HomeMy WebLinkAbout87-604 - Resolutions KES~LUTION NO. 87-604 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCliO CUCAMONGA, CALIFORNIA, ORDERING THE WORK IN CONNECTION WITH ANNEXATION NO. 23 TO STREET LIGHTING MAINTENANCE DISTRICT NO. 2 AND ACCEPTING THE 'FINAL ENGINEER' S REPORT FOR TRACT NOS. 13542-1, 13475 AND 10414 kVHEREAS, the City Council of the City of Rancho CucamonBa did on the 7th day of October, 1987, adopt its Resolution of Intention No. 87-542 to order the therein described work in connection with Annexation No. 23 to Street Lighting Maintenance District No. 2, which Resolution of Intention No. 87-542 was duly and. legally published in the time, form and manner as required by la~, shown by the Affidavit of Publication of said Resolution of Intention on file in the office of the City Clerk; and WHEREAS. after the adoption thereof, notice of the passage of said Resolution of Intention. headed "Notice of Improvenan=", was duly and legally posted in the time, form. m~nner, location, and number as required by law, as appears from the Affidavit of Posting said notices, on file in the office of the City Clerk; and WHEREAS, after the adoption thereof, notices of the adoption of the Resolution of Intention were duly mailed to all persons owning real property proposed to be assessed for the improvements described in said Resolution of Intention No. 87-542, according to the names and addresses of such owners as the same appears on the last mailing or as kncsm to the City Clerk of the City of Rancho Cucamonga, which said copieswexe duly mailed in ~he ~m~, form, and manner as requiredby law, as appears frum the.Affidavit of Mailing on file in the office of the City Clerk; and WHEREAS, said City Council having duly received considered evidence, oral and documentary,'concerning the jurisdiction facts in this-proceeding and concerning the necessity for the contemplated work and the benefits to be derived therefrom and said City Council having now acquired jurisdiction to order the proposed work. SECTION lz It is hereby resolved by the City Council of the City of Rancho Cucsmon~a that the public interest and convenience requires the annexation to the District and the ordering of the work, and said City Council hereby orders that the work, as set forth and described in said Resolution of Intention No. 87-542 be done and made; and SECTION 2: The Report filed by the Engineer is hereby finally approved; and SECTION 3: The assessments and method of assessment in the Engineerrs Report are hereby approved. City Cler~ Resolution No. 87-604 Page 3 CITY OF RANCHO CUCAI~ONGA Engineer' s Report for Street Lighttrig Maintenance Oistrlct No. 2 Annexation No. 23 for Tract Nos. 13541-1, 13475 and 10414 SECTION 1. Authority for Report This report is in compliance with the requirements of Article 4, Chapter 1, Division 15 of the Streets and Highways Code, State of California (Landscaping and Lighting Act of 1972). SECTION 2. General Description :. This City Council has elected to annex the developments enlerated in Exhibit "A" into Street Lighting Maintenance District No. 2. The City Council has determined that the street lights to be maintained will have an effect upon all lots within said tracts as well as on the lots directly abutting the street 1 ights. Work to be provided for with the assessments established by the district are: The furnishing of services and materials for the ordinary and usual maintenance, operating and servicing of street light tmprovenents on local residential streets. Improvement maintenance is considered of general benefit to all areas in the District and cost shall be divided on a per unit basis. SECTION 3. Plans and Specifications The plans and specifications for street lighting have been prepared by the developers. The plans and street lights are as stipulated in the conditions of approval for the development and as approved by the City Engineering Division. Reference is hereby made to the subject tract map or development plan and the assessment diagram for the exact location of the street lighting areas. The plans and specifications for street lighting improvement on the individual development is hereby made a part of this report to the same extent as if said plans and specifics were attached hereto. Detailed maintenance activities on the street lighting district include: the repair, removal or replacement of all or. any part of any improvement, providing for the illmnination of the subject area. Resolution No. 87-604 Page 4 SECTION 4. Estimated Costs' No costs wi 11 be incurred for street 1 ighti ng improvement construction. All improvements will be constructed by developers. Based on available data, it is estimated that maintenance costs for assessment purposes will be as indicated below. These costs are estimated only, actual assessments will be based on actual cost data. The estimated total cost for 1,igHting Haintenance District No. 2 including Annexation No. 23 is shown below: 1. Resolution No. 87-604 Page 5 SECTION 5. Assessment Diagram Copies of the proposed Assessment Diagrams are attached to this report and labeled "Street Lighting Naintenance District No. 2", Annexation No. 23. These diagrams are hereby incorporated within the text of this report. SECTION 6. Assessment Inq~rovements for the District are found to be of general benefit to all units within the District and that assessment shall be equal for each unit. Where there is more than one dwelling unit per lot or parcel of assessable land, the assessment for each lot or parcel shall be proportional to the number of dwelling units per lot or parcel. It is proposed that all future development shall be annexed to the Di strict. SECTION 7. Order of Events 1. City Council adopts resolution instituting proceedings. 2. City Council adopts Resolution of Preliminary Approval of City Engineer's Report. 3. City Council adopts Resolution of Intention to annex a District and sets public hearing date. 4. City Counci 1 conducts public hearing, considers al 1 testimony and determines to fore a District or abandon the proceedings. 5. Every year in Nay, the City Engineer files a report with the City Council. 6. Every year in june, the City Council conducts a public hearing and approves, or modifies and approves the individual assessments.
