DECLARIN~ ITS INTENTION TO ORDER THE ANNEXATION TO STREET LIGHTING MAINTENANCE DISTRICT NO. 3, AN ASSESSMENT DISTRICT: DESIGNATING SAID ANNEXATION AS ANNEXATION NO. 6 TO STREET LIGHTING MAINTENANCE DISTRICT NO. 3~ PURSUANT TO THE LANDSCAPING AND LIGHTIRI~ ACT OF 1972 AND OFFERING A TIME AND FLACE FOR HEARING ~BJECTIONS THERETO N8~, THEREFORE BE IT RESOLVED by the City Council of the City of Rancho Cucamonga, pursuant to the provisions of the Landscaping and Lighting Act of 1972, being Division 15 of the Streets and Higknways Code of the State of California, as follows: SECTION 1. Description of Work: That the public interest and convenience require and it is the intention of this City Council to form a maintenance district in the City of Rancho Cucamonga for: the maintenance and operation of those street lights the boundaries of the proposed mahtenance district described in Section 2 hereof. Said maintenance and operation includes the cost and supervision of any lighting and related facilities in connection with said district. SECTION 2. Location of Work| The foregoing described work is to be located within roadway right-of-way enumerated in the report of the City Engineer and more particularly described on maps which are on file in the office of the City Clerk, entitled "Annexation No. 6. to Street Lighting Maintenance District No. 3e. SECTION 3. D.e...acriptien. of Assessment Districts That the contemplated work, in the opinion of. said City Council, is of more than local or ordinary public benefit, and the said City Council hereby makes the expense of the said work chargeable upon a district, which said district is assessed to pay the costs and expenses thereof, and which district is described as follows: All that certain territory of the City of Rancho Cucamonga included within the exterior boundary lines shown upon that certain eMap of Annexation No. 6 to Street Lighting Maintenance District No. 3" maps is on f~le in the office of the City Clerk of said City. SECTION 4. Report of En2ineer: The City Council of said City by Resolution No. 87-629 has approved the report of the engineer of work which report indicates the amount of the proposed assessment, the district boundary, assessment zones, titled "Engineert s Report, Street Lighting Maintenance District No. 3w is on file in the office of the City Clerk of said City. Reference to said report is hereby made for all particulars for the amount and extent of the assessments and for the extent of the work. Resolution No. 87-630 Page 2 SECTION 5. Collection of Assessments: The assessment shall be collected at the same time and in the same manner as County taxes are collected. The City Engineer shall file a report annually with the City Council of said City and said Council will annually conduct a hearing upon said report at their first reSular meetinS in June, at which time assessments for the next fiscal year will be determined. SECTION 6. Time and Place of HearinS: Notice is hereby Siren that on December 16, 1987, at the hour of 7:30 p.m. in the City Council Chambers at 9161 Base Line, in the City of Rancho CucemonSa, any and all persons h~vinS any ob_~ections to the work or extent of the assessment district. may appear and show cause why said work should not be done or carried out or why said district should not be formed in accordance with this Resolution of Intention. Protests must be in writinS and must contain a description of the property in which each si~ner thereof is interested, sufficient to identify the same, and must be delivered to the City Clerk of said City prior to the time set for the hearinS. and no other protests or objections will be considered. If the siSnet of any protest is not shown upon the last equalized assessment roll of San Bernardino County as the owner of the property described in the protests, then such protest must contain or be accompanied by written evidence that such siSnet is the owner of the property so described. SECTION 7. LandscapinS and LightinS Act of 1972: All work herein proposed shall be done and carried throuSh in pursuance of an act of the leSislature of the State of California desiSnated the Landscaping and LightinS Act of 1972. beinS Division 15 of the Streets and Highways Code of the State of California. SECTION 8. Publication of Resolution of Intention: Published notice shall be made pursuant to Section 61961 of the Government Code. They Mayor shall siSn this Resolution and the City Clerk shall attest to the same, and the City Clerk shall cause the same to be published 10 days before the date set for the hearinS, at least once in The Daily Report, a newspaper of Seneral circulation published in the City of Ontario, California. and circulated in the City of Rancho CucamonSa, California.
