HomeMy WebLinkAbout91-198 - Resolutions RESOIlrfION NO. 91-198 A RESOIJ3TION OF THE CITY COUNCIL OF THE CITY OF RANCHO ClXlAMONGA, CALIFORNIA, APPROVING ~ B(XILEVARD SPECIFIC PLAN AMEN/kMflqT 91-03 AMfl~DING THE ~ ~ SPECIFIC PLAN LAND USE MAP FRC~ MfDIt~ RESIDflgTIAL (8-14 UWF[.T.TNG UNITS PER ACRE) TO A ~ C~v~4~RClAL DESIGNATION WITH A MASTER PLAN Pd~Q~ FOR 2.0 ACRES OF LAND LOCATf~ ON THE NORTHEAST CORNER OF ~.L BO~ AND ~A AVfNUE, AND MAK/]gG FINDINGS IN SUPPORT THERfDF - APN: 1100-161-02 A. Recitals. (i) On September 16, 1987, the City Council of the City of Rancho Cucamonga approved the enactment of the Foothill Boulevard Specific Plan through adoption of Rmsolution No. 87-505. (ii) On November 15, 1990, Planning Network, on behalf of Charles V. Cummins, filed an application for Foothill Boulevard Specific Plan Amendment No. 91-03, requesting a Conmunity Co~-~rcial land use designation for the subject property as described in the title of this Resolution. Hereinafter in this Resolution, the subject Foothill Boulevard Specific Plan Amendment is referred to as "the application." (iii) on May 22, 1991, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and following the conclusion of said public hearing, adopted Resolution No. 91-53 rec~u~JKting to the City Council that said application be approved and a Negative Declaration be certified. (iv) on July 17, 1991, the City Council of the City of Rancho Cucamonga held a duly noticed public hearing and concluded said hearing prior to its adoption of this Resolution. (v) All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby find, determine and resolve as follows: 1. ~nis Council hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Council during the above-referenced public hearing on July 17, 1991, including written and oral staff reports, together with public testimony, this Council hereby specifically finds as follows: Resolution No. 91-198 Page 2 (a) The application applies to approximately 2.0 acres of land located on the northeast corner of Foothill Boulevard and Etiwanda Avenue with a street frontage of 630 feet and is presently developed with a vacant service station. Said property is currently designated Medium ~sidential (8-14 dwelling units per acre); and (b) The property to the north of the subject site is designated Medium Residential (8-14 dwelling units per acre) and is underdeveloped with a single family home. The property to the south is designated Cuit. t,unity C~t,[L~_rcial and is undeveloped. The property to the east is designated Medium Residential (8-14 dwelling units per acre) and is developed with an existing, non-conforming market. The property to the west is designated C~tm~unity C~m~rcial and is developed with a vacant market and motel; and (c) This amendment does not conflict with the Land Use Policies of the General Plan or the Foothill Boulevard Specific Plan and will provide for development, within the district, in a manner consistent with the General Plan and With related development; and (d) This amendment promotes the goals and objectives of the Land Use Element; and (e) That the subject property is suit~_ble for the proposed specific plan designation of Con~¥unity Col,~t~rcial as evidenced by the site's being in close proximity to properties on the west and south which have C~tutt.lnity OJ~t~t~rcial land use designations; and (f) That the proposed amendment would not have significant impacts on the environm~_nt nor on the surrounding properties as evidenced by the findings and conclusions listed in Parts I and II of the Initial Study of this application and of General Plan Amendment 90-02B and that the issuance of a Negative Declaration is appropriate; and (g) That the proposed amendment is in conformance with the General Plan, the Development Code, and the Foothill Boulevard Specific Plan. 3. This Council hereby finds that the project has been reviewed and considered in c~t~liance with the California Environmental Quality Act of 1970 and, further, this Council hereby issues a Negative Declaration. 4. Based upon the findings and conclusions set forth in paragraphs 1, 2, and 3 above, this Council hereby approves Foothill Boulevard Specific Plan Amendment No. 91-03, amending the Foothill Boulevard Specific Plan Land Use Map from Medium Residential (8-14 dwelling units per acre) to a C~mtt~nity C~mt~rcial designation with a Master Plan requirement for 2.0 acres of land located on the northeast corner of Foothill Boulevard and Etiwanda Avenue, as shown on Exhibit "A." 5. The City Clerk shall certify to the adoption of this Resolution. Resolution No. 91-198 Page 3 PASS~D, APPROVED, and ADOPTSD this 17th day of July, 1991.
