HomeMy WebLinkAbout87-659 - Resolutions RESOLUTION NO. 87-659 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANC~O CUCAMDNGA ORDERING THE WORK IN CONNECTION WITH ANNEXATION NO. 39 TO LANDSCAPE MAINTENANCE DISTRICT NO. I AND ACCEPTING THE FINAL ENGINEER' S REPORT FOR HELLMAN AVENUE PARKWAY FOR TRACT NO. 12238 WHEREAS, the City Council of the City of Rancho Cucamonga did on the 4th day of November, 1987, adopt its Resolution of Intention No. 87-597 to order the therein described work in connection with Annexation No. 39 to Landscape Maintenance District No. 1, which Resolution of Intention No. 87-597 was duly and legally published in the time, form and manner as required by law, shown by the Affidavit of Publication of said Resolution of Intention on file in the office of the City Clerk; and WHEREAS, after the adoption thereof, notice of the passage of said Resolution of Intention, headed "Notice of Improvement", was duly and legally posted in the time, form, manner, location, and number as required by law, as appears from the Affidavit of Posting said notices, on file in the office of the City Clerk; and WHEREAS, after the adoption thereof, notices of the adoption of the Resolution of Intention were duly mailed to all persons owning real property proposed to be assessed for the improvements described in said Resolution of Intention No. 87-597 according to the names and addresses of such owners as the same appears on the last mailing or as known to the City Clerk of the City of Rancho Cucamonga, which said copies were duly mailed in the time, form, and manner as required by law, as appears from the Affidavit of Mailing on file in the office of the City Clerk; and WHEREAS, said City Council having duly received considered evidence, oral and documentary, concerning the jurisdiction facts in this proceeding and concerning the necessity for the contemplated work and the benefits to be derived therefrom and said City Council having now acquired jurisdiction to order the proposed work. SECTION 1: It is hereby resolved by the City Council of the City of Rancho Cucamonga that the public interest and convenience requires the annexation to the District and the ordering of the work, and said City Council hereby orders that the work, as set forth and described in said Resolution of Intention No. 87-597, be done and made; and SECTION 2: Be it further resolved that the report filed by the Engineer is hereby finally approved; and SECTION 3: Be it further resolved that the assessments and method of assessment in the Engineer's Report are hereby approved. Resolution No. 87-659 Page 2 SECTION 4: Be it finally resolved that said assessments shall not begin until after 60 percent of said tracts have been occupied. Authelet, City Clerk Resolution No. 87-659 Page 3 CITY OF RANCHO 'CUCANONGA Engtneer' s Report for Landscape Maintenance District No. 1 ANNEXATION NO. 39 for Hellman Avenue Parkway for Tract No. 12238 SECTION 1. Authority for Report This report is fn compliance with the requirements of Article 4, Chapter 1, Division 15 of the Streets and Highways Code, State of California (Landscaping and Lighting Act of 1972). SECTION 2. General Description This City Council has elected to annex all new subdivisions into Landscape Maintenance District No. 1. The City Council has determined that the areas to be maintained will have an effect upon all lots within Tract Numbers 12238 and 12530 as well as on the lots dtrectly abutttng the landscaped areas. All landscaped areas to be maintained in the annexed tracts are shown on the recorded Map as roadway right-of-way or easements to be granted to the City of Rancho Cucamonga. SECTION 3. Plans and Specifications The plans and landscaping are as stipulated tn the conditions of approval for the development and as approved by the City Engfneertng Division. Reference fs hereby made to the subject tract map or development plan and the assessment diagram for the exact location of the landscaped areas. The plans and specifications for landscaped improvement on the individual development fs hereby made a part of this report to the same extent as tf said plans and specfftcattons were attached hereto. SECTION 4. Estimated Costs No costs wtll be fncurred for parkway improvement construction. All improvements will be constructed by developers. Based on historical data, contract analysis and developed work standards, ft ts estimated that maintenance costs for assessment purposes wt11 equal thfrty ($.30) cents per square foot per year. Where the development covered by thts annexation tnvolves frontage along arterial or collector streets, which are designated for Inclusion in the maintenance district but wtll be maintained by an acttve homeowners association, these assessments shall be reduced. SECTION 5. Assessment Diagram A copZ of the proposed assessment diagram is attached to this report and labeled Exhibit A", by this reference the diagram is hereby incorporated within the text of this report. SECTION 6. Assessment In~0rovements for the District are found to be of general benefit to all lots within the District and that assessment shall be equal for each unit. Where there is more than one dwelling unit per lot or parcel of assessable land, the assessmnt for each lot or parcel shall be proportional to the nunWDer of dwelltrig units per lot or parcel. The City Council will hold a public hearing in June, to determine the actual assessments based upon the actual costs incurred by the City during the previous fiscal year which are to be recovered through assessments as required by the Landscape and Lighting Act of 1972. SECTION 7. Order of Events 1. City Council adopts Resolution of Preliminary Approval of City Engtneer's Report. 2. City Council adopts Resolution of Intention to Annex to District and sets public hearing date. 3. City Council conducts public hearing, considers all testimony and determines to Annex to the Oistrict or abandon the proceedings. 4. Every year in May, the City Engineer files a report with the City Council. 5. Every year in June, the City Counctl conducts a public hearing and approves, or modifies and approves the individual assessments.
