I AND ACCEPTING THE FINAL ENGINEERt S REPORT FOR DR 87-22, DR 86-42. CUP 85-37 (PCL 3 OF PM 9487), TRACT NOS. 12873. 13279 AND 13443 WHEREAS, the City Council of the City of Rancho Cucamonga did on the 18th day of November, 1987, adopt its Resolution of Intention No. 87-626 to order the therein described work in connection with Annexation No. 33 to Street Lighting Maintenance District No. 1. which Resolution of Intention No. 87-626 was duly and legally published in the time, form and manner as required by law, shown by the Affidavit of Publication of said Resolution of Intention on file in the office of the City Clerk; and WHEREAS. after the adoption thereof. notice of the passage of said Resolution of Intention. headed "Notice of Improvement", was duly and legally posted in the time, form, manner, location, and number as required by law, as appears from the Affidavit of Posting said notices, on f41e in the office of: the City Clerk; and WHEREAS, after the adoption thereof, notices of the adoption of the Resolution of Intention were duly mailed to all persons owning real property proposed to be assessed for the improvements described in said Resolution of Intention No. 87-626, according to the names and addresses of such owners as the same appears on the last mailing or as known to the City Clerk of the City of Rancho Cucamonga, which said copies were duly mailed in the time, form, and manner as required by law, as appears from the Affidavit of Mailing on file in the office of the City Clerk; and WHEREAS. said City Council having duly received considered evidence. oral and documentary. concerning the jurisdiction facts in this proceeding and concerning the necessity for the contemplated work and the benefits to be derived therefrom and said City Council having now acquired jurisdiction to order the proposed work. SECTION 1: It is hereby resolved by the City Council of the City of Rancho Cucamonga that the public interest and convenience requires the annexation to the District and the ordering of the work, and said City Council hereby orders that the work. as set forth and described in said Resolution of Intention No. 87-626, be done and made; and SECTION 2: The Report filed by the Engineer is hereby finally approved; and SECTION 3: The assessments and method of assessment in the Engineerrs Report are hereby approved. Authority for Report This report is tn compliance with the requirements of Arttcle 4, Chapter 1, Dtvtsion 15 of the Streets and Htghways Code, State of California (Landscaping and Lighting Act of 1972). SECTION 2. General Description This City Counctl has elected to annex a]l new developments into Street Lighting Hatntenance District No. 1. The City Council has determined that the street lights to be maintained wtll have an effect upon a]l lots within said developments as well as on the lots dtrect]y abutting the street lights. Work to be provided for with the assessments established by the dtstrtct are: The furnishing of servtces and materials for the ordtnary and usual maintenance, operating and servicing of street ]tght improvements on major streets (arterial and certain collector streets) as shown on the Ltghtfng Dtstrtct Altas Hap whlch is on file with the Ctty Engineer. Improvement maintenance ts considered of general benefft to all areas in the District and cost shall be assessed on a per untt basts. SECTION 3. Plans and Specifications The p3ans and specifications for street lighttrig have been prepared by the developers. The plans and street lights are as stipulated in the conditions of approval for the development and as approved by the Ctty Engineerlng DIvision. Reference is hereby made to the subject tract map or development Man and the assessment dtagrae for the exact location of the street ltghttng areas. The plans and specifications for street ]tghtlng improvement on the tndtvtdua] development ts hereby made a part of this report to the same extent as if said plans and specifics were attached hereto. Detailed maintenance activities on the street ltghttng dtstrtct include: the repair, removal or replacement of all or any part of any improvement, providing for the Illumination of the subject area. Resolution No. 87-686 Page 4 SECTZON 4. Esttmatffd Costs No costs will be tncuPred for street ltghttng improvement construction. All Improvements wtll be constructed by developers. Based on available data, ~t ts estimated that ma(ntenance costs for assessment purposes will be as ~ndtcated below. These costs are estimated only, actual assessments will be based on actual cost data. Street L~ght~ng Maintenance Dtstrtct No. 1 has been deearcated tnto two zones. Zone 1 ts comprised of street 11ght Improvements on major streets for residential Improvements (stngle faintly, multi-family, condomtntums and apartments) throughout the C~ty. Each dwelllng untt tn this zone wtll be assessed as one assessment untt for the operation of the DIstrict. Zone 2 ts comprised of all ~ndustr~al, cornerda1 and Institutional projects throughout the City. It has been detenetned that one acre of land tn industrial, co~eerdal and Institutional areas derives the same beneftt as two assesgent untts tn Zone 1. Assessment Dtagram Copies of the proposed Assessment Diagram are attached to this report and labeled "Street Lighting Maintenance District No. Annexation No. 33. These diagram are hereby incorporated within the text of this report. SECTION 6. Assessment Improvements for the District are found to be of general benefit to all units within the Distrtct and that assessment shall be equal for each unit. When units are based on acreage, assessment will be 2 units per net acre. SECTION 7. Order of Events 1. City Council adopts Resolution of P~ltmtnary Approval of City Engtneer's Rdport. 2. Ctty Council adopts Resolution of Intention to annex a Otstrtct and sets public hearing date. 3. City Council conducts public hearing, considers all testimony and determines to form a District or abandon the proceedings. 4. Every year in May, the City Engineer files a report with the City Council. 5. Every year in June, the City Council conducts a public hearing and approves, or modifies and approves the individual assessments.
