HomeMy WebLinkAbout87-412 - Resolutions RESOLUTION NO. 87-412 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OE RANCHO CUCAMONGA ORDERING THE WORK IN CONNECTION WITH ANNEXATION NO. 26 TO STREET LIGHTING MAINTENANCE DISTRICT NO. 1 AND ACCEPTING THE FINAL ENGINEER'S REPORT FOR TRACT NO. 10349 WHEREAS, the City Council of the City of Rancho Cucamonga did on the 1st day of July, 1987, adopt its Resolution of Intention No. 87-349 to order the therein described work in connection with Annexation No. 26 to Street Lighting Maintenance District No. 1, which Resolution of Intention No. 87-349 was duly and legally published in the time, form and manner as required by law, shown by the Affidavit of Publication of said Resolution of Intention on file in the office of the City Clerk; and WHEREAS, after the adoption thereof, notice of the passage of said Resolution of Intention, headed "Notice of Improvement", was duly and legally posted in the time, form, manner, location, and number as required by law, as appears from the Affidavit of Posting said notices, on file in the office of the City Clerk; and WHEREAS, after the adoption thereof, notices of the adoption of the Resolution of Intention were duly mailed to all persons owning real property proposed to be assessed for the improvements described in said Resolution of Intention No. 87-349, according to the names and addresses of such owners as the same appears on the last mail ing or as known to the City Clerk of the City of Rancho Cucamonga, which.said copies were duly mailed in the time, form, and manner as required by law, as appears from the Affidavit of Mailing on file in the office of the City Clerk; and WHEREAS, said City Council having duly received considered evidence, oral and documentary, concerning the jurisdiction facts in this proceeding and concerning the necessity for the contemplated work and the benefits to be derived therefrom and said City Council having now acquired jurisdiction to order the proposed work. SECTION 1: It is hereby resolved by the City Council of the City of Rancho Cucamonga that the public interest and convenience requires the annexation to the District and the ordering of the work, and said City Council hereby orders that the work, as set forth and described in said Resolution of Intention No. 87-349, be done and made; and SECTION 2: The Report filed by the Engineer is hereby finally approved; and Resolution No. 87-412 Page 2 SECTION 3: The assessments and method of assessment in the Engineer's Report are hereby approved. SECTION 4: The assessments shall not begin until after 60 percent of said tracts have been occupied. PASSED, APPROVED, and ADOPTED this 5th day of August, 1987. Beverly A/Authele't, City Clerk Resolution No. 87-412 Page 3 CITY OF RANCHO CUCAMONGA Engineer's Report for Street Lighting Maintenance Dtstrict No. 1 Annexation No. 26 for Tracts 10349 SECTION 1. Authority for Report This report is in compliance with the requirements of Article 4, Chapter 1, Division 15 of the Streets and Highways Code, State of California (Landscaping and Lighting Act of 1972). SECTION 2. General Description This City Council has elected to annex the tracts enumerated in Exhibit "A' into Street Lighting Maintenance District No. 1. The City Council has determined that the street lights to be maintained will have an effect upon all lots within said tracts as well as on the lots directly abutting the street 1 ights. Work to be provided for with the assessments established by the di strict are: The furni shi ng of services and material s for the ordinary and usual maintenance, operating and servicing of street light improvements on arterial and certain col 1 ector streets. Improvement maintenance .is considered of general benefit to all areas in the District and cost shall be divided on a per 1 ot basis. I n the case of condomi ni urns with ai rspace ownership only, and apartments, a dwelling unit shall be considered to benefit the same as a lot. SECTION 3. Plans and Specifications The plans and specifications for street lighting have been prepared by the developers. The plans and street lights are as stipulated in the conditions of approval for the development and as approved by the City Engineering Division. Reference is hereby made to the subject tract map or development plan and the assessment diagram for the exact location of the street lighting areas. The plans and specifications for street lighting improvement on the individual development is hereby made a part of this report to the same extent as if said plans and specifics were attached hereto. Detailed maintenance activities on the street lighting district include: the repair, removal or replacement of all or any part of any improvement, providing for the illumination of the subject area. Resolution No. 87-412 Page 4 SECTICN 4. Estimated Costs No costs wi 11 be incurred for street 1 ighti ng improvement construction. All improvements wtll be constructed by developers. Based on available data, it ts estimated that maintenance costs for assessment purposes will be as indicated below. These costs are estimated only, actual assessments will be based on actual cost data. -The estimated total cost for Lighting Maintenance District No. 1 including Annexation No. 26 comprised of 13,399 units is shown below: 1. Assessment Diagram Copies of the proposed Assessment Diagrams are attached to this report and labeled "Street Lighting Hatntenance District No. 1", Annexation No. 26. These diagrams are hereby incorporated within the text of this report. Resolution No. 87-412 Page 5 SECTI~ 6. Assessment Improvements for the Dtstrict are found to be of general benefit to all dwelling units within the District and that assessment shall be equal for each unit. Where there is more than one dwelling untt per lot or parcel of assessable land, the assessment for each lot or parcel shall be proportional to the n~ber of dwelling units per lot or parcel. It is proposed that all future development shall be annexed to the D i strl ct. SECTICN 7. Order of Events 1. City Council adopts Resolution of Preliminary Approval of City Engineer' s Report. 2. Ctty Counctl adopts Resolution of Intention to annex a Dtstrtct and sets publlc heartng date. 3. City Counct1 conducts public heart rig, considers all testteony and determines to fore a Dtstrtct or abandon the proceedings. 4. Every year in May, the Ctty Engtneer files a report wtth the CIty Council. S. Every year in dune, the City Council conducts a public hearing and approves, or modifies and approves the individual assessments.
