jurisdiction facts in this proceeding and concerning the necessity for the contemplated work and the benefits to be derived therefrom and said City Council h~ving now acquired jurisdiction to order the proposed work. SECTION 1: It is hereby resolved by the City Council of the City of Rancho Cucamonga that the public interest and convenience requires the annexation to the District and the ordering of the work, and said City Council hereby orders that the work, as set forth and described in said Resolution of Intention No. 87-452, be done and made; ~nd SECTION 2: Be it further resolved that the report filed by the ~ngineer is hereby finally approved; and Resolution No. 87-515 Page 2 SECTION 3: Be it further resolved that the assessments and method of assessment in the ~ngineer's Report are hereby approved. SECTION 4: Be it finally resolved that said assessments shell not begin until after 60 percent of said tracts have been occupied. PASSED, APPROVED, and ADOPTED this 16th day of September, 1987. Authelet, City Clerk Resolution No. 87-515 Page 3 CITY OF RANCHO CUCAMONGA Engineer's Report for Landscape Maintenance District No. 1 Annexation No. 37 for Tracts 12650-3 and 11549-1 (Median) SECTION 1. Authority for Report This report is In compliance with the requirements of Article 4, Chapter 1, Oivision 15 of the Streets and HIghways Code, State of California (Landscaping and Lighttng Act of 1972). SECTION 2. General Description This City Counctl has elected to annex all new subdivisions into Landscape Maintenance Dtstrtct No. 1. The Ctty Council has determined that the areas to be maintained will have an effect upon all lots within 12650-3 and 11549-1 (Nedtan) as well as on the lots directly abutting the landscaped areas. All landscaped areas to be maintained In the annexed tracts are shown on the recorded Map as roadway right-of-way or easements to be granted to the City of Rancho Cucamonga. SECTION 3. Plans and Specifications The plans and landscaping are as stipulated in the conditions of approval for the development and as approved by the City Engineering Division. Reference is hereby made to the subject tract map or development plan and the assessment diagram for the exact locatton of the landscaped areas. The plans and specifications for landscaped improvement on the individual development is hereby made a part of this report to the same extent as if said plans and specifications were attached hereto. SECTION 4. Estimated Costs No costs will be incurred for parkway improvement construction. All improvements will be constructed by developers. Based on historical data, contract analysi s and developed work standards, it i s estimated that maintenance costs for assessment purposes wtll equal thirty ($.30) cents per square foot per year. These costs are estimated only, actual assessment will be based on actual cost data. Where the development covered by this annexation involves frontage along arterial or collector streets, which are designated for inclusion in the maintenance district but will be maintained by an active homeowners association, these assessments shall be reduced. SECTZON 5. Assessment Diagram A copy of the proposed assessment diagram is attached to this report and labeled "Exhibit A", by this reference the diagram is hereby incorporated within the text of this report. $ECTZON 6. Assessment ZmProvements for the Dlstrtct are found to be of general beneftt to all lots wtthtn the DIstrict and that assessment shall be equal for each unit. Where there Is more than one dwelling unit per lot or parcel of assessable land, the assessment for each lot or parcel shall be proportional to the number of dwelling units per lot or parcel. The City Council will hold a public hearing in June, to determine the actual assessments based upon the actual costs Incurred by the City during the previous fiscal year which are to be recovered through assessments as requtred by the Landscape and Lighting Act of 1972. SECTZON 7. Order of Events City Council adopts Resolution of Preliminary Approval of Ctty Engtneer's Report. 2. City Council adopts Resolution of Zntention to Annex to District and sets public hearing date. 3. City Counct 1 conducts pub1 tc heart ng, considers al 1 testimony and determines to Annex to the District or abandon the proceedings. 4. Every year in May, the Ctty Engineer files a report wtth the City Council. 5. Every year tn June, the City Council conducts a public hearing and approves, or modifies and approves the individual assessments.
