HomeMy WebLinkAbout91-195 - Resolutions RESOD31~ON NO. 91-195 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING GENERAL PLAN ~ 90-02B AM~qDING THE GENERAL PLAN LAND USE MAP FROM M~DIUM RESID~h~iTAL (8-14 DW~.LTNG UNITS PER ACRE) TO C(~9~RCIAL (WITH A MASTER PLAN Pd~QLrEp~ DESIGNATION) FOR 10.89 ACRES OF LAND LOCATED ON THE NORTH SIDE OF FOOTHILL BOULEVARD, EAST OF ~ AVENUE, AND MAKING FINDINGS IN SUPPORP THERtI)F - APN: 1100-161-04 A. Recitals. (i) On April 6, 1981, the City Council of the City of Rancho Cucamonga approved the enauG~nt of the General Plan through adoption of Resolution No. 81-40. (ii) On July 16, 1990, FORMA, on behalf of Group 66 Partr~rship, filed an application for General Plan Amendmant No. 90-02B, requesting a C~m¥~_rcial land use designation for the subject property as described in tb~ title of this Resolution. Hereinafter in this Resolution, the subject General Plan Amendment is referred to as "the application." (iii) On May 22, 1991, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and following the conclusion of said public hearing, adopted Resolution No. 91-50 recu~.L~nding to the City Council that said application be approved and a Negative Declaration be certified. (iv) On July 17, 1991, the City Council of the City of Rancho Cucamonga held a duly noticed public hearing and concluded said hearing prior to its adoption of this Resolution. (v) Ail legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, TH~{EFORE, the City Council of the City of Rancho Cucamonga does hereby find, determine and resolve as follows: 1. This Council hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Council during the above-referenced public hearing on July 17, 1991, including written and oral staff reports, together with public testimony, this Council hereby specifically finds as follows: (a) The application applies to approximately 10.89 acres of land located on the north side of Foothill Boulevard approximately 500 feet east of Etiwanda Avenue with a street frontage of 815 feet and a lot depth of 526.74 feet and is presently undeveloped. Said property is currently designated as Medium Residential (8-14 dwelling units per acre); and Resolution No. 91-195 Page 2 (b) The properties to the north and east of the subject site are designated Medium Residential (8-14 dwelling units per acre) and are undeveloped. The property to the south is designated Low Residential (2-4 dwelling units per acre) and is developed with single family hc~=s. The property to the west is designated Medium R~sidential (8-14 dwelling units per acre) and is developed with an existing, non-conforming market. (c) This amendment does not conflict with the Land Use Policies of the General Plan and will provide for development, within the district, in a manner consistent with the General Plan and with related development; and (d) This amendment promotes the goals and objectives of the Land Use Element; and (e) That the subject property is suit~Dle for the proposed land use designation of Co~uL~rcial as evidenced by the site's being in close proximity to properties on the west, east, and south with C~u~ercial land use designations; and (f) That the proposed amendment would not have significant impacts on the environment nor on the surrounding properties as evidenced by the findings and conclusions listed in Part I and II of the Initial Study of this application and that the issuance of a Negative Declaration is appropriate; and (g) That the proposed amendment is in conformance with the General Plan, Development Code, and Foothill Boulevard Specific Plan. 3. This Council hereby finds that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Council hereby issues a Negative Declaration. 4. Based upon the findings and conclusions set forth in paragraphs 1, 2, and 3 above, this Council hereby approves General Plan Amendment No. 90-02B, amending the General Plan Land Use Map frc~ Medium Residential (8-14 dwelling units per acre) to Co~t~rcial (with a Master Plan requirement designation) for 10.89 acres of land located on the north side of Foothill Boulevard east of Etiwanda Avenue, as shown on Exhibit "A." 5. The City Clerk shall certify to the adoption of this Rmsolution. PASS~D, APPROVED, and ADOPI~Dthis 17thday of July, 1991.
