HomeMy WebLinkAbout90-015 - Resolutions RESOLUTION NO. 90-015 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, ESTABLISHING FILM PERMIT REGULATIONS WHEREAS, the City Council of the City of Rancho Cucamonga has adopted Ordinance No. 410 establishing film permit procedures. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby resolve that the following filming regulations be established: SECTION 1: Filmin~ on Private Property. The permittee is required to obtain the property owner's permission, consent, and/or lease for use of property not owned or controlled by the City. SECTION 2: Filmin~ in Residential Neighborhoods. For protection and safety reasons, and to protect the integrity of the City's residential neighborhoods, the following regulations shall apply: A. As part of the permit application, written permission will be required from the property owner(s) and or tenant(s) of each location to be used. B. For the convenience of the general public, all activity by a permittee between the hours of 10:00 P.M. and 6:00 A.M. may be restricted. As a condition of film permit approval, all surrounding residents and/or businesses within a three hundred foot radius of the filming activity may be required to be notified of date(s) and time(s) in which late evening and early morning filming is to take place. C. Filming activities, such as gunfire, sirens, public address systems, bull horns or other loud noises, may be approved subject to review by the Film Permit Officer. D. Helicopter landings, or filming from the air will not be permitted, without explicit written permission from the City Manager. E. Exceptions to these restrictions may be granted in extreme circumstances upon review by the Film Permit Officer and/or Public Safety Agency or Department. SECTION 3: Required Public Safety Emplosees. A. Police and/or fire personnel requirements shall be determined by those departments and any personnel required at the location{s} shall be at permittee's expense. B. Additional Public Safety employees may be requested by the permittee at the time the application is filed. Resolution No. 90-015 Pa ge 2 C. The responsibilities of the Public Safety employee(s) encompass the interest of the citizens of Rancho Cucamonga as well as the movie company. These officers are employees of the Citj~ not the movie company and they will enforce all City regulations. D. On-site supervision by Public Safety personnel are in the public interest, however, the requirement for both a firefighter and a police officer may be modified at the discretion of those departments in circumstances where one public safety official is deemed sufficient. SECTION 4: Clean Up. The permittee shall conduct operations in an orderly fashion with continuous attention to the storage of equipment not in use and the cleanup of trash and debris. The area used shall be cleaned of trash and debris upon completion of shooting at the scene and restored to the original condition before leaving the site. To ensure cleanup and restoration of the site, an applicant may be required to post a refundable faithful performance bond (amount to be determined) prior to permit approval or as a condition of the permit. Upon completion of filming and inspection of the site by the City, the bond may be returned to the applicant. SECTION 5: Public Works Department (Roads and Streets). If the applicant must park equipment, trucks, and/or cars in zones that will not permit it, the permittee must post the street as required by the City Engineer. The applicant must also obtain permission to string cable across sidewalks, or from generator to the service point. Traffic Control: For filming that would impair traffic flow, an applicant must use California Highway Patrol (CHP), County Sheriff or local law enforcement personnel and comply with all traffic control requirements deemed necessary. 1. If required for traffic safety or as a condition of the film permit, an applicant shall furnish and install advance warning signs and any other traffic control devices in conformance with the Manual of Traffic Controls, State of California, Department of Transportation. All appropriate safety precautions shall be taken. 2. All interruptions of normal pedestrian or vehicular traffic must be authorized on the permit. Police officers or Fire District personnel assigned to on-site supervision may further restrict operations based on safety concerns. 3. Traffic shall not be detoured without prior approval by the City. 4. Unless authorized by the City, camera cars shall be driven in the direction of traffic and shall observe all traffic laws. 5. Any emergency roadwork or construction by State or local government agencies and/or private contractors under permit or contract to the City shall have priority over filming activities. Resolution No. 90-015 Pa ge 3 SECTION 6: Flood Control. The permittee shall obtain all necessary permits and approvals from the San Bernardino Flood Control District prior to filming in a flood control facility. SECTION 7: State Highwaj/s. The permittee shall obtain all necessary permits and approvals from the State Department of Transportation (Caltrans) prior to filming on a State Highway, including, but not limited to, Foothill Boulevard, 19th Street and Highland Avenue east of Haven.
