(Aprvd 4-0-1/Wright)////NOT APPRDVED RESOLUTION NO. 91-207 A RESOLUTION OF THE CITY OOUNCIL OF THE CITY OF RANCHO ~, CALIFORNIA, APPROVING ~ PLAN ~ 91-02B, SUBAREA 5, AMenDING THE G~ERAL PLAN IAND USE MAP FR~4 M~DIL~ RESID~AL (8-14 E~m~LTNG ~ PER Af~E) TO LOW M~DIL~ RESID~fIAL (4-8 E~,L~NG ~ PER AC~E) FOR APPRD~Y 30.72 AC~ES OF LAND BORDereD ON THE NORI~5~,~T BY THE ONTARIO (I-15) ~, ON ~{E FAST BY DESIGNATED LAND, AND ON THE SOUTH BY MII.LwR AV~qUE, AND MAKING FINDINGS IN SUPPO~ TH~DF - APN: 1100-031-08, 1100-041-04 THROUGH 10, 1100-051-03, AND 1100-061-02 THRf)L~ 04, AND POI~IONS OF 1100-071-01 AND 02. A. Recitals. (i) On April 6, 1981, the city Council of the City of Rancho Cucamonga approved the enactment of the General Plan through the adoption of Resolution No. 81-40. (ii) On March 15, 1991, the City of Rancho Cu~ filed an application for General Plan Amendment No. 91-02B as described in the title of this Resolution. Hereinafter in this Resolution, the subject General Plan Amendment is referred to as "the application." (iii) On May 22, and continued to May 29, 1991, the Planning C~t~.~ssion of the City of Rancho Cucamonga conducted duly noticed public hearings on the application and following the conclusion of said public hearings, made no rec~m,~ndation to the City Council. (iv) on July 17, 1991, the City Council of the City of Rancho Cucamonga held a duly noticed public hearing and concluded said hearing prior to its adoption of this Resolution. (v) All legal prerequisites prior to the adoption of this ~solution B. Resolution. NOW, THEREFORE, the city Council of the City of Rancho Cucamonga does hereby find, determine and resolve as follows: 1. This Council hereby specifically finds that all of the facts set forth in the ~citals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Council during the above-referenced public hearing on July 17, 1991, including written and oral staff reports, together with public testimony, this Council hereby specifically finds as follows: Resolution No. 91-207 Page 2 (a) Subarea 5 of the application applies to approximately 30.72 acres of land, basically a linear configuration, bordered on the northwest by the Ontario (I-15) Freeway, on the east by East Avenue and existing Low Medium Residential designated land, and on the south by Miller Avenue as shown on Exhibit "A," and is presently underdeveloped with three single family residences in the southwestern most portion. Said properties are currently designated as Medium Residential (8-14 dwelling units per acre); and (b) The property to the northwest of the subject site is designated freeway and is the Ontario (I-15) Freeway. The property to the east is designated Low Medium Residential and is underdeveloped with single family residences facing Miller Avenue and on the opposite side of East Avenue it is designated Office (OFC) in the City of Fontana's West End Specific Plan. The property to the south on the opposite side of Miller Avenue is designated Medium Residential and is vacant; and (c) This amendment does not conflict with the Land Use Policies of the General Plan and will provide for development, within the district, in a manner consistent with the General Plan and with related development; and (d) ~nis amendment does promote the goals and objectives of the Land Use Element; and (e) That the properties located in Subarea 5 of the application are suitable for the uses permitted in the proposed district and are compat- ible with existing and .a.djaoent land use designations as evidenced by the site's being bordered on rne southeast by the same land use designation; and (f) That the proposed amendment would not have significant impacts on the environment nor on the surrounding properties as evidenced by the findings and conclusions listed in Parts I and II of the Initial Study and that the proposed designation would reduce the intensity of future residential development on the subject properties; and (g) That the proposed amendment is in conformanoe with the General Plan by prc~oting the retention of Etiwanda's rural atmosphere thr~ reduced residential densities. 3. This Council hereby finds that the project ham been reviewed and considered in compli~ with the California ~vironmental Quality Act of 1970 and, further, this Council hereby issues a Negative Declaration. 4. Based upon the findings and conclusions set forth in paragrat~hs 1, 2, and 3 above, this Oouncil hereby approves General Plan Amendment No. 91-02B, Subarea 5, amending the General Plan Land Use Map frc~ Medium Residential (8-14 dwelling units per acre) to Low Medium Residential (4-8 dwelling units per acre) for approximately 30.72 acres of land bordered on the northwest by the Ontario (I-15) freeway, on the east by East Avenue and existing Low Medium Residential designated land, and on the south by Miller Avenue, as shown in Exhibit "A". Resolution No. 91-207 Page 3 5. The City Clerk shall certify to the adoption of this Resolution.
