Recitals. (i) On April 6, 1981, the City of Rancho Cucamonga approved the enau~nt of the General Plan through the adoption of Resolution No. 81-40. (ii) On August 5, 1991, the City of Rancho Cucamonga filed an application for General Plan Amendment No. 91-03, Subarea H, as described in the title of this Resolution. Hereinafter in this Resolution, the subject General Plan Amendment is referred to as "the application." (iii) On October 9, 1991, the Planning C~m~ssion of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and following the conclusion of said public hearing, adopted Resolution No. 91-159 rec~mtend~ to the City Countil that the application be approved. (iv) On November 20, 1991, the City Council of the City of Rancho Cucamonga conducted a duly noticed public hearing and concluded said hearing prior to the adoption of this R~solution. (v) All legal prerequisites prior to the adoption of this Resolution B. Resolution. NOW, THEREFORE, the city Council of the City of Rancho Cucamonga does hereby find, determine, and resolve as follows: 1. ~nis Council hereby specifically finds that all of the facts set forth in the R~citals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Council during the above-referenced public hearing on November 20, 1991, including written and oral staff reports, together with public testimony, this Council hereby specifically finds as follc~s: (a) The application applies to 23.03 acres of land located on the southeast corner of Victoria Park Lane and Rochestar Avenue and is presently undeveloped. Said property is currently designated Medium Residen- tial (8-14 dwelling units per acre); and Resolution No. 91-362 Page 2 (b) The property to the north of the subject site, past the Southern Pacific Railroad right-of-way, is designated Flood Control/Utility Corridor and is developed with a flood control retention basin; the property to the south is designated Medium Residential (8-14 dwelling units per acre) and is developed with an existing, nonconforming lumber yard; the property to the east is designated Flood Control/Utility Corridor and is vacant; and the property to the west is designated L~um R~sidential (4-8 dwelling units per acre) and is developed with single family residenoes; and (c) This amendment does not conflict with the ~and Use Policies of the General Plan and will provide for development, within the district, in a manner consistent with the General Plan and with related development; and (d) This amendment promotes the goals and objectives of the Land Use Element; and (e) The properties located in Subarea H of the application are suitable for the uses permitted in the proposed district and are compatible with existing and adjacent land use designations as evidenced by the location of properties with the same land use designations bordering the subject site to the west; (f) ~11is amendment would not have a significant impact on the environment nor on the surroundir~ properties as evidenoed by the findings and conclusions listed in Parts I and II of the Initial Study; and 3. This Oouncil hereby finds that the project has been reviewed and considered in co~pli~ with the California Environmental Quality Act of 1970 and, further, this Council hereby issues a Negative Declaration. 4. Based upon the findings and conclusions set forth in paragraphs 1, 2, and 3 above, this Council hereby resolves to approve General Plan Amendment 91-03, Subarea H, amending the General Plan ~ Use Map frc~ Medium Residential (8-14 dwelling units per acre) to Low-Medium Residential (4-8 dwelling units per acre) for 23.03 acres of land located on the southeast cozller of Victoria Park Lane and Rochester Avenue as shown in Exhibit "A." 5. The City Clerk shall certify to the adoption of this Resolution. PASS~D, ~, and ADOI~I~D this 20th day of N~, 1991.
