HomeMy WebLinkAbout87-601 - Resolutions RXSOLUTION NO. 87-601 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCliO CUCAMONGA, CALIFORNIA DECLARING ITS INTENTION TO ORDER THE ANNEXATION TO LANDSCAPE HAINT~qANCE DISTRICT NO. 4, AN ASSESSMENT DISTRICT= DESIGNATING SAID ANNK~_&TION AS ANNEXATION NO. 8 TO LANDSCAPE MAINTENANCE DISTRICT NO. 4; PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972 AND OFFERING A TIME AND PLACE FOR HEARING OBJECTIONS THERETO Na4, THEREFORE BE IT RESOLVED by the City Council of the City of Rancho Cucsmonga, pursuant to the provisions of the Landscaping and Lighting Act of 1972, being Division 15 of the Streets and Highways Code of the State of California, as follo~s: SECTION 1. Description of Work: That the public interest and convenience require and it is the intention of this City Council to form a maintenance district i~ the City of Rancho Cucsmonga for the maintenance and operar/on oF those parkNays and facilities thereon dedicated for common greenbelt purposes by deed or. rpcorded subdivision .tract map within the boundaries of the proposed maintenance district described in Section 2 hereof. Said maintenance and operation includes the cost end supervision of any sprinkler system, =~_ees,~ grass, planr/nSs, landscaping, ornamental lightinS, structures, end walls in connection with said parkNays. SECTION 2. Location' of'~ WoXk~- The foregoing described work is to be located within roadway right-of-way and landscaping easements of Landscape Maintenance District No. 4 enumerated in the report of the City Engineer and more particularly described on maps which are on file in the office of the City Clerk, entitled wAnnmtlon. No. 8 to Landscape Maintenance District No. SBCTION 3. Description of .Assessmentl District= That the contemplated work, in the opinion of said City Council, is of more then local or ordinary public benefit, and the said City Council hereby makes the expense of the said work chargeable upon a district, which said district is assessed to pay the costs and expenses thereof, and-which district is described as follows= All that certain territory of the City of Rancho Cucamonga · included within the exterior boundary lines shown upon that certain eMap of Annexation No. 8 to Landscape Maintenance District No. 4w heretofore approved by the City Council of said City by Resolution No. 87-600, indicatin8 by said boundary lines the extent of the territory included within the proposed assessment district and which map is on file in the office of the City Clerk of said City. Resolution No. 87-601 Page 2 SECTION 4. Report of EnSineer: The City Council of said City by Resolution No. 87-600 has approved the report of the engineer of work which report indicate the amount of the proposed assessment, the district boundary, assessment sones, titled "Engineerrs Report, Annexation No. 8, Landscape Maintenance District No. 4" is on file in the office of the City Clerk of said City. Referfence to said report is hereby made for all particulars for the amount and extent of the assessments and for the extent of the work. SECTION 5. Collection of Assessments= The assessment shall be collected at the same' time- and in the same manner as Country taxes are collected. The City Engineer shall file a report annually with the City Council of said City and said Council will annually conduct a hearing upon said report at their first regular meeting in June, at which time assessments for the next fiscal year will be determined. SECTION 6. Time and Place of HearinK: Notice is hereby given that on December 2, 1987. at the hour of 7:30 pm in the City Council Chambers at 9161 Base Line, in the City of Rancho Cucamonga, any and all persons having any objections to the work or extent of the assessment district, may appear end show cause why said work-. should not be done or carried-out or why said district should not be formed in accordance with this Resolution of Inten~ion. Protests must be in writing and must contain a description of the property in which each signer thereof is interested. sufficient to identify the same, and must be delivered to the tit7 Clerk of said City prior. to the time set for the hearing. and no other protests or objections will be constdere~.-~ If the, siSnor of any protest is not shown upon the last equallzedassessment roll of San Bernardino County as the owner of the property described in the protests. then such protest must contain or be accompanied by Wri~enev.idence_that such signer is the owner of the property so' described. SECTION 7. Landscaping and LightinS;Act of 1972z All the work heroin proposed shall be done and carried through in pursuance of an act of the legislature of the State of California designated the Landscaping and Lighting Act of 1972. being Divis~onl5 of the Streets and Highways! Code of the State of California. SECTION 8. Publication of Resolution o~ Intention~ Published notice shall be made pursuant to Section 61961 of the Government Code. The Mayor shall sign this Resolution and the City Clerk shall attest to the same, end the City Clerk shall cause the same to be published 10 days before the datedset for the hearing, at least once in The Deil[ Report, a newspaper of general circulation published in the City of Ontario, California, end circulated in the City of Rancho Cocamonga, Callfornia.I FUELED FROM AGENDA this 4th day of November, 1987.
