(i) Lewis Homes ba.~ filed a sign request as described in the title of this ~msolution. Hereinafter in this Resolution, the subject sign request is referred to as the "application." (ii) On September 25, 1991, the Planning C~.t,~ssion of the City of Rancho Cucamonga conducted a public meeting and denied the application. (iii) The decision represented by said Planning Co~m~ission Minutes was timely appealed to this Council. (iv) On December 4, 1991, the City Council of the City of Pancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. (v) All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby find, determine, and resolve as follows: 1. This Oouncil hereby specifically finds that all of the facts set forth in the R~citals, Part "A," of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Council during the above-referenced December 4, 1991 hearing, including written staff reports and the minutes of the above-referenced Planning C~m~,~ssion meeting, this Council hereby specifically finds as follows: (a) The application applies to property located at the north- east corner of Foothill Boulevard and Haven Avenue, and on property zoned as a Cu~m~,,.l.nity C~,~rcial District, and is currently developed as a shopping (b) The applicant proposed to place a wall sign on the tower of Building G. The proposed location for the wall sign is not an approved loca- tion according to the approved Uniform Sign Program. (c) The C~mp~ssion, at the Workshop of December 21, 1989, imposed a condition of approval for Buildings E and G prc~_ibiting the placement of wall signs on the towers. Resolution No. 91-375 Page 2 (d) There are alternative locations to place the wall sign. 3. Based upon the substantial evidence presented to this Council during the above-referenced public hearing, including written and oral staff reports, this Council hereby finds and concludes as follows: (a) The placement of the wall sign on the tower of Building G would be inconsistent with the Uniform Sign Program and the action of the December 21, 1989, C~,,LHssion action. (b) The placement of the wall sign on the tower would detract frc~ the design of the tower which is the focal point of the Terra Vista Town 4. The City Council of the City of Rancho Cucamonga hereby denies the application. 5. This Council hereby provides notice to Lewis Homes that the time within which judicial review of the decision represented by this Resolution must be sought is governed by the provisions of California Code of Civil Prooedure Section 1094.6. 6. The City Clerk of the City of Rancho Cucamonga is hereby directed to: (a) certify to the adoption of this Resolution, and (b) forthwith transmit a certified copy of this Resolution, by certified mail, return- receipt requested, to L~wis Homes at the address identified in City records. 8.
