A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAMONGA, CALIFORNIA, APPROVING DRAINAGE ACCEPTANCE
AGREEMENT, IMPROVEMENT AGREEMENTS, IMPROVEMENT SECURITIES
AND SECURITY DEPOSIT FOR DEVELOPMENT REVIEW NO. 89-14
WHEREAS, the City Council of the City of Rancho Cucamonga has for its
consideration two Improvement Agreements executed on August 23, 1990, by
American Pacific Concrete Pipe Company, Inc. as developer, for the on-site
Private Storm Drain Improv6ments and for the improvement of public right-of-
way adjacent to and on the real property specifically described therein, and
generally located on the south side of Arrow Route and east of the Interstate
15 Freeway; and
WHEREAS, the installation of such improvements, described in said
Improvement Agreements and subject to the terms thereof, are to be done in
conjunction with the development of said real property as referred to Planning
Commission, Development Review No. 89-14; and
WHEREAS, said Improvement Agreements are secured and accompanied by
good and sufficient Improvement Security and a security deposit which are
identified in said Improvement Agreements; and
WHEREAS, to meet a requirement established as prerequisite to
approval of said Development Review said Developer has offered the Drainage
Acceptance Agreement submitted herewith for Approval and Execution by said
City.
NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does
hereby resolve as follows:
1. That said Improvement Agreements be and the same are
approved and the Mayor is authorized to execute same
on behalf of said City and the City Clerk is
authorized to attest thereto; and
2. That said Improvement Securities and Security
Deposit are accepted as good and sufficient, subject
to approval as to form and content thereof by the
City attorney; and
3. That said Drainage Acceptance Agreement be and the
same are approved and the Mayor is authorized to
execute same on behalf of said City and the City
Clerk is authorized to attest thereto.
