HomeMy WebLinkAbout91-355 - Resolutions RESOLUTION NO. 91-355 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CJCAMONGA, CALIFORNIA, APPROVING G~ERAL PLAN ~ 91-03, SUBAREA B, AM~qDING THE G~IRAL PLAN LAND USE MAP FRC~ M~DIL~-HIGH RESIDeNtiAL (14-24 DWi,LING UNITS PER ACRE) TO M~D1T~ RESIDenTIAL (8-14 DW~.LrNG UNITS PER ACRE) FOR 19.3 ACRES OF IAND ~ ON THE ~ SIDE OF FINDINGS IN SUPPOR~ THEREOF - APN: 227-091-14 AND 15 A. Recitals. (i) On April 6, 1981, the City of Rancho Cucamonga approved the enactment of the General Plan t~ the adoption of Resolution No. 81-40. (ii) On August 5, 1991, the city of Rancho Cucamonga filed an application for General Plan Amendment No. 91-03, Subarea B, as described in the title of this Resolution. Hereinafter in this Resolution, the subject General Plan Amendment is referred to as "the application." (iii) On October 9, 1991, the Planning C~m~dssion of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and following the conclusion of said public hearing, adopted Resolution No. 91-167 rec~m-~nding to the City Council that the application be approved. (iv) On November 20, 1991, the City Council of the City of Rancho Cucamonga conducted a duly noticed public hearing and concluded said hearing prior to the adoption of this Rmsolution. (v) All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby find, determine, and resolve as follows: 1. ~o_is Council hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Council during the above-referenced public hearing on November 20, 1991, including written and oral staff reports, together with public testimony, this Council hereby specifically finds as follows: (a) ~ne application applies to 19.3 acres of land located on the north side of Base Line Road, west of Victoria Park Lane and is presently undeveloped. Said property is currently designated Medium-High Residential (14-24 dwelling units per acre); and Resolution No. 91-355 Page 2 (b) ~ne property to the north of the subject site, past the Southern Pacific Railroad right-of-way, is designated Low Residential (2-4 dwelling units per acre) and is developed with single family residences; the property to the south is designated High Residential (24-30 dwelling units per acre) and is developed with an existing, nonconforming industrial building used to produce wine vineqar; the properties to the east are designated Medium-High Residential (14-24 dwelling units per acre) and Neighborhood C~,..~rcial and are developed with a cor~'um project under construction and a c~m,~rcial shopping center; and the property to the west is designated Medium-High Residential (14-24 dwelling units per acre) and is developed with a recreational vehicle self-storage facility; and (c) This amendment does not conflict with the Tand Use Policies of the General Plan and will provide for development, within the district, in a manner consistent with the General Plan and with related development; and (d) This amendment promotes the goals and objectives of the Land Use Element; and (e) The properties located in Subarea B of the application are suitable for the uses permi~ in the proposed district and are compatible with existing and adjacent land use designations as evidenced by the location of properties with lower density land use designations bordering the subject site to the north; and (f) ~nis amendment would not have a significant impact on the environment nor on the surrounding properties as evidenced by the findings and conclusions listed in Parts I and II of the Initial Study; and 3. This Council hereby finds that the project has been reviewed and considered in cc~pli~ with the California Environmental Quality Act of 1970 and, further, this Council hereby issues a Negative Declaration. 4. Based upon the findings and conclusions set forth in paragraphs 1, 2, and 3 above, this Council hereby resolves to approve General Plan Amendment 91-03, Subarea B, amending the General Plan Land Use Map from Medium-High Residential (14-24 dwelling units per acre) to Medium Residential (8-14 dwelling units per acre) for 19.3 acres of land located on the north side of Base Line Road, west of Victoria Park Tane as shown in Exhibit "A." 5. The City Clerk shall certify to the adoption of this Resolution. PASS~D, APPrOVeD, and ADOPTED this 20th day of November, 1991.
