A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAMONGA, CALIFORNIA, SUMMARILY ORDERING THE VACATION OF
A PUBLIC UTILITY AND DRAINAGE EASEMENT ON A PORTION OF
LOT 5 OF TRACT 10045
WHEREAS, by Chapter 4, Article 1, Section 8330, of the Streets and
Highway Code, the City Council of the City of Rancho Cucamonga is authorized
to summarily vacate a portion of the City easement hereinafter more
particularly described; and
WHEREAS, the City Council found all the evidence submitted that a
public utility and drainage easement on a portion of Lot 5 of Tract 10045 is
unnecessary for present or prospective public easement purposes because the
easement has not been used for the last 6 years.
NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does
hereby resolve as follows:
SECTION 1: That the City Council of the City of Rancho Cucamonga
hereby makes its order vacating that portion of street on Map V-095 on file in
the office of the City Clerk of the City of Rancho Cucamonga, which has been
further described in a legal description which is attached hereto, marked
Exhibit "A", and by reference made a part thereof.
SECTION 2: That from and after the date the resolution is recorded,
said easement vacation as described in Exhibit "A" and shown on Exhibit "B" no
longer constitutes a public utility easement.
SECTION 3: That the City Clerk shall cause a certified copy of this
resolution to be recorded in the office of the County Recorder of San
Bernardino County, California.
PASSED, APPROVED, and ADOPTED this 15th day of August, 1990.

THE CITY OF RANCHO CUCAMONGA, COUNTY OF SAN BERNARDINO, STATE OF
CALIFORNIA, AS PER PLAT RECORDED IN BOOK 164 OF MAPS, PAGES 77 AND
78 IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY, THE
SOUTHWESTERLY LINE OF SAID STRIP BEING THE SOUTHWESTERLY LINE OF
SAID LOT 5.
