A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAMONGA, CALIFORNIA, SUMMARILY ORDERING THE VACATION
OF A DRAINAGE EASEMENT AFFECTING THE NORTHEASTERLY 30
FEET OF LOT 12, TRACT 9350
WHEREAS, by Chapter 4, Article 1, Section 8330, of the Streets and
Highway Code, the City Council of the City of Rancho Cucamonga is authorized to
summarily vacate a City drainage easement hereinafter more particularly
described~ and
WHEREAS, the City Council has found from all evidence submitted that a
drainage easement affecting the northeasterly 30 feet of Lot 12, Tract 9350 is
unnecessary for present or future drainage purposes.
NO~, THEREFORE, BE IT RESOLVED by the City Council of the City of
Rancho Cucemonga as follows:
SECTION 1: That the City Council of the City of Rancho Cucamonga
hereby makes its order vacating that drainage easement which is that portion of
Lot 12, Tract No. 9350 in the City of Rancho Cucemonga, County of San
Bernardino, State of California, as per map recorded in Book 137, pages 68
through 72. inclusive, of Maps in the office of the County Recorder, of said
County, being the 30-foot San Bernardino County Drainage easement shown on said
map on file in the office of the City Clerk of the City of Rancho Cucemonga,
which has further been described in a legal description which is attached
hereto, marked Exhibit "A", and by reference made a part thereof and excepting
from above order the easement recorded as instrument 85-059394 of official
records of the County Recorder of San Bernardino County, California.
SECTION 2: That from and after the date the resolution is recorded,
said portion of a drainage easement affecting the northeasterly 30 feet of Lot
12, Tract 9350 no longer constitutes a drainage easement.
SECTION 3: That the City Clerk shall cause a certified copy of this
resolution to be recorded in the office of the County Recorder of San
Bernardino County, California.
PASSED, APPROVED, and ADOPTED this 18th day of November, 1987.

County of San Bernardino, State of California, as per map recorded in
Book 137, pages 68 through 72, inclusive, of Maps in the office of the
County Recorder, said County, being the 30 foot San Bernardino County
Drainage easement as shown on said map. Excepted from this vacation is
the easement recorded as instrument 85-059394 of official records of the
County Recorder of San Bernardino, California.
