HomeMy WebLinkAbout87-512 - Resolutions RESOLUTION NO. 87-512 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCliO CUCAMONGA ORDERING T}tE WORK IN CONNECTION WITH ANNEXATION NO. 7 TO STREET LIGHTING MAINTENANCE DISTRICT NO. 4 AND ACCEPTING THE FINAL ENGINEER' S REPORT FOR TRACT NOS. 12671-1, 12671-2, 12671-3 AND 12671-4 WHEREAS, the City Council of the City of Rancho CucamonSa did on the 19th day of AuSust. 1987. adopt its Resolution of Intention No. 87-438 to order the therein described work in connection with Annexation No. 7 to Street LiShtins Maintenance District No. 4, which Resolution of Intention No. 87-438 was duly and legally published in the time. form and manner as required by law. shown by the Affidavit of Publication of said Resolution of Intention on file in the office of the City Clerk; and WHEREAS, after the adoption thereof. notice of the passaSe of said Resolution of Intention, headed "Notice of Improvement", was duly and leaally posted in the time. form, manner. location, and number as required by law, as appears from the Affidavit of Postins said notices, on file in the office of the City CIerk: and WHEREAS, after the adoption thereof, notices of the adoption of the Resolution of Intention were duly mailed to all persons ownins real property proposed to be assessed for the improvements described in said Resolution of Intention No. 87-438, accordins to the names and addresses of such owners as the same appears on the last mailins or as known to the City Clerk of the City of Rancho Cuedmonad. which said copies were duly mailed in the time, form, and manner as required by law, as appears from the Affidavit of Mailins on file in the office of the City Clerk; and WHEREAS, said City Council hayins duly received considered evidence, oral and documentary, concernins the jurisdiction facts in this proceedins and concernins the necessity for the contemplated work and the benefits to be derived therefrom and said City Council heyinS now acquired jurisdiction to order the proposed work. SECTION 1: It is hereby resolved by the City Council of the City of Rancho Cucamonga that the public interest and convenience requires the annexation to the District and the orderhS of the work, and said City Council hereby orders that the work, as set forth and described in said Resolution of Intention No. 87-438, be done and made] 'and SECTION 2: The Report filed by the Engineer is hereby finally approved; and Resolution No. 87-512 Page 2 SECTION 3: The assessments and method of assessment in the ~ngineer's Report are hereby approved. SECTION 4: The assessments shall not begin until after 60 percent of said tracts have been occupied. PASSED, APPROVED, and ADOPTED this 16th day of ~eptember, 1987. Authelet, City Clerk -- ReSOlutiOD No. 87-512 Page 3 CITY OF RANCHO CUCAMONGA Engineer's Report for ANNEXATION NO. 7 to STREET LIGHTING MAINTENANCE DISTRICT NO. 4 Terra Vista Planned Conmnunity Tracts Nos. 12671-1, -2, -3, -4; Milliken Avenue (west half) from Mountain View Drive to north boundary of Tract 12671; Mountain View Drive (north half) from Mtlltken Avenue to eastern boundary of Tract 12365 SECTION 1. Authority for Report This report is prepared in compliance with the requirements of Arttcle 4, Chapter 1, Division 15 of the Streets and Highways Code, State of California (Landscaping and Lighttrig Act of 1982). SECTION 2. Genera~ Description Street Lighting Maintenance District No. 4 (the "District") provides for operation, servicing, and maintenance of street }ights on local and collector streets and secondary arteria~s (except Church Street) in the Tetra Vista Planned Community. A~I residential developments tn Tetra Vista are to be annexed to the District pursuant to Ordinance No, 190; areas to be maintained which lie outside residentia} developments are also to be annexed for mainte- nance purposes. This Annexation No. 7 annexes to the District the fo}lowing area: o Tracts Nos. 12671-1, -2, -3, -4 o Milliken Avenue (west half) from Mountain View Drive to north boundary of Tract 12671 o Mountain View Drive (north half) from Milliken Avenue 'to eastern boundary of Tract 12365 SECTION 3. Plans and Specifications The plans and specifications for' street lighting have been prepared by the developers. The plans and specifications are as stipulated in the con- ditions of approval for the development and as approved by the City Engineering Oivision. Reference is hereby made to the subject tract maps or development plans and the assessment diagrams for the exact location of the street lighting areas. The plans and specifications for street lighting improvements are hereby made a part of this report to the same extent as if said plans and specifications were attached hereto. Resolution No. 87-512 - Page 4 SECTION 4. Estimated Costs No costs will be incurred for street lighting construction. All improvements will be constructed by developers. Based on available data, it is estimated that maintenance costs for assessment purposes will be as set forth below. These costs are estimated only; actual assessments will be based on actual cost data. SECTION S. Annexation Diagram A copy of the proposed annexation area is attached to this report and by this reference is hereby incorporated within the text of this report. SECTION 6. Assessment Maintenance costs for the entire District are found to be of specific benefit to all developed residential property within the District in accordance with the following relationship: Land Use Assessment Units Single family residential dwelling I unit Multifamily residential dwelling .S unit The City Council holds a public hearing in June to determine the actual assessments based upon the actual costs incurred by the City during the prior fiscal year. SECTION 7. Order of Events 1. City Council adopts Resolution of Preliminary Approval of City Engineer's Report. 2. City Council adopts Resolution of Intention to Annex to District and sets public hearing dates. 3. City Council conducts public hearing, considers all testimony and determines to annex to the District or abandon the proceedings. 4. Every year in May, the City Engineer files a report with the City Council. S. Every year in June, the City Council conducts a public hearing and approves, or modifies and approves the individual assessments.
