HomeMy WebLinkAbout90-395 - Resolutions RESOLUTION NO. 90-395 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING DESIGN REVIEW FOR TENTATIVE TRACT NO. 14866, A RESIDENTIAL SUBDIVISION OF 47 SINGLE FAMILY LOTS ON 8.7 ACRES OF LAND LOCATED AT THE SOUTHEAST CORNER OF LEMON AVENUE AND LONDON AVENUE IN THE LOW-MEDIUM RESIDENTIAL DISTRICT (4-8 DWELLING UNITS PER ACRE), AND MAKING FINDINGS IN SUPPORT THEREOF A. Recitals. (i) The Pennhill Company has filed an application for the Design Review of Tract No. 14866 as described in the title of this Resolution. Hereinafter, the subject Design Review request is referred to as "the a ppl i cati on". (ii) On July 11, 1990, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. After considering all public testimony, the Planning Commission adopted its Resolution No. 90-96 approving the application. (iii) The decision represented by said Planning Commission Resolution was timely appealed to this Council by Biscayne Development, the owner of a parcel directly south of the project site. (iv) On October 3, 1990, the City Council of the City of Rancho Cucamonga conducted a duly noticed public hearing to hear an appeal filed on the application and concluded said hearing on that date. (v) All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resol uti on. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby find, determine, and resolve as follows: 1. This Council hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Council during the above-referenced meeting on October 3, 1990, including written and oral staff reports, this Council hereby specifically finds as follows: (a) That the proposed project is consistent with the objectives of the General Plan; and (b) That the proposed design is in accord with the objectives of the Development Code and the purposes of the district in which the site is located; and Resolution No. 90-395 Page 2 (c) That the proposed design is in compliance with each of the applicable provisions of the Development Code; and (d) That the proposed design, together with the conditions applicable thereto, will not be detrimental to the public health, safety or welfare or materially injurious to properties or improvements in the vicinity. 3. Based upon the findings and conclusions set forth in paragraphs 1 and 2 above, this Council hereby approves the application subject to each and every condition set forth below: Planning Division 1} All Conditions of Approval as contained in Planning Commission Resolution No. 90-96 shall apply. 4. This Council hereby provides notice to The Pennhill Company that the time within which judicial review of the decision represented by this Resolution must be sought is governed by the provisions of California Code of Civil Procedure Section 1094.6. 5. The City Clerk of the City of Rancho Cucamonga is hereby directed to {a) certify to the adoption of this Resolution, and {b} forthwith transmit a certified copy of this Resolution, by certified mail, return-receipt requested, to The Pennhill Company at the address identified in City records.
