HomeMy WebLinkAbout90-309 - Resolutions RESOLUTION NO. 90-309 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, COUNTY OF SAN BERNARDINO, STATE OF CALIFORNIA, DECLARING ITS INTENTION TO VACATE KINLOCK AVENUE LOCATED SOUTH OF HIGHLAND AVENUE, APPROXIMATELY 40 FEET WIDE AND 248 FEET LONG - APN: 1076-101-01 BE IT RESOLVED by the City Council of the City of Rancho Cucamonga as fol 1 ows: SECTION 1: That the City Council hereby elects to proceed under Section 8300, et. seq., of the Streets and Highways Code, also known as the Street Vacation Act of 1941. SECTION 2: That the City Council hereby declares its intention to vacate a portion of Kinlock Avenue, located south of Highland Avenue, a City Street approximately 40 feet wide and 248 feet long, as shown on Map No. V-091 on file in the Office of the City Clerk, a legal description of which is attached hereto marked Exhibit "A" and by reference made a part hereof. SECTION 3: That the City Council hereby fixes Wednesday, the 15th day of August, 1990, at 7:00 p.m., in the City Hall Council Chamber, located at 10500 Civic Center Drive, Rancho Cucamonga, California, as the time and place for hearing all persons objecting to the proposed vacation for the purpose of its determining whether said City Street is necessary for present or prospective street purposes. SECTION 4: That the City Street Superintendent shall cause notices to be posted conspicuously along the line of the street or part thereof proposed to be vacated at least 15 days before the hearing, not more than 30 feet apart and not less than three signs shall be posted, each of which shall have a copy of this resolution on them and shall have the following title in lettering not less than one inch in height: "NOTICE OF HEARING TO VACATE STREET". SECTION 5: The subject vacation shall be subject to the reservations and exceptions, if any, for existing utilities on record. SECTION 6: The Mayor shall sign this Resolution and the City Clerk shall attest to the same, and the City Clerk shall cause same to be published 10 days before the date set for the hearing, at least once in Inland Valley, Daily, Bulletin, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of Rancho Cucamonga California. A~lams, City Cler~Fl~'-~'~ Resolution No. 90-309 Page 3 EXHIBIT "A" 40 FOOT ACCESS EASEMENT All that certain real property situated in the City of Rancho Cucamonga, County of San Bernardino, State of California, being over a portion of Parcel 2, as said Parcel 2 is shown on Map No. 4232 recorded in Book 40, pages 57 and 58 of parcel maps, said portion being a strip of land 40 feet in width and lying 20 feet each side of the following described center line: Beginning at a point on the northerly line of said Parcel 2, distant thereon N 89°, 53' 29" E, 173.58 feet from the northwest corner of said Parcel 2; thence from said point of beginning S 0°, 11' 37" W, 248.83 more or less to a point on the southerly line of said Parcel 2, distant thereon 169.48 feet from the southwest corner of said Parcel 2.
