HomeMy WebLinkAbout87-414 - Resolutions RESOLUTION NO. 87-414 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA CERTIFYING THE SUPPLEMENT TO THE FINAL ENVIRONMENTAL IMPACT REPORT FOR AMENDMENT NO. 1 TO THE · REDEVELOPMENT PLAN FOR THE RANCHO REDEVELOPMENT PROJECT AND REPEALING RESOLUTION NO. 87-289 WHEREAS, the Rancho Cucamonga Redevelopment Agency (the "Agency") has prepared Amendment No..1 to the Redevelopment Plan for the Rancho Redevelopment Project (hereinafter..collectively referred to as the "Redevelopment Plan") and has filed its Report on the Redevelopment Plan with the City Council of the City of Rancho Cucamonga (the "City Council"); and WHEREAS, the Planning Commission of the City of Rancho Cucamonga has approved 'and forwarded to the Agency its report and recommendation that the proposed Redevelopment Plan is in conformity with the General Plan of the City of Rancho Cucamonga and has recommended approval of the Redevelopment Plan; and WHEREAS, the City council has read, reviewed and considered the Supplement to the Final Environmental Impact Report (hereinafter collectively referred to as the "Final EIR") with respect to the adoption of the Redevelopment Plan; WHEREAS, pursuant to notice duly given, the City Council and the Agency have held a full and fair, joint public hearing on proposed Amendment No. I to the Redevelopment Plan and Final EIR and have considered all written and oral comments and testimony relating thereto and are fully advised thereon. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Rancho Cucamonga as follows: Section 1. A full and fair public hearing having been held on the Final EIR and the City Council having considered all oral and written comments received thereon and testimony relating thereto, said Final EIR is hereby approved and adopted as the Final EIR for the adoption of the Redevelopment Plan, and the Final EIR is hereby incorporated herein by reference. Section 2. The City Council hereby certifies that the Final EIR for the adoption of the Redevelopment Plan has been completed in compliance with the California Environmental Quality, as amended, and all applicable state and local environmental guidelines and regulations, and that it has reviewed and considered the Final EIR and the information contained therein in connection with the adoption of the proposed Redevelopment Plan. The City Council hereby finds with respect to the adverse environmental impacts detailed in the Final EIR: (a) That the adverse environmental impacts associated with the adoption of the Redevelopment Plan have been considered and recognized .by the City Council. {b) That comnents and responses made during the public hearing of the City Council and City Council have been considered and recognized by the City Council. (c) That, pursuant to 14 California Administrative. Code 'Section 15091{a), changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the following potentially significant environmental effects: 1. Traffic and Circulation. As discussed on pages 18-19 of the Final EIR, which discussion is incorporated herein by reference. 2. Noise. As discussed on pages lg-22 of the Final EIR, which discussion is incorporated herein.by reference. 3. Public Services. As discussed on pages.22-25 of the Final EIR, which discussion is incorporated herein by reference. However, the proposed mitigation measures described on those pages may not completely mitigate the significant impacts of the project associated with school capacity. Therefore, as discussed in the Response to the Document Entitled "Deficiencies of the Project Plan and Environmental Impact Report as Related to the Five School Districts Serving the Rancho Project Area and Recommendations Regarding Mitigation" and as discussed in the City Council staff report, which discussions are incorporated herein by reference, further changes and alterations have been required in, and incorporated into, the Project which avoid or substantially lessen this potentially significant environmental effect. 4. Parks and Recreational Facilities. As discussed on page 26 of the Final EIR, which. discussion is incorporated herein by reference. 5. Light and Glare. As discussed. on pages 26-27 of the Final EIR, which discussion is incorporated herein by reference. 6. Visual Effects. As discussed on pages 27-28 of the Final EIR, which discussion is incorporated herein by reference. Resolution No. 87-414 Page 3 (d) That no other adverse environmental impacts will result from implementation of the proposed Redevelopment Plan. (e) That environmental, economic, social and other considerations and benefits derived by development of the project override the unavoidable environmental risks of the project and make infeasible · project alternatives identified in the Final EIR. Section 4. The City Council finds that changes or alterations have been required in or incorporated into, the Redevelopment Plan, or mitigation measures have been adopted, which avoid or substantially lessen any significant environmental effects as identified in the Final EIR. The Redevelopment Plan is itself a measure for providing for the mitigation of adverse environmental effects which may otherwise be associated with existing conditions within the Project Area or such development which may occur within the Project Area without redevelopment assistance. As a result of the foregoing, the City Council hereby determines that the implementation of the Redevelopment Plan will not have a significant effect on the environment. To the extent that there are any remaining significant effects upon the environment, the City Council hereby determines such effects are unavoidable and acceptable because the benefits of the adoption of the Redevelopment Plan outweigh any such adverse environmental effects, in that the redevelopment of the Project Area and the elimination of blight therein pursuant to Health and Safety Code Section 33000, et seq., will generally create a better living and working environment for the Project Area and the community. Section 5. The City Clerk is hereby authorized and directed to file a Notice of Determination pursuant to 14 California Administrative Code Section 15094. Section 6.
